1.The petitioner, who was conducting toddy shops<\/p>\n
 for the last around seven abkari years, was given<\/p>\n
 the privilege to vend toddy for the current<\/p>\n
 abkari year also. In terms of Rue 7(15) of the<\/p>\n
 Kerala Abkari Shops Disposal Rules, 2002, for<\/p>\n
 short, the “Disposal Rules”, the petitioner is<\/p>\n
 obliged to conduct the shop and to keep it open<\/p>\n
 in terms of that sub rule. Admittedly, no order<\/p>\n
 of closure, either temporary or permanent, was<\/p>\n
 issued by the competent authority. But, Ext.P17<\/p>\n
 show cause notice for cancellation of licence in<\/p>\n
 terms of Section 26(b) of the Abkari Act read<\/p>\n
 with Rule 7(15) of the Disposal Rules is issued<\/p>\n
 on the admitted fact that the petitioner had not<\/p>\n
 commenced operations from the shops in question<\/p>\n
 and they were kept closed.\n<\/p>\n

2.Respondents 5 and 6 are police officers. They are<\/p>\n
 attributed     with   malafides    in   as  much  as,<\/p>\n
 according     to  the  petitioner,    on   account of<\/p>\n
 certain illegal gains that the said persons would<\/p>\n
 make from third parties and because of prejudice<\/p>\n
 towards the petitioner, he was falsely implicated<\/p>\n
 in   a     criminal  case     for  offences  allegedly<\/p>\n
 punishable under Sections 55(a) and (i) of the<\/p>\n
 Abkari Act. The allegation against the petitioner<\/p>\n
 in   the    criminal   case    is   that  a  car  was<\/p>\n
 intercepted and the petitioner was apprehended,<\/p>\n
 it having been found that the car was loaded with<\/p>\n
 about     72  litres  of     spirit  which  could  be<\/p>\n
 gainfully     employed  for    utilisation  as  liquor<\/p>\n
 which would be spurious and prohibited in terms<\/p>\n
 of the Abkari Act in the State of Kerala.<\/p>\n
3.The petitioner was granted bail by this Court. On<\/p>\n
 his    application   seeking     a  vigilance  enquiry<\/p>\n
 against the conduct of respondents 5 and 6, this<\/p>\n
 Court     issued  Ext.P25     judgment  recording the<\/p>\n

 submission of the Government that the matter is<\/p>\n
 being     looked into.     The   respondents do  not<\/p>\n
 contradict the petitioner’s assertion that all<\/p>\n
 his previous years as an abkari licensee remained<\/p>\n
 unblemished.\n<\/p>\n<\/p>\n
4.While the learned Government Pleader appears on<\/p>\n
 behalf of the officials of the Excise Department,<\/p>\n
 the fact of the matter remains that respondents 5<\/p>\n
 and 6, who are impleaded in person, have not<\/p>\n
 placed any counter affidavit controverting the<\/p>\n
 personal allegations levelled against them. May<\/p>\n
 be that, such course is being adopted by them on<\/p>\n
 appropriate     advice,     having   regard  to  the<\/p>\n
 undertaking given by the Government before this<\/p>\n
 Court that the complaint against them is being<\/p>\n
 looked into through the Vigilance Department.<\/p>\n
5.After    issuing Ext.P17     show cause  notice and<\/p>\n
 hearing the petitioner on the basis of Exts.P18<\/p>\n
 and P19, the Commissioner of Excise issued the<\/p>\n
 impugned Ext.P20 ordering resale of the shops at<\/p>\n

 the risk and loss of the writ petitioner. Though<\/p>\n
 Ext.P17 was issued on the ground of rule 7(15) of<\/p>\n
 the Disposal Rules only, when it reached at the<\/p>\n
 stage of final order, Ext.P20 was issued making<\/p>\n
 reference to Rule 7(15), 7(33) and 5(3)(i) of the<\/p>\n
 Disposal    Rules. The    Commissioner, in issuing<\/p>\n
 Ext.P20,    also  took   note   of  the fact  that<\/p>\n
 prosecution proceedings are pending against the<\/p>\n
 petitioner in a court of law and there is no<\/p>\n
 provision of law under which the Commissioner<\/p>\n
 could condone the delay in filing application to<\/p>\n
 get the shops licensed. Accordingly, Rule 5(3)(i)<\/p>\n
 of the Disposal Rules was specifically referred<\/p>\n
 to, to state that the petitioner is ineligible to<\/p>\n
 have privilege to vend toddy. It is accordingly<\/p>\n
 that the impugned order was issued for resale and<\/p>\n
 forfeiture in terms of Rule 7(31).\n<\/p>\n<\/p>\n
6.The show cause notice (Ext.P17) was issued solely<\/p>\n
 on the ground that the shops remained closed and<\/p>\n
 were not opened within a period of one month. The<\/p>\n
 explanation given by the petitioner to that, was<\/p>\n

