\nRule.\n<\/p>\n
Mr. Dabhi, learned APP waives service of Notice of Rule on behalf of
\nthe respondent-State.\n<\/p>\n

\nMr. Buch, learned advocate for the applicants and Mr. Dabhi, learned
\nAPP for the respondent-State.\n<\/p>\n
3.\tThis
\napplication seeking regular bail under Section 439 of the Code of
\nCriminal Procedure, 1973 has been preferred by applicants in
\nconnection with the offence registered with Jhalod Police Station,
\nDistrict : Dahod
\nbearing
\nCR No.I-63 of 2011
\nfor
\nthe offence punishable under Sections 147, 148, 149, 325, 395, 387
\nand 427 of the Indian Penal Code.\n<\/p>\n
4.\tMr.\n<\/p>\n
Buch, leaned advocate for the applicants has submitted that the
\nalleged incident occurred pursuant to the election of Jhalod Kelavni
\nMandal and allegations and counter allegations by two groups, who are
\ncontesting the election, has been made and consequently, cross
\ncomplaints have been filed. He has also submitted that in case of a
\ncross complaint filed by the present applicant ,the accused has been
\nreleased on bail vide order dated 08.06.2011 in Criminal Misc.
\nApplication No.7675 of 2011 and therefore, he seeks parity in the
\npresent case.\n<\/p>\n
5.\tThe
\napplication is opposed by Mr.Dabhi, learned APP, who has submitted
\nthat the applicants had  committed the alleged offence which is
\nserious in nature and that therefore, the application deserves to be
\nrejected.\n<\/p>\n
6.\tThe
\nparties do not desire a reasoned order, however, having heard the
\nlearned counsel for both the sides and considering the facts and
\ncircumstances of the case as well as the documents and other material
\nproduced on record of this case, the gravity of the offence, the
\nquantum of punishment, the allegations against the applicants, the
\nmanner in which the applicants are allegedly involved in the case as
\nper the allegation of the prosecution, coupled with the fact that the
\naccused in cross complaint has been released by this Court vide order
\ndated 08.06.2011, I am of the view that the applicants deserve to be
\nreleased on bail, I am inclined to allow this application and release
\nthe applicants.\n<\/p>\n

\n\tHence,
\nthis application is allowed. It is directed that the present
\napplicants in connection with CR
\nNo.I-63 of 2011 registered
\nwith Jhalod Police Station, District : Dahod be released on bail, in
\nrespect of the offences alleged against them in this application, on
\ntheir executing and furnishing a bond of Rs.10,000\/- (Rupees: Ten
\nThousand Only) one for each of the applicants with two solvent surety
\nof like amount for each applicant, by the concerned Police Officer,
\nand on condition that they shall:-\n<\/p>\n
\t(a)
\nnot take undue advantage of or abuse the\tliberty.\n<\/p>\n
(b)
\nnot act in manner injurious to the interest of the prosecution.\n<\/p>\n
(c)
\nmaintain law and order.\n<\/p>\n
(d)
\nnot leave the State of Gujarat without prior permission of the
\nSessions Court concerned.\n<\/p>\n
(e)
\nfurnish the address of their residence at the time of execution of
\nbond and shall not change the residence without prior permission of
\nthe Sessions Court\/this Court.\n<\/p>\n
(f)
\nsurrender their passport, if any, to the lower court within 4 days
\nfrom the date of this order.\n<\/p>\n
(g)
\nmark their presence at the Jhalod Police Station, District : Dahod
\ninitially
\non 27th
\nJune,  2011 and thereafter on every first and fifteenth day of every
\nmonth, between
\n11.00
\na.m. to 3.00 p.m.<\/p>\n
(h)
\nnot to enter into the revenue limit of Dahod District till the trial
\nis over without prior permission of the Sessions Court, but for
\nmarking their presence and attending the Court in connection with
\nthis case the applicants will be free to enter the limits for a
\nperiod to the extent necessary and will leave the limits of Dahod
\nDistrict immediately after the case is adjourned.\n<\/p>\n
8.\tThe
\nauthorities will release the applicants only if they are not required
\nin any other offence for the time being.\n<\/p>\n
9.\tIf
\nbreach of any of the above conditions is committed the Sessions Judge
\nconcerned will be free to issue warrant or take any appropriate
\naction in the matter.\n<\/p>\n
10.\tBail-bond
\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n
11.\tAt
\nthe trial, the trial Court shall not be influenced by the
\nobservations, which are purely prima facie, tentative and preliminary
\nnature and have been made only for the purpose of examining prayer
\nfor bail pending the trial. The Court shall arrive at its own
\nconclusion independently on the basis of the evidence and other
\naspects of the case.\n<\/p>\n
12.\tRule
\nis made absolute to the aforesaid extent. Direct service is
\npermitted.\n<\/p>\n
