Justice R.BASANT\n\n Dated :08\/01\/2007\n\n O R D E R\n                                 R.BASANT, J\n\n                              ----------------------\n\n                          Crl.M.C.No.3777 of 2006\n\n                        ----------------------------------------\n\n                Dated this the 8th day of January   2007\n\n\n                                   O R D E R\n<\/pre>\n<p>      The   petitioner   claims   to   be   a   financier   in   respect   of   a<\/p>\n<p>vehicle.     The   second   respondent   herein   is   admittedly   the<\/p>\n<p>registered   owner   of   the   vehicle.     The   second   respondent<\/p>\n<p>complained to the police that a theft had taken place of the said<\/p>\n<p>vehicle.  The police, in the course of the investigation, seized the<\/p>\n<p>vehicle.     The   second   respondent   applied   for   release   of   the<\/p>\n<p>vehicle   under   Section     451   Cr.P.C.     His   was   the   earlier<\/p>\n<p>application for release.  Subsequently, the petitioner herein filed<\/p>\n<p>an   application   under   Section     451   Cr.P.C   for   release   of   the<\/p>\n<p>vehicle to him.   To a pointed query of this court, it is conceded<\/p>\n<p>that the petitioner has no case that the vehicle was seized from<\/p>\n<p>his   possession   by   the   police.     However,   he   claims   right   to   re-\n<\/p>\n<p>possess   the   vehicle   in   as   much   as   there   has   been   default   in<\/p>\n<p>payment of instalment by the second respondent.  Both petitions<\/p>\n<p>were   simultaneously   pending   before   the   learned   Magistrate.\n<\/p>\n<p>The learned Magistrate, without taking note of the pendency of<\/p>\n<p>the application filed by the petitioner, took up the petition filed<\/p>\n<p>by the  second  respondent  for  consideration   and  by  Annexure  A<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3777\/06                      2<\/span><\/p>\n<p>order   directed   the   release   of   the   vehicle   to   the   second<\/p>\n<p>respondent herein.\n<\/p>\n<p>      2.     Later,   it   was   brought   to   the   notice   of   the   learned<\/p>\n<p>Magistrate   that   the   petition   filed   by   the   petitioner   herein<\/p>\n<p>remains   without   disposal.     When   that   petition   came   up   for<\/p>\n<p>hearing,   the   learned   Magistrate   proceeded   to   pass   Annexure   B<\/p>\n<p>order.  In as much as Annexure A order could not be reviewed by<\/p>\n<p>the   learned   Magistrate,   sitting   as  a   criminal   court,   the   learned<\/p>\n<p>Magistrate   proceeded   to  pass  Annexure   B   order   dismissing   the<\/p>\n<p>petition filed by the petitioner.\n<\/p>\n<p>      3.     The   short   grievance   of   the   petitioner   is   that   for   an<\/p>\n<p>error   committed   by   the   court,   he   may   not   be   forced   to   endure<\/p>\n<p>prejudice.  Both petitions must have been disposed of together as<\/p>\n<p>the   identical   relief   &#8211;   release   of   the   vehicle   to   the   respective<\/p>\n<p>claimants under Section  451 Cr.P.C, was prayed.\n<\/p>\n<p>      4.     I do not intend to express any opinion on merits but I<\/p>\n<p>am satisfied that the grievance of the petitioner is justified.  Both<\/p>\n<p>petitions   must   have   been   disposed   of   together   and<\/p>\n<p>simultaneously by the learned Magistrate.\n<\/p>\n<p>      5.     What   then   is  the   best  course   that   the   court   can  now<\/p>\n<p>follow?\n<\/p>\n<p>      6.     I am satisfied that both Annexure A and B orders can<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.No.3777\/06                     3<\/span><\/p>\n<p>be   set   aside   and   the   learned   Magistrate   can   be   directed   to<\/p>\n<p>dispose   of   both   petitions   together   after   giving   the   rival<\/p>\n<p>contestants   opportunity   to   raise   and   substantiate   their<\/p>\n<p>contentions and disprove the contentions of the adversary.  Such<\/p>\n<p>direction shall satisfy the ends of justice eminently.\n<\/p>\n<p>      7.     The  vehicle  is now with  the second respondent.   The<\/p>\n<p>second   respondent   can   be   permitted   to   keep   the   vehicle   in   his<\/p>\n<p>possession   subject   to   fresh   orders   that   will   be   passed   by   the<\/p>\n<p>learned Magistrate as indicated above.  To that extent, Annexure<\/p>\n<p>A order though set aside as a final order shall be reckoned as an<\/p>\n<p>order   regarding   temporary   release   of   the   vehicle,   till   both<\/p>\n<p>petitions are disposed of afresh.\n<\/p>\n<p>      8.     In   the   result,   this  Criminal   Miscellaneous   Case    is<\/p>\n<p>allowed in part to the extent indicated above.\n<\/p>\n<p>      9.
