HEMA,J\n                       ----------------------\n                    B.A.No.2749 OF 2010\n                -----------------------------------\n          Dated this the 18th day of May , 2010\n\n\n                           O R D E R\n<\/pre>\n<p>     This is a petition for bail.\n<\/p>\n<p>     2. The alleged offences are under section 120B, 302<\/p>\n<p>r\/w 34 IPC. According to prosecution, petitioner (woman)<\/p>\n<p>and the deceased Raseela were residing in the same house.<\/p>\n<p>Petitioner was having illicit relationship with CW 10 and 11<\/p>\n<p>which was objected to by deceased Raseela. Petitioner<\/p>\n<p>became pregnant also. The deceased informed about the<\/p>\n<p>affairs of petitioner to petitioner&#8217;s husband, who was<\/p>\n<p>working abroad. Due to this petitioner nurtured enmity<\/p>\n<p>towards deceased Raseela and she along with accused No.2<\/p>\n<p>and 3 administered poison         on deceased Raseela, mixed<\/p>\n<p>with Soda and alcohol on 4.8.2008 and the deceased died<\/p>\n<p>due to poisoning.\n<\/p>\n<p>     3. Petitioner was arrested on 2.8.2008 and she is in<\/p>\n<p><span class=\"hidden_text\">B.A. No.2749                    2<\/span><\/p>\n<p>custody for the past one year and eight months.             It is<\/p>\n<p>submitted that      second accused (a juvenile) and third<\/p>\n<p>accused were released on bail.\n<\/p>\n<p>      4. Learned public prosecutor submitted that as per the<\/p>\n<p>instructions given, if the petitioner is released on bail, it is<\/p>\n<p>dangerous to her own life, since the relatives of deceased<\/p>\n<p>Raseela are likely to retaliatewho live in the same locality.<\/p>\n<p>Committal proceedings are pending.\n<\/p>\n<p>      5. On hearing both sides, I am satisfied that petitioner<\/p>\n<p>is in custody for the past one year and eight months and the<\/p>\n<p>only ground of objection is that relatives of the deceased<\/p>\n<p>Raseela will retaliate if petitioner is visiting her house in the<\/p>\n<p>same locality.    But it appears to me that to prevent any<\/p>\n<p>untoward incident, it is sufficient if conditions are imposed.<\/p>\n<p>Any way, there is no ground to justify further detention of<\/p>\n<p>petitioner in prison.\n<\/p>\n<\/p>\n<p>      6. Hence the following order is passed:<\/p>\n<blockquote><p>            Petitioner   is released     on    bail  on  her<\/p>\n<p><span class=\"hidden_text\">B.A. No.2749                     3<\/span><\/p>\n<p>             executing a bond for Rs. 50,000\/- with two<\/p>\n<p>             solvent securities each for the like sum to<\/p>\n<p>             the satisfaction of the learned Magistrate<\/p>\n<p>             concerned, on the following conditions :<\/p>\n<p>               i. Petitioner shall not enter the limits of<br \/>\n                  police station within which the deceased<br \/>\n                  Raseela and petitioner were residing.<\/p>\n<p>               ii.Petitioner   shall  report   before    the<br \/>\n                  investigating officer on every Monday,<br \/>\n                  between 10 AM and 1 PM.\n<\/p><\/blockquote>\n<blockquote><p>               iii.Petitioner  shall  not  influence      or<br \/>\n                  intimidate any witnesses.\n<\/p><\/blockquote>\n<blockquote><p>               iv.In case the petitioner violates any of the<br \/>\n                  conditions, the bail is liable to be<br \/>\n                  cancelled.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<p>      Petition is allowed.\n<\/p>\n<\/p>\n<p>                                           K.
