Dwivedi,P.K.Gupta\nRespondent Counsel :- C.S.C.,Siddharth Verma\n\nHon'ble Devendra Pratap Singh,J.\n<\/pre>\n<p>      Heard learned counsel for the parties.\n<\/p>\n<p>      It is a sad story of how a lawyer son is employing his legal<br \/>\ncapabilities against his own father.\n<\/p>\n<p>      The petitioner in this petition is the father of respondent no. 5.\n<\/p>\n<p>      It appears that the petitioner let out a premises for opening a<br \/>\nhospital to the respondent no. 2 under a duly executed rent deed but<br \/>\nwhen the father was about to receive the rent after sanction by the<br \/>\nGovernment, he instituted an injunction suit no. 248 of 2000 claiming<br \/>\nthat he was the landlord and owner of the tenanted premises and entitled<br \/>\nto rent wherein an interim injunction was granted which is challenged in<br \/>\nthe present writ petition.\n<\/p>\n<p>      Notices were issued to the respondents including the son asking<br \/>\nthem to file counter affidavit but about 9 years have elapsed yet no<br \/>\ncounter affidavit has been filed.\n<\/p>\n<p>      Today when the matter was taken up, the counsel for the<br \/>\nrespondent son produced a certified copy of an order dated 25.4.2003 by<br \/>\nwhich the respondent-tenant has been directed to deposit the rent in<br \/>\nCourt and it is claimed that the order was passed with the consent of the<br \/>\nparties. The aforesaid certified copy has been taken on record and its<br \/>\nperusal shows that in desperation, the petitioner father had no option<br \/>\nexcept to accede to the deposit of rent in Court, despite the fact that he<br \/>\nhas pleaded in the writ petition that the constructions were made after<br \/>\nobtaining a loan from a bank which is clamouring for repayment.\n<\/p>\n<p>      The suit had remained pending for the last 10 years and the court<br \/>\nhas been informed at the bar that no substantial progress has been made<br \/>\ndespite the fact that this court while entertaining this petition had passed<br \/>\n<span class=\"hidden_text\">                                                                            2<\/span><\/p>\n<p>an order on 8.5.2001 directing the trial court to expedite the trial of the<br \/>\ncase on priority basis.\n<\/p>\n<p>      After considering all the facts in detail, this petition is finally<br \/>\ndisposed off by the following directions:-\n<\/p>\n<p>   i) The trial court shall dispose off the suit no. 248 of 2000 Madan<br \/>\n      Gopal Ram Vs. Rajkiya Ayurvedi Chikitsalay and others within three<br \/>\n      months from the date of submission of a certified copy of this<br \/>\n      order;\n<\/p>\n<p>   ii) The plaintiff-respondent shall not be granted more than three<br \/>\n      adjournments and that too not exceeding for a period of more than<br \/>\n      a week at a time and after imposing cost of at least Rs.1000\/-<br \/>\n      payable to the petitioner-defendant;\n<\/p>\n<p>   iii) In case the cost for such adjournments is not paid before the next<br \/>\n      date fixed in the suit, the entire amount of rent which is in deposit<br \/>\n      with the court shall forthwith be released in favour of the petitioner-<br \/>\n      defendant on his personal security other than cash or bank<br \/>\n      guarantee;\n<\/p>\n<p>   iv) Learned District Judge, Ghazipur may monitor the disposal of the<br \/>\n      aforesaid suit.\n<\/p>\n<p>      Let a copy of this order be sent to the learned District Judge,<br \/>\nGhazipur to be made available to the trial judge for compliance.\n<\/p>\n<p>      It would further be open to the petitioner to approach this Court in<br \/>\nthe present petition in case the trial is not completed within the<br \/>\nprescribed time.\n<\/p>\n<p>Order Date :- 8.7.2010<br \/>\nAU\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Allahabad High Court Mangla Rai vs Govt.
