Justice ANTONY DOMINIC\n\n Dated :23\/06\/2009\n\n O R D E R\n                      ANTONY DOMINIC, J.\n                     ================\n                 W.P.(C) NO. 31673 OF 2006 (U)\n                =====================\n\n             Dated this the 23rd day of June, 2009\n\n                         J U D G M E N T\n<\/pre>\n<p>      Petitioner claims that he is an agriculturist, who was availing<\/p>\n<p>of power supply under LT V tariff. He is claiming the benefit of<\/p>\n<p>Exts.P1 to P3 orders issued by the 4th respondent extending the<\/p>\n<p>benefit of free supply of energy to paddy cultivators and also<\/p>\n<p>other cultivators having land upto to 2 hectares. According to the<\/p>\n<p>petitioner, immediately on the issuance of the scheme, way back<\/p>\n<p>in 1997 itself, being eligible for the benefit, his mother had<\/p>\n<p>applied for free supply of energy. His mother&#8217;s eligibility was<\/p>\n<p>accepted and the benefit of the scheme was also extended to her.<\/p>\n<p>Petitioner submits that on that basis, they were not being issued<\/p>\n<p>any invoice, but however, he was issued Ext.P4 dated 9\/9\/06<\/p>\n<p>demanding an amount of Rs.5,994.05 together with interest of<\/p>\n<p>Rs.2,474 for the period April 1999 to December 2006. It is<\/p>\n<p>stated that for non payment of the aforesaid amount, supply was<\/p>\n<p>disconnected. That led the petitioner to file this writ petition<\/p>\n<p>praying for a declaration that he is entitled to be exempted from<\/p>\n<p>payment of electricity charges for LT V connection and also for a<\/p>\n<p>WPC 31673\/06<br \/>\n<span class=\"hidden_text\">                                  :2 :<\/span><\/p>\n<p>direction to the respondents to reconnect the power supply.<\/p>\n<p>      2.    Counsel for the petitioner placed reliance on the<\/p>\n<p>judgment of this Court in <a href=\"\/doc\/1485559\/\">Ammini Gopalakrishnan v. State of<\/p>\n<p>Kerala<\/a> (2002(3) KLT 553), which according to the petitioner dealt<\/p>\n<p>with a case identical in all respects.\n<\/p>\n<p>      3.    Learned Government Pleader referred me to the<\/p>\n<p>counter affidavit filed by the 3rd respondent. According to the 3rd<\/p>\n<p>respondent, although going by the extent of land held by the<\/p>\n<p>petitioner, the petitioner is eligible for the benefit of the scheme,<\/p>\n<p>still as the 3rd respondent had not received any application from<\/p>\n<p>the petitioner, he was not extended the benefit of Exts.P1 to P3<\/p>\n<p>referred to above.\n<\/p>\n<p>      4.    Counsel appearing for the Electricity Board referred me<\/p>\n<p>to Section 65 of the Indian Electricity Act, 2003 and submits that<\/p>\n<p>although the consumer had paid the energy charges till March<\/p>\n<p>1999, default was committed from April 1999 and it was therefore<\/p>\n<p>that Ext.P4 invoice was issued.\n<\/p>\n<p>      5.    Admittedly, Exts.P1 to P3 reflects the policy decision<\/p>\n<p>of the Government, providing for free supply of energy to<\/p>\n<p>agriculturists cultivating paddy, without any limit to its extent.<\/p>\n<p>WPC 31673\/06<br \/>\n<span class=\"hidden_text\">                                 :3 :<\/span><\/p>\n<p>The scheme also provides for free supply of energy to<\/p>\n<p>agriculturists  engaged   in    other   cultivations  and    having<\/p>\n<p>agricultural land upto an extent of 2 hectares.              Ext.P3<\/p>\n<p>Government order dated 4\/2\/99 is a consolidated one which<\/p>\n<p>shows that the Agricultural Officers are required to submit the list<\/p>\n<p>of eligible persons and they are also to make payment of the<\/p>\n<p>energy charges to the electricity board and it is on that basis, the<\/p>\n<p>scheme is to be implemented.