      The challenge before us in the above two<\/p>\n
Civil Revision Petitions is the order of appointment<\/p>\n
of   Advocate    Sri.P.C.Najeeb     as   the    interim<\/p>\n
Mutawalli of Nellikkapparambu Juma-Ath Masjid<\/p>\n
by the Wakf Board pending dispute regarding the<\/p>\n
office of Mutawalli. While the Wakf was smoothly<\/p>\n
managed by a committee elected by the members<\/p>\n
of the Mahal, there arose dispute between<\/p>\n
members.     There    was    grouping     in  between<\/p>\n
members and ultimately a suit as O.S.739\/89 was<\/p>\n
filed before the Munsiff’s Court, Kozhikode. The<\/p>\n
suit was dismissed. Dispute prevailed. While so,<\/p>\n

       the    members       arrived   at an  understanding.<\/p>\n
       Accordingly,       Sri.V.E.Moyin Haji, the   second<\/p>\n
       respondent in C.R.P.119\/10 was appointed as a<\/p>\n
       Mutawalli and he was managing the affairs of the<\/p>\n
       Masjid. While he holding so, in 2003, some of the<\/p>\n
       members of the Mahal convened a meeting. A<\/p>\n
       Managing Committee as well as a Mutawalli was<\/p>\n
       elected. Thereupon, the service of the second<\/p>\n
       respondent in CRP.119\/10 as Mutawalli was<\/p>\n
       terminated. On the other hand, the Wakf Board<\/p>\n
       appointed V.E.Moyin Haji as the Mutawalli. That<\/p>\n
       appointment was challenged before the Wakf<\/p>\n
       Tribunal in O.P.2\/04. The Wakf Tribunal, while<\/p>\n
       allowing the O.P. set aside the order of the Wakf<\/p>\n
       Board appointing Moyin Haji as the Mutawalli and<\/p>\n
       the matter was remanded to the Wakf Board for<\/p>\n

       fresh disposal. The order in O.P.2\/04 was<\/p>\n
       challenged before this Court, but not successful.<\/p>\n
       Some of the parties also approached for framing a<\/p>\n
       scheme by filing O.P. Nos.58\/07 and 86\/07. In<\/p>\n
       O.P.86\/07, a petition was filed praying for<\/p>\n
       appointing a Mutawalli stating that the post of the<\/p>\n
       Mutawalli had become vacant. Thereupon, the<\/p>\n
       Wakf Board appointed Advocate Sri.P.C.Najeeb as<\/p>\n
       the Mutawalli till the disposal of the proceedings<\/p>\n
       before the Wakf Board. Assailing the said order,<\/p>\n
       O.P.5\/07 was filed. Moyin Haji, who was the 7th<\/p>\n
       respondent in O.P.5\/07, filed O.P.11\/07 seeking<\/p>\n
       an order to appoint him as Mutawalli. By a<\/p>\n
       common order, O.P.5\/07 was allowed after<\/p>\n
       arriving at conclusion that there arose no vacancy<\/p>\n
       of the Mutawalli. O.P.11\/07 was dismissed for the<\/p>\n

       reason that there is objection for a group of<\/p>\n
       members in appointing Moyin Haji as Mutawalli. It<\/p>\n
       is that order now assailed in both the revision<\/p>\n
       petitions.\n<\/p>\n
              2. While the dispute is getting stronger<\/p>\n
       between the parties, it was brought to the notice<\/p>\n
       of the Wakf Board that some urgent repairs are<\/p>\n
       badly in need, especially regarding toilet and<\/p>\n
       washing place. Therefore, by Ext.P2 order dated<\/p>\n
       11\/05\/10 assailed in O.P.4\/10, the Wakf Board<\/p>\n
       authorised an officer of the Board to do the urgent<\/p>\n
       repairs. Assailing that order, O.P.16\/10 was filed<\/p>\n
       before the Wakf Tribunal, Kozhikode. The Writ<\/p>\n
       Petitioner also filed petition as I.A.297\/10 to stay<\/p>\n
       Ext.P2 order. That petition was dismissed by<\/p>\n
       Ext.P4 order. Ext.P2 order as well as Ext.P4 order<\/p>\n

       is assailed in O.P.(WT).4\/10 under Article 227 of<\/p>\n
       the Constitution of India.\n<\/p>\n
              3. We heard the learned counsel appearing<\/p>\n
       either side and perused the orders impugned. It is<\/p>\n
       not disputed that Advocate Sri.P.C.Najeeb was<\/p>\n
       appointed as interim Mutawalli in exercise of the<\/p>\n
       powers vested on the Wakf Board under Section<\/p>\n
       63 of the Wakf Act which reads as follows:-<\/p>\n
              Sec.63:- “When there is a vacancy in
\n              the office of the mutawalli of a Wakf
\n              and there is no one to be appointed
\n              under the terms of the deed of the
\n              Wakf, or where the right of any person
\n              to act as mutawalli is disputed, the
\n              board may appoint any person to act as
\n              mutawalli for such period and on such
\n              conditions as it may think fit.”<\/p><\/blockquote>\n
              4. Going by the orders impugned in the<\/p>\n
       revision petitions, it is seen that the Tribunal<\/p>\n
       below      interfered    with  the order appointing<\/p>\n

