MUKHOPADHAYA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\nDate\n: 13\/07\/2011  \nORAL ORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE J.B.PARDIWALA)<\/p>\n<p>1.\tCommon<br \/>\njudgment and order dated 29.4.2001 passed by the learned Single Judge<br \/>\nin Special Civil Application Nos.  13066 of 2010 and 3930 of 2011 is<br \/>\nthe subject matter of challenge in these appeals.\n<\/p>\n<p>2.\tThe<br \/>\nappellant-original petitioner challenged the order dated 6th<br \/>\nSeptember, 2010 passed by the learned Principal Senior Civil Judge,<br \/>\nGandhinagar below exh. 336 in Special Civil Suit No. 100 of 2001,<br \/>\nwhereby the learned Civil Judge ordered to recast issue no.3 in the<br \/>\nmain suit.
