The said suit<br \/>\nwas decreed on 31.12.1988.  Being aggrieved by the said decree of<br \/>\neviction, the respondent herein preferred Regular Civil Appeal No. 41<br \/>\nof 1989.  The appellate court after hearing the parties allowed the<br \/>\nappeal and the decree dated 31.12.1988 was set aside.  Being<br \/>\naggrieved by the said order of the appellate court, the present<br \/>\nrevision application is preferred.\n<\/p>\n<p>3.\tMr.\n<\/p>\n<p>Gandhi, learned advocate appearing for the petitioner submitted that<br \/>\nthe appellate court failed to consider that on the date of notice,<br \/>\nRs. 770\/- were outstanding towards rent.  He submitted that the<br \/>\nappellate court failed to appreciate that before the notice the<br \/>\npresent respondent had already filed Standard Rent Application being<br \/>\nMisc. Application No. 242\/1980 and after the said notice was given,<br \/>\napplication for interim standard rent was filed.\n<\/p>\n<p>3.1\tMr.\n<\/p>\n<p>Gandhi submitted that in the aforesaid misc. application, the learned<br \/>\njudge passed an order on 13.01.1981 whereby the interim rent was<br \/>\nfixed at Rs. 90\/- and it was directed that the tenant should go on<br \/>\ndepositing the rent regularly.   He submitted that the trial court<br \/>\nrightly came to the conclusion that rent is not fully paid in<br \/>\ncompliance of the order of standard rent application.\n<\/p>\n<p>4.\tMr.\n<\/p>\n<p>Padhya, learned advocate appearing for the respondent supported the<br \/>\norder of the appellate court.  He submitted that the appellate court<br \/>\nhas rightly appreciated the money order receipts whereby amount of<br \/>\nrent was sent by the tenant but the landlord did not accept the same.<br \/>\n He submitted that the landlord had given notice to the tenant on<br \/>\n18.12.1980 and Rs. 770\/- was to be paid for due rent of seven months<br \/>\nfrom 01.05.1980 to 01.12.1980 within a period of one month from the<br \/>\ndate of statutory notice.  The tenant paid Rs. 900\/- as rent before<br \/>\nthe expiry of the statutory notice.\n<\/p>\n<p>5.\tHaving<br \/>\nheard the learned advocates for either side and having perused the<br \/>\npapers on record, this court is of the view that the appellate court<br \/>\nhas gone into the evidence in detail and has come to the conclusion<br \/>\nthat the defendant cannot claim possession on the ground that the<br \/>\ntenant had committed default in depositing the rent regularly.  It is<br \/>\nnot in dispute that the tenant had remitted the due rent amount by<br \/>\nsending money order regularly and those were refused by the landlord<br \/>\nwithout any reason.  From the perusal of the order of the trial court<br \/>\nit is borne out that the trial court committed an error in holding<br \/>\nthat the defendant had committed default in depositing the rent<br \/>\nregularly during the pendency of the suit.   The appellate court has<br \/>\nrightly set aside the decree passed by the trial court in view of the<br \/>\nfact that decree for eviction cannot be passed where the tenant is<br \/>\nshown to be ready and willing to pay the rent and more over has in<br \/>\nfact paid such rent upto the date of filing of the suit.  In the<br \/>\npresent case, it is proved that the tenant had deposited the amount<br \/>\nmore than the notice amount within thirty days of suit notice and it<br \/>\nis also proved that the tenant is ready and willing to pay the rent<br \/>\ndue.  The trial court ought to have considered the money order<br \/>\nreceipts which shows the genuineness of the tenant.  This court is in<br \/>\ncomplete agreement with the reasonings adopted and findings arrived<br \/>\nat by the appellate court.\n<\/p>\n<p>6.\tFor<br \/>\nthe foregoing reasons, Revision Application is dismissed.  Rule is<br \/>\ndischarged.  Interim relief, if any, stands vacated.