       Advocate P.C. Najeeb as Mutawalli solely for the<\/p>\n
       reason that there was no vacancy of the office of<\/p>\n
       the Mutawalli. In fact, it is not disputed from the<\/p>\n
       Bar     that    main      dispute is regarding the<\/p>\n
       management of Wakf and as to who shall be the<\/p>\n
       Mutawalli. The facts stated earlier speak volumes.<\/p>\n
       Since the parties are fighting tooth and nail,<\/p>\n
       appointment of any person from a warring group<\/p>\n
       without resolving the dispute may aggravate the<\/p>\n
       dispute. In case, parties to dispute could not<\/p>\n
       arrive at a consensus, it is always advisable to<\/p>\n
       appoint a neutral person till the dispute is<\/p>\n
       resolved. Whenever there is a dispute regarding<\/p>\n
       the right of a person to act as a Mutawalli, Wakf<\/p>\n
       Board is empowered to appoint a Mutawalli under<\/p>\n
       Section 63. That aspect was not considered by the<\/p>\n

       Tribunal below and thus, the order impugned is<\/p>\n
       vitiated. We find that since there is serious<\/p>\n
       dispute regarding the person to hold the office of<\/p>\n
       Mutawalli and the parties are warring regarding<\/p>\n
       the office of the Mutawalli, the Wakf Board was<\/p>\n
       justified in appointing Advocate Sri.P.C.Najeeb as<\/p>\n
       interim Mutawalli till the matter is finally decided<\/p>\n
       by the Board. It is not disputed from either side<\/p>\n
       that Advocate P.C. Najeeb is anyway disqualified<\/p>\n
       to hold the office of the Mutawalli for an interim<\/p>\n
       period. There is no case that Sri.Najeeb has got<\/p>\n
       any favours or disfavours with any group. In the<\/p>\n
       above circumstances, we find that the Tribunal<\/p>\n
       below was not justified in interfering with the<\/p>\n
       order appointing Advocate Sri.P.C.Najeeb as<\/p>\n
       Mutawalli for the interim period till the matter<\/p>\n

       before the Wakf Tribunal is disposed of. So we<\/p>\n
       find that the order impugned in the revision<\/p>\n
       petitions are liable to be set aside and the order of<\/p>\n
       the Wakf Board appointing Advocate Sri.P.C.<\/p>\n
       Najeeb as interim Mutawalli is to be restored. The<\/p>\n
       claim of the petitioner in CRP.263\/10 is also<\/p>\n
       devoid of merits as such appointment would<\/p>\n
       aggravate the dispute.\n<\/p>\n
              5. As regards O.P.(WT) No.4\/10, it is not<\/p>\n
       disputed that urgent repairs are to be done<\/p>\n
       regarding the latrine and washing place. The<\/p>\n
       question is as to how it is to be done. Since we<\/p>\n
       hold      that    the    order appointing  Advocate<\/p>\n
       Sri.P.C.Najeeb as Mutawalli is liable to be<\/p>\n
       restored, irrespective of the grounds alleged to<\/p>\n
       assail the orders, we find that it would be just and<\/p>\n

       appropriate to allow him to conduct the repair<\/p>\n
       work. We are not going to the merits of the<\/p>\n
       contention that Ext.P2 order impugned in O.P.<\/p>\n
       (WT) No.4\/10 was passed on a holiday or not<\/p>\n
       because we find that irrespective of the date of<\/p>\n
       the order, urgent works are to be done and that<\/p>\n
       cannot be postponed to a future date. Since we<\/p>\n
       uphold the order to appoint Adv. Sri.P.C.Najeeb as<\/p>\n
       Mutawalli, let him do it. Advocate Sri.P.C.Najeeb<\/p>\n
       may also explore as to whether any of the<\/p>\n
       members of the Mahal or any outsider is prepared<\/p>\n
       to sponsor the execution of repair work and if so,<\/p>\n
       the repair work shall be done at the expense of<\/p>\n
       the sponsor so found out. In case no sponsor<\/p>\n
       could be found out, the repair work shall be done<\/p>\n
       out of the funds of the Wakf.\n<\/p>\n

              6. We notice that by Ext.P1 order a Single<\/p>\n
       Bench of this Court has given direction to the<\/p>\n
       Wakf Board to dispose of the matter within a time<\/p>\n
       frame. In the above circumstances, we are not<\/p>\n
       fixing any time frame regarding the disposal of<\/p>\n
       the matter by the Wakf Board. Revision petitions<\/p>\n
       and O.P. would stand disposed as above.<\/p>\n
