Jhanwar\n\n\n\n       Dated:02\/07\/2009\n\n\n\n\n:       Judgment\n\n\n\n                     J U D G M E N T\n<\/pre>\n<pre>                   (Delivered on    02 .07.2009)\n\nR.L.Jhanwar, J.\n\n<\/pre>\n<p>     The  appellant  has preferred this appeal  against  the<br \/>\njudgment   of   conviction  and  order  of  sentence   dated<br \/>\n22.3.1999,  passed  by  the 2nd Additional  Sessions  Judge,<br \/>\nJagdalpur at Bastar in S.T.No.309\/1989, whereby the  learned<br \/>\n2nd  Additional Sessions Judge has convicted  the  appellant<br \/>\nunder  Section 326 of the IPC and sentenced him  to  undergo<br \/>\nR.I. for 5 years and to pay a fine of Rs.5,000\/-, in default<br \/>\nof payment of fine to further undergo R.I. for 1 year.\n<\/p>\n<p>      The  story  of  the prosecution in short  is  that  on<br \/>\n2.3.1989,  at about 1.15 p.m. Ganesh and Munendra  assaulted<br \/>\nShankar  Prasad  Tiwari (PW-5) with hand and fists.  Shankar<br \/>\nPrasad  Tiwari  ran  away  from  the  spot  and  fell  down.<br \/>\nThereafter, Munendra assaulted him with knife on  his  back,<br \/>\nas  a  result of which, he became unconscious.  Some persons<br \/>\nsaw   the  incident  and  informed  the  complainant-   PW1-<br \/>\nRajeshwari  about it.  Rajeshwari lodged a First Information<br \/>\nReport  (Ex.P\/1)  in  the  Police  Station.   The  case  was<br \/>\nregistered against the present appellant and Munendra  under<br \/>\nSection  307  read  with Section 34  of  the  IPC.   Injured<br \/>\nShankar   Prasad   Tiwari   was   medically   examined   and<br \/>\ninvestigation   took   place.  After   completion   of   the<br \/>\ninvestigation, charge sheet was filed in the Court of  Chief<br \/>\nJudicial  Magistrate, Jagdalpur, who in turn  committed  the<br \/>\ncase  to the Sessions Judge. The learned Sessions Judge made<br \/>\nover   the  case  to  the  2nd  Additional  Sessions  Judge,<br \/>\nJagdalpur for trial.\n<\/p>\n<p>      The  learned Additional Sessions Judge framed  charges<br \/>\nagainst  the appellant and Munendra under Section 307\/34  of<br \/>\nthe  IPC, read over and explained it to them.  Both of  them<br \/>\nabjured  the  guilt  and their defence  was  that  they  are<br \/>\ninnocent and have been falsely implicated in this case.\n<\/p>\n<p>      During  the  course of trial, accused  Munendra  died,<br \/>\ntherefore,  the learned trial Court struck out the  name  of<br \/>\nMunendra, as the case against him has been abated.\n<\/p>\n<p>     The   learned  2nd  Additional  Sessions  Judge,  after<br \/>\nevaluating the evidence available on record and hearing  the<br \/>\ncounsel  for  respective parties, acquitted  the  appellant-<br \/>\nGanesh  under Section 307 of the IPC; however, he  convicted<br \/>\nand sentenced the appellant under Section 326 of the IPC.\n<\/p>\n<p>      I have heard learned counsel for the parties at length<br \/>\nand perused the record.\n<\/p>\n<p>      Rajeshwari (PW-1), who lodged the F.I.R. (Ex.P\/1)  has<br \/>\nstated  that one Nanu Jangla came and told that her  brother<br \/>\nShankar Prasad Tiwari has been assaulted by Munna, she  went<br \/>\nto   the  spot  and  saw  that  her  brother  was  lying  in<br \/>\nunconscious  condition near the Mandir.   She  reported  the<br \/>\nmatter  to  the  Police.   She is not  an  eye-witness.  The<br \/>\ninjured (PW-5)- Shankar Prasad Tiwari, has stated that  near<br \/>\nthe  Mahadev Mandir, the appellant &amp; Munendra surrounded him<br \/>\nand  assaulted him with hands and fists.  He  ran  away  and<br \/>\nfell down, thereafter; Munendra came there and assaulted him<br \/>\nwith  knife.   He  specifically stated that  the  appellant-<br \/>\nGanesh  did  not assault him with knife.  He nowhere  stated<br \/>\nthat  when Munendra was assaulting him with knife, appellant<br \/>\nGanesh in any way assisted Munendra.  He also did not  state<br \/>\na  single  word  that the appellant also took  part  in  the<br \/>\nincident when he was assaulted with knife by Munendra.\n<\/p>\n<p>     The  learned  trial  Court, for the  injury  caused  by<br \/>\nknife, has convicted the appellant under Section 326 of  the<br \/>\nIPC,  whereas,  from the evidence, it is  evident  that  the<br \/>\nappellant neither assaulted Shankar Prasad Tiwari with knife<br \/>\nnor  he  assisted Munendra when he was inflicting the  knife<br \/>\ninjury.   The  learned trial Court held that  there  was  no<br \/>\ncommon intention; therefore, the learned trial Court did not<br \/>\nconvict the appellant with the aid of Section 34 of the IPC.<br \/>\nSection 34 of the IPC reads as follow-\n<\/p>\n<p>     When  a  criminal  act is done by  several  persons  in<br \/>\nfurtherance  of the common intention of all,  each  of  such<br \/>\npersons is liable for that act in the same manner as  if  it<br \/>\nwere done by him alone.\n<\/p>\n<p>     For  deciding the facts that any act has been  done  in<br \/>\nfurtherance  of common intention, it is necessary  to  asses<br \/>\nthe  evidence minutely and to record a clear finding on  the<br \/>\nmaterial  available on record. How a person by  any  of  his<br \/>\nacts  is liable for commission of any offence in furtherance<br \/>\nof common intention. If that person neither took any part in<br \/>\nthe  crime  nor  assisted  the  other  accused  person,  who<br \/>\ncommitted  the crime, only because prior to the incident  he<br \/>\nwas  in  the  company of other accused,  who  committed  the<br \/>\ncrime, that alone, is not sufficient to hold him guilty  for<br \/>\ncommitting the offence in furtherance of common intention.\n<\/p>\n<p>     In  the instant case, Munendra and Ganesh were together<br \/>\nprior to the incident but when Munendra inflicted injury  to<br \/>\nShankar  Prasad  Tiwari  with knife, the  appellant  neither<br \/>\nassisted   Munendra in inflicting the knife  injury  nor  he<br \/>\nhimself assaulted  Shankar Prasad Tiwari.\n<\/p>\n<p>     In the facts and circumstances of the case, there is no<br \/>\nevidence  to convict &amp; sentence the appellant for commission<br \/>\nof the offence under Section 326 of the IPC.\n<\/p>\n<p>      For  the foregoing reasons, the appeal deserves to  be<br \/>\nallowed.  The judgment of conviction and order  of  sentence<br \/>\npassed  by  the  trial  Court against  the  appellant  under<br \/>\nSection  326  of  the IPC is set aside.   The  appellant  is<br \/>\nacquitted  of the charge under Section 326 of the  IPC.
