The Board shows that the notice is<br \/>\n\tserved on the respondents.   Despite service of notice, no one has<br \/>\n\tfiled his appearance on behalf of the respondents.\n<\/p>\n<p>The<br \/>\n\tbrief facts giving rise to the present Second Appeal are that the<br \/>\n\tplaintiff is an agriculturist and the defendants are also<br \/>\n\tagriculturists.  The plaintiff is having a land in the sim of<br \/>\n\tvillage Kinkaria.  The plaintiff has got a land bearing Survey No.6<br \/>\n\tadmeasuring 23 Acres 03 Gunthas.  From this land, a water canal is<br \/>\n\talso passing.  On the south of the plaintiff&#8217;s land, there is a land<br \/>\n\tbearing Survey No.7 which originally belonged to Kanbi Kanji Jadav.<br \/>\n\tThe said land was purchased by Balu Vagha in an auction and from<br \/>\n\tBalu Vagha, the said land was purchased by Mangalshi Dulabhai and<br \/>\n\tfrom Mangalshi Dulabhai, defendant No.1 purchased the said land and<br \/>\n\the is in possession of the same.  It is the case of the defendant<br \/>\n\tNo.1 that the land of Survey No.7 was purchased by defendant No.2.<br \/>\n\tThe way for going to Survey No.7 is adjacent to Dudhala road and<br \/>\n\tthen there is west land of Nerda which is situated in the northern<br \/>\n\tside of Survey No.7.  The defendant is not having any right of way<br \/>\n\tthrough the plaintiff&#8217;s field. Yet the defendant has tried to pass<br \/>\n\tthrough the plaintiff&#8217;s field.  Hence, he filed the suit.  It is<br \/>\n\talso the case of the plaintiff that he is the owner of the field<br \/>\n\tbearing Survey Nos.6 &amp; 11\/2 and defendant is the owner of<br \/>\n\tportion of land which is part of Survey No.7 and situated in the<br \/>\n\tsame land of village Kinkaria.  The plaintiff has contended that<br \/>\n\tthere is field of defendants&#8217; father in west of Survey No.6 and in<br \/>\n\tthe south from it, there is a field of defendant.  According to<br \/>\n\tplaintiff, the way of defendants for going to Survey No.7 is first<br \/>\n\talong Kinkaria   Dudhala road and then there is a Narda which is<br \/>\n\tsituated on the northern side of Survey No.7.  According to the say<br \/>\n\tof plaintiff, his way for Survey No.6 is first along the Kinkaria<br \/>\n\tDudhala road and then in the western Narda and then in the field of<br \/>\n\tSurvey No.7 which is in possession of Hari Harkha and Arvind Limba.<br \/>\n\tAccording to plaintiff, he has enjoyed his right to way as an<br \/>\n\teasement and without obstruction.  He has contended that he has no<br \/>\n\tother way except as described in the plaint.\n<\/p>\n<p>The<br \/>\n\tdefendants have filed their written statement and objected to the<br \/>\n\trelief claimed by the plaintiff in the suit.  The Trial Court after<br \/>\n\tconsidering the rival submissions and documentary evidence on<br \/>\n\trecord, has dismissed the plaintiff&#8217;s suit for declaration and<br \/>\n\tpermanent injunction.\n<\/p>\n<p>The<br \/>\n\tsaid judgment and decree was challenged in Regular Civil Appeal<br \/>\n\tbefore the learned Extra Assistant Judge, Bhavnagar who partly<br \/>\n\tallowed the appeal and held that the plaintiff has got right of way<br \/>\n\tto his Survey No.11\/2 admeasuring 5 Acres 13 Gunthas from the<br \/>\n\teastern shedha of defendants Survey No.7 as easement and the<br \/>\n\tdefendants were permanently restrained from obstructing plaintiff<br \/>\n\tand his persons from using the said way.  The defendants were also<br \/>\n\trestrained from obstructing the plaintiff and his persons from<br \/>\n\ttaking cattle from the said way.  The rest of the prayers of the<br \/>\n\tplaintiffs were, however, rejected by the lower Appellate Court.\n<\/p>\n<p>It<br \/>\n\tis this order of the learned Extra Assistant Judge which is under<br \/>\n\tchallenge in the present Second Appeal.\n<\/p>\n<p>I<br \/>\n\thave heard learned advocate appearing for the appellant and perused<br \/>\n\tthe orders passed by the Courts below.  From the plain reading of<br \/>\n\tthe orders passed by both the Courts below, it clearly appears that<br \/>\n\tthe dispute between the parties center round the factual data and no<br \/>\n\tsubstantial question of law arises out of the orders of the Courts<br \/>\n\tbelow.  The learned lower Appellate Court has considered the rival<br \/>\n\tsubmissions and also discussed at great length the order passed by<br \/>\n\tthe Trial Court and then arrived at the aforesaid conclusion.  It is<br \/>\n\tnothing but appreciation of facts and evidence on record.  The Court<br \/>\n\tis of the view that no infirmity or illegality is committed by the<br \/>\n\tlower Appellate Court.  This Second Appeal does not call for any<br \/>\n\tinterference by the Court.  It is accordingly dismissed.  There<br \/>\n\tshall be no order as to costs.\n<\/p>\n<p>In<br \/>\n\tview of the order passed in Second Appeal, Civil Application does<br \/>\n\tnot survive and it is accordingly disposed of.\n<\/p>\n<p>\t\t\t\t\t\t\t\t\tSd\/-\n<\/p>\n<p>\t\t\t\t\t\t\t\t[K.
