MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\nappellant preferred the writ petition in Special Civil Application<br \/>\nNo.9947 of 2010 which was dismissed on 26.8.2010 for non-prosecution.<br \/>\n In the petition for restoration   Misc. Civil Application No. 2364<br \/>\nof 2010, Rule having issued returnable on 25.10.2010, the present<br \/>\nappeal under Clause 15 of the Letters Patent Appeal has been filed.\n<\/p>\n<p>\tWe<br \/>\nhave heard the learned counsel for the appellant and perused the<br \/>\nrecord.  This is a gross case of misuse of the jurisdiction of the<br \/>\nCourt for which the Court is not only inclined to dismiss the case,<br \/>\nbut also inclined to impose costs.  We accordingly impose costs of<br \/>\nRs.10,000\/- (Rupees ten thousand only) on the petitioner<br \/>\nappellant which will pay the same by 24th October, 2010 in<br \/>\nfavour of the Gujarat State Legal Services Authority, High Court<br \/>\nCampus, Ahmedabad and report to the Court in Misc. Civil Application<br \/>\nNo. 2364 of 2010.\n<\/p>\n<p>\tLet<br \/>\na copy of this order be kept in the record of Misc. Civil Application<br \/>\nNo. 2364 of 2010.\n<\/p>\n<p>\tIn<br \/>\nview of the above order, no further order is required to be passed in<br \/>\nthis Appeal.