 the fact that he was under detention following<\/p>\n
 the arrest in connection with the criminal case.<\/p>\n
 Even in Ext.P18, the petitioner had criticised<\/p>\n
 the police officers of having acted malafide and<\/p>\n
 to harass the petitioner on account of animosity<\/p>\n
 generated    by  his  refusal     to  concede  to  the<\/p>\n
 request of the police officers for continued<\/p>\n
 utilisation of private cars etc. belonging to the<\/p>\n
 petitioner. When it came to the stage of final<\/p>\n
 order     (Ext.P20),  the     fact  remains  that  the<\/p>\n
 criminal     court   had     numbered  the   case  as<\/p>\n
 C.P.138\/2009.     The  statement     in   the  counter<\/p>\n
 affidavit is that the Judicial Magistrate of<\/p>\n
 First Class, Wadakkanchery had issued process<\/p>\n
 calling upon the accused persons to appear on<\/p>\n
 4.12.2009.      In   the      impugned    order,  the<\/p>\n
 Commissioner     noted  that     the  proceedings  are<\/p>\n
 pending    before  a  court     of  law.  The  learned<\/p>\n
 Government Pleader appears to be justified in<\/p>\n
 saying that Rule 5(3)(i) of the Disposal Rules<\/p>\n
 operates not only in relation to cases where the<\/p>\n
 court has framed charge but would also relate to<\/p>\n

 cases where prosecution proceedings are pending<\/p>\n
 before     the  criminal    courts.  By   judgment<\/p>\n
 dt.1.12.2009 in WP(C).31562\/2009, it was held<\/p>\n
 that commencement of prosecution proceedings is<\/p>\n
 different from the framing of charge and the<\/p>\n
 ratio in Vijayan’s case, 2002 (3) KLT 646, would<\/p>\n
 apply only to cases where the question of framing<\/p>\n
 a charge by court is to be relevant vis-a-vis the<\/p>\n
 registration of a first information report by the<\/p>\n
 police.\n<\/p>\n<\/p>\n
7.In the case in hand, it is quite obvious that the<\/p>\n
 Commissioner   of  Excise    had  not taken   into<\/p>\n
 consideration the time spent by the petitioner in<\/p>\n
 police custody. It may be true that prosecution<\/p>\n
 proceedings   are pending    against him and   the<\/p>\n
 petitioner may face the wrath of Rule 5(3)(i) of<\/p>\n
 the Disposal Rules. But, equally important is the<\/p>\n
 fact that the police officers are accused in<\/p>\n
 person with allegations of unlawful gains and the<\/p>\n
 allegations   against   them   are,  as  of   now,<\/p>\n
 following Ext.P25 judgment, being looked into by<\/p>\n

 the Vigilance Department. The petitioner, even<\/p>\n
 going      by  the  counter     affidavit, has   an<\/p>\n
 unblemished past of about seven continued years<\/p>\n
 as licensee under the State of Kerala.<\/p>\n
8.A reading of Ext.P20 and Ext.P17 would show that<\/p>\n
 the decision of the Commissioner is fundamentally<\/p>\n
 on the ground that the petitioner did not start<\/p>\n
 operations within a month of the grant. The other<\/p>\n
 findings are quite incidental and may require<\/p>\n
 even     a  second look,     having  regard to  the<\/p>\n
 allegations against the police officers.<\/p>\n
 Having regard to what is aforesaid, this writ<\/p>\n
 petition is ordered directing that Ext.P20 will<\/p>\n
 be treated as a fresh show cause notice referable<\/p>\n
 to grounds which are not stated in Ext.P17 and<\/p>\n
 the Commissioner will hear the petitioner again<\/p>\n
 after     obtaining the    views  of  the  authority<\/p>\n
 looking into the complaints against the police<\/p>\n
 officers following Ext.P25 judgment. The licences<\/p>\n
 granted to the petitioner in terms of the interim<\/p>\n

 order granted at the time of admission and issued<\/p>\n
 as   per   Exts.P24 series   will continue  to  be<\/p>\n
 applicable till the Commissioner takes a decision<\/p>\n
 de novo in the light of what is stated above.<\/p>\n
