RAMKUMAR, J.\n             ------------------------------------------------\n              Bail Application No.8498 of 2010\n             ------------------------------------------------\n           Dated this the 3rd day of January, 2011\n\n                                ORDER\n<\/pre>\n<p>     Petitioners, who are accused Nos.1 &amp; 5 in Crime No.1326<\/p>\n<p>of 2010 of Parippally Police Station for offences punishable<\/p>\n<p>under Sections 143, 147, 148, 323, 324, 326 &amp; 427 read with<\/p>\n<p>Section 149 I.P.C., seek anticipatory bail.<\/p>\n<p>     2.    The    learned      Public     Prosecutor       opposed the<\/p>\n<p>application.\n<\/p>\n<p>     3.    After evaluating the factors and parameters which are<\/p>\n<p>to be taken into consideration in the light of paragraph 122 of<\/p>\n<p>the verdict dated 2-12-2010 of the Apex Court in <a href=\"\/doc\/1108032\/\">Siddharam<\/p>\n<p>Satlingappa Mhetre v. State of Maharashtra and Others<\/a><\/p>\n<p>(2010 (4) KLT 930), I am of the view that anticipatory bail<\/p>\n<p>cannot be granted in a case of this nature, since the<\/p>\n<p>investigating officer has not had the advantage of interrogating<\/p>\n<p>the petitioners.   But at the same time, I am inclined to permit<\/p>\n<p>the petitioners to surrender before the Investigating Officer for<\/p>\n<p>the purpose of interrogation and then to have their application<\/p>\n<p>B.A.No. 8498\/2010<br \/>\n<span class=\"hidden_text\">                                 -:2:-<\/span><\/p>\n<p>for bail considered     by the Magistrate or the Court having<\/p>\n<p>jurisdiction.    Accordingly, the petitioners shall surrender before<\/p>\n<p>the investigating officer on 12\/01\/2011 or on 13\/01\/2011 for<\/p>\n<p>the purpose of interrogation and recovery of incriminating<\/p>\n<p>material, if any. In case the investigating officer is of the view<\/p>\n<p>that   having regard to the facts of the case          arrest of the<\/p>\n<p>petitioners is imperative he shall record his reasons for the<\/p>\n<p>arrest in the case-diary as insisted in paragraph 129             of<\/p>\n<p>Siddharam Satlingappa Mhetre&#8217;s case (supra).                    The<\/p>\n<p>petitioners shall thereafter be produced before the Magistrate or<\/p>\n<p>the Court concerned and permitted to file an application for<\/p>\n<p>regular bail. In case the interrogation of the petitioners are<\/p>\n<p>without arresting them, the petitioners shall thereafter appear<\/p>\n<p>before the Magistrate or the Court concerned and apply for<\/p>\n<p>regular bail. The Magistrate or the Court on being satisfied that<\/p>\n<p>the petitioners have been interrogated by the police shall, after<\/p>\n<p>hearing the prosecution as well, consider and dispose of<\/p>\n<p>their application for regular bail preferably on the same<\/p>\n<p>date on which it is filed.\n<\/p>\n<p>B.A.No. 8498\/2010<br \/>\n<span class=\"hidden_text\">                                -:3:-<\/span><\/p>\n<p>     4.      In case the petitioners while surrendering before<\/p>\n<p>the Investigating Officer have deprived        the investigating<\/p>\n<p>officer sufficient time for interrogation, the officer shall<\/p>\n<p>complete the interrogation even if it is beyond the time limit<\/p>\n<p>fixed as above      and submit a report to that effect to the<\/p>\n<p>Magistrate or the Court concerned.
