No. 10047 of 2010.<\/p>\n<p>                            This    I.A.    has    been    filed       by   the<\/p>\n<p>                  petitioner praying for liberty to challenge<\/p>\n<p>                  the     order    passed   by    the     respondents,      as<\/p>\n<p>                  contained in Annexures-7 and 8, by which the<\/p>\n<p>                  claim     of    the   petitioner       for    payment      of<\/p>\n<p>                  arrears of salary has been rejected on the<\/p>\n<p>                  ground that his services have already been<\/p>\n<p>                  terminated.\n<\/p>\n<p>                             Considering           the         facts        and<\/p>\n<p>                  circumstances of the case, the Interlocutory<\/p>\n<p>                  application      is   allowed.    The     petitioner       is<\/p>\n<p>                  granted    liberty to challenge the orders as<\/p>\n<p>                  contained in Annexures- 7 and 8 of the I.A.<\/p>\n<p>                            These four petitioners in these three<\/p>\n<p>                  writ applications initially moved this Court<\/p>\n<p>                  for payment of their arrears of salary. The<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>respondents          were    directed          to    file     counter<\/p>\n<p>affidavit       which        they       have     filed.       In     the<\/p>\n<p>counter affidavit they have taken stand that<\/p>\n<p>the    post     on     which       these       petitioners          were<\/p>\n<p>posted was later on found to be not existing<\/p>\n<p>and therefore, a problem arose with regard to<\/p>\n<p>payment    of    their        salary.         Instructions          were<\/p>\n<p>sought for from the Department. On receipt of<\/p>\n<p>the      same,         the        District           Compassionate<\/p>\n<p>Committee,       met        again       and     recommended          for<\/p>\n<p>their    appointment          as    teachers          in     terms    of<\/p>\n<p>circular       No.1078         dated       1.7.2006,          meaning<\/p>\n<p>thereby    that       they       were    to    be     appointed       as<\/p>\n<p>Panchayat Teacheres on fixed remuneration. To<\/p>\n<p>this    extent       the     earlier       resolution          of    the<\/p>\n<p>Compassionate          Committee         dated       29.9.2004       was<\/p>\n<p>modified and consequential orders have been<\/p>\n<p>issued    by     the      Regional       Deputy           Director    of<\/p>\n<p>Education, Bhagalpur, vide his memo No. 684<\/p>\n<p>dated     28.8.2010.          These       two       documents        are<\/p>\n<p>Annexure- 7 and 8 with the I.A. application<\/p>\n<p>of the petitioners.\n<\/p>\n<p>           Learned          counsel      for        the    petitioner<\/p>\n<p>drew     attention           of     this        Court         to     the<\/p>\n<p>proceeding       of        the      District         Compassionate<\/p>\n<p>Committee dated 29.9.2004, which is Annexure-<br \/>\n<span class=\"hidden_text\">                     3<\/span><\/p>\n<p>6    with   the    I.A.         From    this     proceeding      it<\/p>\n<p>appears that as many as 35 candidates were<\/p>\n<p>recommended for appointment on the post of<\/p>\n<p>clerk       i.e    Class-        III      post        under      the<\/p>\n<p>establishment of Regional Deputy Director of<\/p>\n<p>Education,        Bhagalpur,           which     included        the<\/p>\n<p>petitioners        also.         This     Court        fails      to<\/p>\n<p>understand as to why, after the petitioners<\/p>\n<p>moved this Court for payment of their arrears<\/p>\n<p>of    salary,     the     respondents          have   discovered<\/p>\n<p>that the posts of the petitioners were non<\/p>\n<p>existent and therefore, there was problem in<\/p>\n<p>release of their salary. This Court has an<\/p>\n<p>impression that these petitioners have been<\/p>\n<p>victimized only because they have moved this<\/p>\n<p>Court for arrears of salary.\n<\/p>\n<p>             In the circumstances, the respondent<\/p>\n<p>Regional      Deputy      Director       of     Education,        is<\/p>\n<p>directed to give the details of all the 35<\/p>\n<p>persons      who        were     recommended          for     their<\/p>\n<p>appointment on the post of clerk under his<\/p>\n<p>establishment and to place before this Court<\/p>\n<p>definite     evidence          and   materials        to    justify<\/p>\n<p>their stand        in respect of           the petitioners.<\/p>\n<p>This Court makes it clear that in case it is<\/p>\n<p>not    satisfied        with    the     explanation         of   the<br \/>\n<span class=\"hidden_text\">                              4<\/span><\/p>\n<p>            Regional     Deputy    Director,       it   may   consider<\/p>\n<p>            directing for payment of panel interest on<\/p>\n<p>            the arrears of salaries of the petitioners<\/p>\n<p>            from   the    packet     of     the    Regional    Deputy<\/p>\n<p>            Director.\n<\/p>\n<p>                       Learned    counsel    for    the   respondents<\/p>\n<p>            prays four weeks time for the purpose.<\/p>\n<p>                       Put up this case after four weeks, at<\/p>\n<p>            the same position.\n<\/p>\n<\/p>\n<pre>Devendra\/                         ( J.
