Also  perused  the  record.\n<\/p>\n<p>It<br \/>\n\tappears that one offence being DCB Police Station Prohi.C.R.No.5011<br \/>\n\tof 2009 dated 27-5-2009 under the prohibition Act has been<br \/>\n\tregistered against the detenue  alleging that 1100 liters of country<br \/>\n\tliquor mixed with ethyl acetate chemical,  800 liters of country<br \/>\n\tliquor mixed with ethyl acetate chemical, 57 liters of country<br \/>\n\tliquor mixed with chemical and 5 liters of country liquor mixed with<br \/>\n\tghycol chemical were found from the possession of the detenu. On the<br \/>\n\tbasis of registration of the said case, the detaining authority held<br \/>\n\tthat since the activities of selling country made liquor of the<br \/>\n\tpresent detenu were harmful to the health of the public, to restrain<br \/>\n\thim from carrying further illegal activities, he has been detained.<br \/>\n\tIt appears from the order that the activities of the detenu cannot<br \/>\n\tbe said to be disturbing the  public order .  It also appears<br \/>\n\tfrom the order passed by the detaining authority that  grounds which<br \/>\n\tare mentioned in the order are in reference to the situation of  law<br \/>\n\tand order  and not  public order . Therefore, on this ground,<br \/>\n\tthe subjective satisfaction arrived at by the detaining authority is<br \/>\n\tvitiated on account of non-application of mind and the impugned<br \/>\n\torder, therefore, deserves to be quashed and set aside.\n<\/p>\n<p>Except<br \/>\n\tthe statements of some anonymous witnesses, there is no material on<br \/>\n\trecord which shows that the detenu is carrying on activities of<br \/>\n\tselling country made liquor which is harmful to the health of the<br \/>\n\tpublic. In the case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki v.<br \/>\n\tPolice Commissioner, Surat<\/a> [(2001) (1) GLH 393), having<br \/>\n\tconsidered the decision of the Hon&#8217;ble Apex Court in the case of Ram<br \/>\n\tManohar Lohia v. State of Bihar (AIR 1966 SC 740), this Court<br \/>\n\theld that the case wherein the detention order passed on the basis<br \/>\n\tof the statements of the witnesses fall under the maintenance of<br \/>\n\t law and order  and not  public order .\n<\/p>\n<p>Applying<br \/>\n\tthe ratio of the above decisions, it is clear that before passing an<br \/>\n\torder of detention of a detenu, the detaining authority must come to<br \/>\n\ta definite finding that there is threat to the  public order<br \/>\n\tand it is very clear that the present case would not fall within the<br \/>\n\tcategory of threat to  public order . In that view of the<br \/>\n\tmatter, when the order of detention has been passed by the detaining<br \/>\n\tauthority without having adequate grounds for passing the said<br \/>\n\torder, it cannot be sustained and, therefore, it deserves to be<br \/>\n\tquashed and set aside.\n<\/p>\n<p>The<br \/>\n\tpetition is allowed. The impugned order of detention dated 31-8-2009<br \/>\n\tpassed by the Police Commissioner,  Ahmedabad City passed  against<br \/>\n\tthe detenu is hereby quashed and set  aside.   The detenu is ordered<br \/>\n\tto be set at liberty forthwith,  if  not  required  in  any other<br \/>\n\tcase.    Rule is made absolute accordingly.
