RESPONDENT (s)\n\n\nCORAM:- HON'BLE MR.JUSTICE RAM CHAND GUPTA\n\n\nPresent:    Mr. Shailendra Jain,\n            Advocates for the appellant.\n\n            Mr. Ashish Kapoor, Addl.A.G., Haryana.\n            for respondents no.1 and 2.\n\n            Mr. Dhiraj Chawla,\n            Advocate for respondent no.3-HSIDC.\n\n                        *****\n<\/pre>\n<p>RAM CHAND GUPTA, J.(Oral)<\/p>\n<p>CM No.9660-CI of 2011<\/p>\n<p>            Heard.\n<\/p>\n<p>            Notice of the application.\n<\/p>\n<p>            Mr. Ashish Kapoor, Additional Advocate General, Haryana<br \/>\naccepts notice on behalf of respondents no.1 and 2 and Mr. Dhiraj Chawla,<br \/>\nAdvocate, who is present in the court accepts notice on behalf of respondent<br \/>\nno.3-HSIDC.\n<\/p>\n<p><span class=\"hidden_text\"> RFA No.4357 of 2011                                                      2<\/span><\/p>\n<p>            Hence, taking into consideration the facts mentioned in the<br \/>\napplication accompanied by affidavit, delay of 338 days in filing the appeal<br \/>\nis, hereby, condoned.\n<\/p>\n<p>            Civil Misc. stands disposed of.\n<\/p>\n<p>CM No.9659-CI of 2011<\/p>\n<p>            The application is allowed subject to all just exceptions.<\/p>\n<p>RFA No.4357 of 2011<\/p>\n<p>            The present regular first appeal has been filed against award<\/p>\n<p>dated 27.01.2010 passed by learned Additional District Judge, Gurgaon vide<\/p>\n<p>which reference under Section 18 of the Land Acquisition Act, 1894 (for<\/p>\n<p>short the &#8216;Act&#8217;) filed by the present appellant was decided.<\/p>\n<p>            It has been contended by learned counsel for the appellant that<\/p>\n<p>land belonging to other land owners was also acquired by the same<\/p>\n<p>notification dated 06.03.2002 issued under Section 4 of the Act for setting up<\/p>\n<p>of Industrial Model Township, Manesar Phase II and the same was<\/p>\n<p>subsequently followed by notification dated 15.11.2002 under Section 6 of<\/p>\n<p>the Act. It is further contended that the appeals filed by the other land<\/p>\n<p>owners against the same award dated 27.01.2010 passed by learned<\/p>\n<p>Additional District Judge, Gurgaon were decided by this Court vide judgment<\/p>\n<p>dated 11.02.2011 passed in RFA No.2373 of 2010, titled as <a href=\"\/doc\/190404694\/\">Madan Pal v.<\/p>\n<p>State of Haryana. Hence,<\/a> it is contended that this appeal be also decided on<\/p>\n<p>the same terms.\n<\/p>\n<p>            These facts have also not been disputed by learned counsel for<\/p>\n<p>the respondents.\n<\/p>\n<p><span class=\"hidden_text\"> RFA No.4357 of 2011                                                  3<\/span><\/p>\n<p>            Hence, for the detailed reasons recorded in RFA No. 2373 of<\/p>\n<p>2010, titled as <a href=\"\/doc\/190404694\/\">Madan Pal v.