\n<\/p>\n<p>      6.   Counter affidavit filed by the Government would show<\/p>\n<p>that though they accept the eligibility of the petitioner, their only<\/p>\n<p>complaint is that no application has been received from the<\/p>\n<p>petitioner. Although the petitioner contends that his mother had<\/p>\n<p>submitted an application way back in 1997 itself, nothing has<\/p>\n<p>been placed on record to substantiate this contention.<\/p>\n<p>      7.   Having regard to the fact that the Government have<\/p>\n<p>accepted the eligibility of the petitioner for the benefit of the<\/p>\n<p>scheme and also in the light of the law laid down by this Court in<\/p>\n<p>the judgment referred to by the counsel for the petitioner where<\/p>\n<p>also liberty was given to the petitioners therein to make<\/p>\n<p>applications claiming the benefit of the scheme, I dispose of this<\/p>\n<p>WPC 31673\/06<br \/>\n<span class=\"hidden_text\">                                   :4 :<\/span><\/p>\n<p>writ petition with the following directions.<\/p>\n<p>      (1)   That it will be open to the petitioner to make an<\/p>\n<p>application to the 3rd respondent along with all other documents,<\/p>\n<p>claiming the benefit of Exts.P1 to P3 schemes referred to above.<\/p>\n<p>      (2)   It is directed that if such an application with necessary<\/p>\n<p>documents is received from the petitioner as above, within 4<\/p>\n<p>weeks thereafter, the 3rd respondent shall inspect the agricultural<\/p>\n<p>land of the petitioner and assess his eligibility for the benefit of<\/p>\n<p>Exts.P1 to P3.\n<\/p>\n<p>      (3)   On such assessment, if the 3rd respondent finds that<\/p>\n<p>the petitioner is eligible, the 3rd respondent shall immediately<\/p>\n<p>take steps for extending the benefit of Exts.P1 to P3 schemes to<\/p>\n<p>the petitioner without any further delay in this matter.<\/p>\n<p>      (4)   In so far as the liability as per Ext.P4 is concerned,<\/p>\n<p>counsel for the respondent Board insisted that the amount should<\/p>\n<p>be paid by the petitioner while the petitioner contended that it<\/p>\n<p>was accepting his eligibility for the benefit of the scheme that bills<\/p>\n<p>were not raised since April, 1999.\n<\/p>\n<p>      (5)   Irrespective of the controversy, it is directed that if the<\/p>\n<p>petitioner is found to be eligible for the benefit of the scheme,<\/p>\n<p>WPC 31673\/06<br \/>\n<span class=\"hidden_text\">                                  :5 :<\/span><\/p>\n<p>necessarily the benefit of the scheme should enure to the<\/p>\n<p>petitioner from the date from which the 3rd respondent finds the<\/p>\n<p>petitioner eligible for the same.\n<\/p>\n<p>      (6)   Therefore, I leave it open to the 3rd respondent to<\/p>\n<p>assess the effective date from which the petitioner is eligible for<\/p>\n<p>the benefit of the scheme and it is directed that from that date<\/p>\n<p>onwards the petitioner will be eligible for the benefit of the<\/p>\n<p>scheme and it is for the petitioner to discharge the liability for the<\/p>\n<p>previous period, if any.\n<\/p>\n<p>      (7)   It is directed that in case the 3rd respondent certifies<\/p>\n<p>the eligibility of the petitioner, on the petitioner complying with<\/p>\n<p>the other procedural requirements, supply to his premises will be<\/p>\n<p>reconnected.\n<\/p>\n<p>      (8)   Petitioner shall produce a copy of this judgment before<\/p>\n<p>the 3rd respondent for compliance.\n<\/p>\n<p>                                       ANTONY DOMINIC, JUDGE<br \/>\nRp<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court P.
