The learned Judge has observed in para-4 as under:-\n<\/p>\n<p> 4.\tAfter<br \/>\nhearing both advocates and considering the facts and circumstances of<br \/>\nthe case stated in this chamber summons and the reply filed by the<br \/>\ndefendant No.5 resisting this chamber summons,  this Court is of<br \/>\nthe opinion that earlier while pending the suit the defendants No.1,<br \/>\n2 and 3 have sold away the property by way the of Banakhat to the<br \/>\npresent defendant No.5 and the amount of Rs.50,00,000=00 was stated<br \/>\nas damage to the plaintiff and instead of Rs.50,00,000=00 now the<br \/>\nplaintiff has sought permission to enhance upto Rs.2,50,00,000=00<br \/>\nwhich cannot be permitted  because it changes the whole<br \/>\nnature of the suit so far as amount of Rs.50,00,000=00 is concerned.<br \/>\n Under these circumstances, this chamber summons requires to be<br \/>\ndismissed.  Therefore, the following order is passed.\n<\/p>\n<p> ORDER<\/p>\n<p>This chamber<br \/>\nsummons stands dismissed with no order as to costs.\n<\/p>\n<p>Dictated and<br \/>\npronounced in the open Court on this 22nd day of June,<br \/>\n2009.\n<\/p>\n<p>(emphasis<br \/>\nsupplied)<\/p>\n<p>This<br \/>\nCourt is not able to understand as to how come the  whole nature<br \/>\nof the suit gets changed by substituting the amount of damages.\n<\/p>\n<p>3.\tLearned<br \/>\nAdvocate Mr.Patel for the opponent vehemently submitted that it does<br \/>\nchange the  nature<br \/>\nof the suit.\n<\/p>\n<p>\tHowever,<br \/>\nhe is not able to explain to this Court as to how the  nature<br \/>\nof the suit changes.  In view of that, the matter requires<br \/>\nconsideration.\n<\/p>\n<p>4.\t RULE.\n<\/p>\n<p> Learned Advocate Mr.Ashok N.Parmar waives service of Rule on behalf<br \/>\nof opponent Nos.1 to 3 and learned Advocate Mr.Patel waives service<br \/>\nof Rule on behalf of opponent Nos.4 and 5.\n<\/p>\n<p>\tAt the joint<br \/>\nrequest of the learned Advocates, the matter is taken up for<br \/>\nconsideration.\n<\/p>\n<p>5.\tHaving<br \/>\nperused the order impugned, the Court finds no justification for<br \/>\nmaking an observation that by substituting the amount of<br \/>\nRs.2,50,00,000\/- in place of original amount of Rs.50,00,000\/-, how<br \/>\ndoes the  whole nature<br \/>\nof the suit changes.  In absence of any reasoning given in support of<br \/>\nthe said conclusion drawn by the learned Judge, the petition is<br \/>\nallowed.  The impugned order dated 22.06.2009 passed by the learned<br \/>\nJudge in Chamber Summons in Civil Suit No.2146 of 2006 is quashed and<br \/>\nset aside.  The Chamber Summons to be heard again by the learned<br \/>\nJudge and after hearing the contesting parties on the same, the<br \/>\nlearned Judge to pass a reasoned order.  Rule is made absolute.
