Jamjodhpur,<br \/>\n\tDist.Jamnagar  for the offence punishable under Sections 397, 395,<br \/>\n\t34 and 504 of  Indian Penal Code and 25(1)(a)(b) of Arms Act.\n<\/p>\n<p>Learned<br \/>\n\tadvocate, Mr.V.H.Kanara, referring to the FIR and other papers,<br \/>\n\tsubmitted that considering the nature of offence as discussed in<br \/>\n\timpugned judgment and order dated 30.8.2010, present application may<br \/>\n\tbe allowed, as now the charge-sheet has been filed.\n<\/p>\n<p>Ms.Mini<br \/>\n\tNair, learned APP, resisted the application and she has also<br \/>\n\tsubmitted that applicant has been attributed with specific role.\n<\/p>\n<p>Having<br \/>\n\theard learned advocate Mr.V.H.Kanara, for the applicant, learned<br \/>\n\tAPP, Ms.Nair for respondent-State and having considered the nature<br \/>\n\tof offence, manner in which it is alleged to have been committed,<br \/>\n\trole attributed and also considering the fact that charge-sheet has<br \/>\n\tnow been filed, the present application deserves to be allowed.\n<\/p>\n<p>\tAccordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No. 30 of 2009<br \/>\n\tregistered with Jamjodhpur Police Station, Tal. Jamjodhpur,<br \/>\n\tDist.Jamnagar on his executing a bond of Rs.5,000\/- (Rupees Five<br \/>\n\tThousand) with one solvent surety of the like amount to the<br \/>\n\tsatisfaction of the lower Court and subject to the conditions that<br \/>\n\the shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tmark<br \/>\nhis presence before concerned Police Station on 1st Monday<br \/>\nof every month between 11.00 AM to 2.00 PM till the trial commences.\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender<br \/>\n\this passport, if any, to the lower Court, within a week.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>\tBail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>\tRule<br \/>\n\tis made absolute.
