NANAVATI\n\n\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     This special  leave petition  arises from\tthe judgment<br \/>\nand order  of the  Orissa High\tCourt, made on September 18,<br \/>\n1996 in OJC No.2148\/95.\n<\/p>\n<p>     The petitioner was appointed as a clerk on June 1, 1974<br \/>\nagainst a vacancy. On August 9, 1990, she seems to have been<br \/>\nkept in-charge\tof teaching  post in  the school.  It is her<br \/>\nclaim that  pursuant thereto  she was teaching as a teacher.<br \/>\nSince no  action was  taken by\tthe authorities\t to have her<br \/>\nappointed as a teacher, she filed OJC No.671\/91 on March 27,<br \/>\n1992 and  pending disposal  interim direction  was  granted.<br \/>\nPursuant  thereto,   she  was\tappointed  with\t provisional<br \/>\napproval by  the Director  on August  4,  1992.\t On  a\twrit<br \/>\npetition filed\tby the\t5th respondent\ton  April  15,\t1993<br \/>\nalleging that  she was\tnot entitled to the post, the matter<br \/>\nwas directed to be reconsidered. The Director refused appeal<br \/>\nby proceeding dated March 4, 1995 resulting in filing of the<br \/>\npresent writ  petition. It  is contended that the High Court<br \/>\nwas not\t right in  rejecting the claim of the petitioner, on<br \/>\nthe  ground   that  all\t  those\t cases\twhich  were  pending<br \/>\nconsideration, required\t to be\tdecided in  accordance\twith<br \/>\nFull Bench  judgment of\t the High  Court in  OJC No.5361\/91,<br \/>\ndecided on  December 2,\t 1994. Since  the petitioner&#8217;s claim<br \/>\nwas  already  considered  and  approval\t was  given  by\t the<br \/>\nDirector, it  is not a pending case and she must, therefore,<br \/>\nbe  appointed  as  a  teacher.\tWe  find  no  force  in\t the<br \/>\ncontention.\n<\/p>\n<p>     It is  seen that  appointment should  be in  accordance<br \/>\nwith the  Rules to  a post  as defined under Section 2(b) of<br \/>\nthe Orissa  Education (Recruitment and Conditions of Service<br \/>\nof Teachers  and Members  of the  Staff of  Aided  Education<br \/>\nInstitutions) Rules,  1974. Since the petitioner was working<br \/>\nin a  clerical post,  she is not entitled to be approved and<br \/>\nthe view  taken by  the Director is correct. Admittedly, she<br \/>\nwas appointed  as a  clerk. While working as clerk, the mere<br \/>\nfact that  she was kept in charge of the teaching post, does<br \/>\nnot confer  any right  to appointment to a post, because she<br \/>\nwas not\t initially appointed  to a  teaching post.  The Full<br \/>\nBench, therefore,  has rightly\tinterpreted that the initial<br \/>\nappointment should be to a teaching post and a clerk, though<br \/>\ndirected to  discharge the duties as a teacher, cannot claim<br \/>\nthe post  as a\tteacher. Consequently,\tthe earlier Division<br \/>\nBench judgment\tof the\tHigh Court  was set aside. Resultant<br \/>\noperation was  that all\t those cases  which had become final<br \/>\nwere directed not to be reopened and all those cases pending<br \/>\nconsideration  either\tin  writ   petition  or\t before\t the<br \/>\nauthorities were  required to  be dealt\t with in  accordance<br \/>\nwith the  Rules. Though\t the  petitioner  was  provisionally<br \/>\ngiven approval\tpursuant to the direction issued by the High<br \/>\nCourt in  the said writ petition, that would be only subject<br \/>\nto the\tappointment and\t since no  appointment could be made<br \/>\nand was\t in fact not made, the order could not be said to be<br \/>\nin accordance  with  the  Rules.  The  provisional  approval<br \/>\ngranted\t by  the  Director  cannot  be\tconstrued  to  be  a<br \/>\nratification of the petitioner&#8217;s appointment as teacher. The<br \/>\nview of\t this Court  in Krishna Chandra v. State of Orissa &amp;<br \/>\nOrs.  [CA  No.13755\/96]\t decided  on  November\t1,  1996  is<br \/>\nconsistent with\t the above  view and  is of  no help  to the<br \/>\npetitioner. Under  these circumstance,\twe do  not find\t any<br \/>\nillegality in  the order passed by the High Court warranting<br \/>\ninterference.\n<\/p>\n<p>     The special leave petition is accordingly dismissed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Smt.
