She seeks to<\/p>\n<p>challenge the common order passed in I.A.No.1896\/2010 in<\/p>\n<p>O.P.No.553\/2009. O.P.No.553\/2009 is filed by the respondent<\/p>\n<p>for custody of the minor children and the same was allowed vide<\/p>\n<p>Annexure B order on a joint statement filed by both parties,<\/p>\n<p>stating that custody of the children can be granted to the<\/p>\n<p>respondent. It is the case of the appellant that when the custody<\/p>\n<p>of the children were handed over to the respondent, he had<\/p>\n<p>harassed the children and all the three children ran away from<\/p>\n<p>the house of the respondent\/father and were found wandering<\/p>\n<p>through the street, from where, Child Welfare Committee,<\/p>\n<p>Malappuram took the children and after hearing the children<\/p>\n<p>sent along with the grand mother considering the welfare of the<\/p>\n<p>children. The order is produced as Annexure C. The children<\/p>\n<p>are totally unprepared to go with the father.\n<\/p>\n<p><span class=\"hidden_text\">Mat.Appeal No.7 of 2011          2<\/span><\/p>\n<p>      2.     According to the appellant, the appellant filed<\/p>\n<p>W.P.C.No.22179\/2010 to quash the consent order in Annexure B.<\/p>\n<p>The same was disposed of by Annexure A wherein the court<\/p>\n<p>relegated the appellant to approach the Family Court to file a<\/p>\n<p>fresh petition. Accordingly I.A.No.1896\/2010 was filed by the<\/p>\n<p>appellant. The appellant also filed I.A.No.1879\/2010 for staying<\/p>\n<p>the proceedings pursuant to Annexure B order. The respondent<\/p>\n<p>filed I.A.No.1664\/2010 for a direction to the appellant to comply<\/p>\n<p>with Annexure B order. All the three applications were<\/p>\n<p>considered and a common order was passed for which the<\/p>\n<p>appellant has chosen to challenge the order passed in<\/p>\n<p>I.A.No.1896\/2010.       The learned counsel for the respondent<\/p>\n<p>would contend that the I.A itself is not maintainable.<\/p>\n<p>      3.     We have heard the learned counsel for the appellant<\/p>\n<p>and the learned counsel for the respondent. In the impugned<\/p>\n<p>order, the Family Court has noted at paragraph 5 that though<\/p>\n<p>the I.As were posted for evidence, the mother has submitted that<\/p>\n<p>she has no evidence to adduce either oral or documentary in<\/p>\n<p>these three IAs and the father has produced and marked Exts.B1<\/p>\n<p>to B7. According to the appellant, the matter was not posted for<\/p>\n<p>evidence. We called for the report from the Family Court. It is<\/p>\n<p><span class=\"hidden_text\">Mat.Appeal No.7 of 2011            3<\/span><\/p>\n<p>inter alia stated that I.As were posted for enquiry. Both sides<\/p>\n<p>were heard and posted for orders on 30\/12\/2010 and thus, there<\/p>\n<p>was no specific posting for evidence. This is the report which is<\/p>\n<p>submitted by the Sheristadar after verification. In the nature of<\/p>\n<p>the case, we feel that an opportunity can be given to the<\/p>\n<p>appellant for adducing whatever evidence the appellant wants to<\/p>\n<p>adduce.      However, we feel that the matter should also be<\/p>\n<p>disposed of at the earliest.\n<\/p>\n<p>      4.     Accordingly, the impugned order in I.A.No.1896\/2010<\/p>\n<p>in O.P.No.553\/2009 of the Family Court, Malappuram is set<\/p>\n<p>aside.     The parties shall appear before the Family Court,<\/p>\n<p>Malappuram on 15\/01\/2011.             The court shall take up<\/p>\n<p>I.A.No.1896\/2010 and the parties shall be permitted to adduce<\/p>\n<p>such evidence as they are advised to.         The matter shall be<\/p>\n<p>disposed of within a period of two weeks from 15\/01\/2011.
