Justice V.RAMKUMAR\n\n Dated :27\/03\/2007\n\n O R D E R\n                           V.RAMKUMAR, J.\n\n                           ----------------------------\n\n                   Bail Application No. 1741\/2007\n\n                           -----------------------------\n\n                 Dated this  27th day of March, 2007\n\n\n                                 O R D E R\n<\/pre>\n<p>                The   petitioner,   who   is   the   first   accused   in   Crime<\/p>\n<p>No.62\/2007   of     Panniyankara   Police   Station   for   offences<\/p>\n<p>punishable   under     Sections   341,   307   and   302   IPC   read   with<\/p>\n<p>Section 34 IPC, seeks his enlargement on bail.<\/p>\n<p>      2.    The   learned   Public   Prosecutor   opposed   the<\/p>\n<p>application.\n<\/p>\n<\/p>\n<p>      3.    The case of the prosecution is that at about 8.30.p.m<\/p>\n<p>on   31.1.2007,     the   defacto   complainant   and   his   friend   while<\/p>\n<p>sitting   on   a   corporation   ground   saw   all   the   three   accused<\/p>\n<p>persons   consuming     liquor.     After   15   minutes,     the   accused<\/p>\n<p>picked up a quarrel with  the defacto complainant and then went<\/p>\n<p>away.  Consequently at  9.15 p.m., the accused 1 to 3 came there<\/p>\n<p>in   a   motorcycle   and   obstructed   the   defacto   complainant   and<\/p>\n<p>Mahesh.   The  first accused took out a soda bottle and beat the<\/p>\n<p>defacto complainant who fell down.  Thereafter, the first accused<\/p>\n<p>took out a knife and stabbed him.   When Mahesh intervened to<\/p>\n<p>prevent the first accused from stabbing the defacto complainant,<\/p>\n<p>he was also stabbed.  In that attempt Mahesh succumbed to the<\/p>\n<p>injuries on the way to the hospital.\n<\/p>\n<p>\nB.A.1741\/2007<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>        4.
