SHAH\n\t\t\n\t\n\n \n\nDate\n: 06\/09\/2010 \n\n \n\n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tRule.\n<\/p>\n<p>Shri PC Master, learned advocate waives service of notice of Rule on<br \/>\nbehalf of respondent nos.1 and 2 and Ms. R.V. Acharya, learned<br \/>\nadvocate waive service of notice of Rule on behalf of respondent<br \/>\nnos.. 3 and 4. In the facts and circumstances of the case and with<br \/>\nthe consent of the learned advocates for the respective<br \/>\nparties, the petition is taken up for final hearing today.\n<\/p>\n<p>2.\tBy way of this<br \/>\npetition under Article 226 of the Constitution of India, the<br \/>\npetitioner has prayed for an appropriate writ, direction and order<br \/>\nquashing and setting aside the impugned order\/ communication dated<br \/>\n31.1.2008 passed by respondent nos. 3 and 4, by which the appropriate<br \/>\nauthority has refused to refer the dispute to the concerned Labour<br \/>\nCourt.\n<\/p>\n<p>3.\tIt appears that<br \/>\nthe petitioner raised an industrial disputes against respondent nos.<br \/>\n1 and 2 with respect to his termination and for reinstatement with<br \/>\nfull back wages. That respondent no.3 by order dated 31.1.2008<br \/>\nrefused to refer the dispute to the Labour Court observing that  the<br \/>\nclaimant has failed to furnish documentary evidence to establish that<br \/>\nhe was employed by the management upto 28.2.2004 hence the matter<br \/>\nraised cannot be construed as an industrial dispute .  Being<br \/>\naggrieved and dissatisfied with the same, the petitioner has<br \/>\napproached this Court by way of filing present Special Civil<br \/>\nApplication under Article 226 of the Constitution of India. Relying<br \/>\nupon the decision of this Court in the case of  Hardesh Kumar<br \/>\nRajaram Vs. K.V.B. Unni and Ors. reported in 2000(3) GLR 196 as<br \/>\nwell as in the case of Chetan Somabhai Parmar Vs. The Desk<br \/>\nOfficer, Govt. of India reported in 2004(3) GLH (UJ) 12,, Shri<br \/>\nParekh, learned advocate for the petitioner has requested to allow<br \/>\nthe present petition and directed the appropriate authority to refer<br \/>\nthe dispute to the Labour Court  for its adjudication. It is<br \/>\nsubmitted that as held by this Court relying upon the Supreme  Court<br \/>\njudgment it is held that only when the demand is perverse and<br \/>\nfrivolous, the appropriate authority can refuse the dispute to be<br \/>\nreferred to Tribunal \/Labour Court. It is submitted that it is also<br \/>\nheld by this Court that appropriate authority while exercising the<br \/>\npower under Section 10 of the Industrial Disputes Act, 1947 cannot<br \/>\ndelve into the merits of the case, Therefore, it is requested to<br \/>\nallow the present Special Civil Application.\n<\/p>\n<p>4.\tLearned<br \/>\nadvocate for the concerned respondent have tried to support the<br \/>\nimpugned decision by submitting that as the appropriate authority did<br \/>\nnot find any prima facice case and, therefore, the appropriate<br \/>\nauthority justified in refusing to refer the dispute to the Labour<br \/>\nCourt.\n<\/p>\n<p>5.\tHaving heard<br \/>\nthe learned advocates for the respective parties and considering the<br \/>\nimpugned order passed by respondent no.3 in not referring the dispute<br \/>\nto the Labour Court, it appears that the appropriate authority has<br \/>\ntried to enter into the merits of the case, which is not permissible<br \/>\nwhile exercising under Section 10 of the  Industrial Disputes Act.<br \/>\nThe controversy in the present case is squarely covered by the<br \/>\naforesaid two decisions of this Court. Under the circumstances,<br \/>\npresent petition deserve to be allowed and impugned communication\/<br \/>\ndecision of respondent no.3 dated 31.1.2008 refusing to refer the<br \/>\ndispute raised by the petitioner to the Labour Court is required to<br \/>\nbe quashed and set aside.\n<\/p>\n<p>6.\tIn view of the<br \/>\nabove and for the reasons stated above, petition succeed. The<br \/>\nimpugned order \/ communication\/ decision 31.1.2008 passed by<br \/>\nrespondent nos. 3 , by which the appropriate authority has refused to<br \/>\nrefer the dispute to the concerned Labour Court is hereby quashed and<br \/>\nset aside and appropriate authority is directed to refer the dispute<br \/>\nto the appropriate Labour Court. It goes without saying that it will<br \/>\nalways be upon for respondent nos. 1 and 2   employer to raise the<br \/>\ndispute that petitioner was not working and \/ or not in employment of<br \/>\nrespondent nos. 1 and 2  upto 28.2.2004, all the questions which are<br \/>\navailable to respondent nos. 1 and 2 are kept open and they are<br \/>\nrequired to be dealt with and considered on appreciation of evidence<br \/>\nin accordance with law.
