Jain, J.  <\/p>\n<p> 1. This civil revision is directed against the<br \/>\norder of the learned Additional District Judge dated<br \/>\n30-1-2002 by which the learned trial court has<br \/>\ndismissed an application under Order 14 Rule 5 CPC<br \/>\nfiled on behalf of the petitioner-defendant seeking<br \/>\nreframing\/modification of existing issue No.4 and for<br \/>\nframing 3 additional issues.\n<\/p>\n<p> 2. Learned counsel for the petitioner seeks to<br \/>\nchallenge the impugned order mainly on the ground that<br \/>\ndefendant-petitioners have raised certain specific<br \/>\nobjections and pleas in their written statement about<br \/>\nthe maintainability of the suit; plaintiff having got<br \/>\nno cause of action for filing the suit and also about<br \/>\nthe agreement to sell land in question which is the<br \/>\nbasis of the suit being void and the subject matter of<br \/>\nthe suit agreement was covered by the provisions of<br \/>\nDelhi Land Reforms Act 1954 and the consideration<br \/>\nprovided for in the agreement is grossly inadequate<br \/>\nand illusory and agreement. The court existing issues<br \/>\nframed do not take into account the said specific<br \/>\npleas of the petitioner-defendant.\n<\/p>\n<p> 3. On a consideration of the matter it is noted<br \/>\nthat the present suit filed by the<br \/>\nplaintiff-respondent is for specific performance of<br \/>\nagreement to sell and damages and on the basis of the<br \/>\npleadings of the parties, the trial court framed the<br \/>\nfollowing issues:\n<\/p>\n<p> 1. &#8220;Whether the plaintiff is entitled<br \/>\nto a decree of specific performance<br \/>\nof agreement dated 27-7-99 against<br \/>\nthe defendants?\n<\/p>\n<p> 2. Whether the plaintiff is entitled to<br \/>\na decree of recovery of<br \/>\nRs. 1,45,000\/- with interest in the<br \/>\nalternative as alleged?\n<\/p>\n<p> 3. Whether the suit is not maintainable<br \/>\nas alleged?\n<\/p>\n<p> 4. Whether the agreement in question is<br \/>\nvoid as alleged, if so, to what<br \/>\neffect?\n<\/p>\n<p> 5. Relief?\n<\/p>\n<p> 4. Application under Order 14 Rule 5 read with<br \/>\nSection 151 CPC was moved after the plaintiff had led<br \/>\nand concluded his evidence and when the case was at the<br \/>\nstage of defendant evidence. The plaintiff sought the<br \/>\nmodification of issue No.4 and framing of the<br \/>\nadditional three issues as under :\n<\/p>\n<p> Proposed Issue No.4:\n<\/p>\n<p>  &#8220;Whether the agreement in question<br \/>\nis void agreement being not<br \/>\nenforceable in view of the Delhi<br \/>\nLand Reform Act as alleged, if so,<br \/>\nto what effect?&#8221;\n<\/p>\n<p> Proposed additional issues:\n<\/p>\n<p> 1. &#8220;Whether there is no cause of action<br \/>\nin favor of the plaintiff and<br \/>\nagainst the defendants to file the<br \/>\npresent suit?\n<\/p>\n<p> 2. Whether consideration amount shown<br \/>\nin the agreement is illusory and not<br \/>\nadequate as alleged, if so to what<br \/>\neffect?\n<\/p>\n<p> 3. Whether the physical possession of<br \/>\nthe land in question was actually<br \/>\nhanded over by the defendants to the<br \/>\nplaintiff at the time of execution<br \/>\nof the Agreement?\n<\/p>\n<p> 5. Learned trial court has declined to consider,<br \/>\nthe application favorably mainly on the ground that<br \/>\nthe application was moved at a belated stage when the<br \/>\nmatter was fixed for defendant evidence which was aimed<br \/>\nat delaying the proceedings in the suit. It was also<br \/>\nstated that the issue No.4 with regard to the agreement<br \/>\nin question being void did not require any<br \/>\nmodification.\n<\/p>\n<p> 6. This court on a consideration of the facts,<br \/>\ncircumstances and the material placed on record and the<br \/>\nabove submissions of the counsel is also of the view<br \/>\nthat although delay in filing the application or for<br \/>\nseeking modification of issues is not a sufficient<br \/>\nground in itself to decline the application if on the<br \/>\nface of the pleas of the parties and for the effective<br \/>\nadjudication of the controversy between the parties<br \/>\nsuch a modification of the issues or framing of the<br \/>\nadditional issue is required. However, the question is<br \/>\nas to whether on the face of the facts of the case and<br \/>\nthe plea raised by the petitioner-defendant any<br \/>\nmodification of the existing issue or framing of any<br \/>\nadditional issue was called for. The answer is plain<br \/>\nin the negative because the existing issues are wide<br \/>\nenough in there scope so as to cover the pleas and<br \/>\ncontentions raised by the petitioner-defendant. The<br \/>\ndefendant would be free to lead any quantum of evidence<br \/>\nin support of issue No.4 in order to show that the<br \/>\nagreement to sell is void for the reasons stated in the<br \/>\nwritten statement. Similarly the existing issue No.3<br \/>\nin regard to the non-maintainability of the suit also<br \/>\ncovers the proposed additional issue No.1 and no<br \/>\nadditional issue was required to be framed. Issue No.3<br \/>\ndoes not arise from the pleadings of the parties as<br \/>\nneither the petitioner-plaintiff has not claimed relief<br \/>\nof possession. The defendant cannot be allowed to<br \/>\nraise the controversy about the possession of the<br \/>\nproperty in question.\n<\/p>\n<p> 7. For the reasons stated, this court is of the<br \/>\nopinion that no infirmity, illegality or jurisdictional<br \/>\nerror is seen in the impugned order which calls for any<br \/>\ninterference by this court.
