Petitioner has prayed for declaring Rule 4 (ka)<\/p>\n<p>                       (ii) of Bihar Nagar Nikay Madhyamik Evam Uchchattar<\/p>\n<p>                       Madhyamik Shikshak (Niyojan Evam Seva Shartien)<\/p>\n<p>                       Niyamawali, 2006 as ultra vires and also seeking<\/p>\n<p>                       quashing of Annexure-1 whereby the appellate authority<\/p>\n<p>                       dismissed the appeal preferred by the petitioner against<br \/>\n<span class=\"hidden_text\">                       2<\/span><\/p>\n<p>cancellation of her appointment on the post of Hindi<\/p>\n<p>Teacher in Government Girls&#8217; High School, Purnea.<\/p>\n<p>         3.     Learned counsel for the State has raised a<\/p>\n<p>preliminary         objection   on    the   ground     of    res<\/p>\n<p>judicata\/constructive res judicata in the light of order<\/p>\n<p>dated 17.03.2009 contained in Annexure-15 whereby an<\/p>\n<p>earlier writ petition preferred by the petitioner and others<\/p>\n<p>bearing CWJC No. 10186\/2008 seeking relief against<\/p>\n<p>cancellation of appointment was dismissed as withdrawn<\/p>\n<p>without seeking any liberty to prefer fresh writ petition.<\/p>\n<p>         4. The fact that earlier writ petition preferred by<\/p>\n<p>the petitioner was dismissed as withdrawn without any<\/p>\n<p>liberty is not in dispute. Learned counsel for the<\/p>\n<p>petitioner has submitted that the ground of invalidity of<\/p>\n<p>the relevant Rule was not taken in the earlier writ<\/p>\n<p>petition and at that time a review petition was pending<\/p>\n<p>before        the   appellate   authority   which    has    been<\/p>\n<p>subsequently dismissed on 18.04.2009 vide an order<\/p>\n<p>which is a part of Annexure-1 series.\n<\/p>\n<p>         5.     An additional ground cannot form the basis<\/p>\n<p>for preferring a second writ petition as it would be barred<\/p>\n<p>by principles of constructive res judicata. So far as the<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>         pendency of a review petition is concerned, since the<\/p>\n<p>         review has been dismissed and the earlier appellate order<\/p>\n<p>         stands confirmed, there is no change in factual situation<\/p>\n<p>         to create a fresh cause of action for preferring a second<\/p>\n<p>         or subsequent writ petition. The appellate order dated<\/p>\n<p>         31.12.2008 was not interfered with by this Court when<\/p>\n<p>         the earlier writ petition was dismissed as withdrawn and<\/p>\n<p>         petitioner cannot be granted any relief unless the same<\/p>\n<p>         appellate order contained in Annexure-1 series is<\/p>\n<p>         interfered with or set aside.\n<\/p>\n<p>                6. Thus we find ourselves unable to give any<\/p>\n<p>         relief to the petitioner. The writ petition has to be held as<\/p>\n<p>         barred by principles of res judicata\/constructive res<\/p>\n<p>         judicata in view of law laid down in paragraph-13 of<\/p>\n<p>         Supreme Court judgment in the case of <a href=\"\/doc\/1684282\/\">Avinash Nagra<\/p>\n<p>         v. Navodaya Vidyalaya Samiti &amp; Ors<\/a> (1997)2 SCC<\/p>\n<p>         534.
