\tThis
\npublic interest litigation has been preferred by the petitioner for
\ndirecting the respondents to ensure that  the manufacturers of goods
\nare obliged to show or write or publish all the details of goods
\nnamely price of goods, ingredients of goods, date of manufacture,
\nmanufacturing and marketing unit etc. in Hindi.\n<\/p>\n
\tLearned
\ncounsel appearing on behalf of the petitioner submitted that the
\nconsumers are entitled to know what they are consuming as a right is
\navailable to them under Article 21 of the Constitution of India. The
\nLegislature has made provisions in the Statute making the consumers
\naware about ingredients they are consuming and  what is provided to
\nthem. The language, as per dictionary meaning, means mode of
\ncommunication which generally is used in nation or in a group of
\npeople and if the things are conveyed or communicated in that
\nparticular people or citizens or group of people, they will
\nunderstand it correctly in its correct sense and spirit. It was
\ncontended that Hindi being the national language and has been
\ncommunicated and understood by a large number of persons in the
\ncountry, direction should be given to publish all details of goods in
\nHindi. Learned counsel for the petitioner relied on the deliberation
\nwhich was made in the discussion of the Constituent Assembly wherein
\ndeliberating on the issue of language formula, it was suggested by
\nthe Sub-Committee to use Hindustani written either in  the Devanagari
\nor the Persian script, as the national language and for its inclusion
\nin the Fundamental Rights.\n<\/p>\n
\tLearned
\ncounsel appearing on behalf of Union of India by referring to the
\nStandards of Weights and Measures (Packaged Commodities) Rules, 1977
\nsubmitted that under Rule 9(4) it has been prescribed that the
\nparticulars of declaration required to be specified under this rule
\non a package shall be either in Hindi in Devanagari script or in
\nEnglish. Similarly, Rule 33(3A) also prescribes that the particulars
\nof declaration required to be specified under the said rule on a
\npackage either in Hindi in Devanagari script or in English.\n<\/p>\n
\tWe
\nhave heard the learned counsel for the parties and notice their rival
\ncontentions. It is true that the Constituent Assembly  while
\ndiscussing the Language Formula noticed the recommendation of the
\nSub-Committee on Fundamental Rights, which recommended the following
\nformula :-\n<\/p>\n
 Hindustani,
\nwritten either in Devanagari or the Persian script at the option of
\nthe citizen, shall, as the national language, be the first official
\nlanguage of the Union. English shall be the second official language
\nfor such period as the Union may by law determine. All official
\nrecords of the Union shall be kept in Hindustani in both the scripts
\nand also in English until the Union by law otherwise provides.\n<\/p>\n
\tHowever,
\nafter such deliberation when the Constitution of India was accepted
\nunder Chapter IV   `Special Directives’, Article 351 was enacted as
\nfollows :-\n<\/p>\n
 351.\tDirective
\nfor development of Hindi language. – It shall be the duty of the
\nUnion to promote the spread of the Hindi language, to develop it so
\nthat it may serve  as a medium of expression for all the elements of
\nthe composite culture of India and to secure its enrichment by
\nassimilating without interfering with its genius, the forms, style
\nand expressions used in Hindustani and in the other languages of
\nIndia specified in the Eighth Schedule, and by drawing, wherever
\nnecessary or desirable, for its vocabulary, primarily on Sanskrit and
\nsecondarily on other languages.\n<\/p>\n
\tPart
\nXVII of the Constitution deals with Official Language. Under Article
\n343, official language of the Union has been prescribed, which
\nincludes Hindi in Devanagari script and English. This will be evident
\nfrom the said provision, which reads as follows :-\n<\/p>\n
 343.\tOfficial
\nlanguage of the Union. – (1) The official language of the Union
\nshall be Hindi in Devanagari script.\n<\/p>\n
\tThe
\nform of numerals to be used for the official purposes of the Union
\nshall be the international form of Indian numerals.\n<\/p>\n
\t(2)\tNotwithstanding
\nanything in clause (1), for a period of fifteen years from the
\ncommencement of this Constitution, the English language shall
\ncontinue to be used for all the official purposes of the Union for
\nwhich it was being used immediately before such commencement.\n<\/p>\n
\tProvided
\nthat the President may, during the said period, by order authorise
\nthe use of the Hindi language in addition to the English language and
\nof the Devanagari form of numerals in addition to the international
\nform of Indian numerals for any of the official purposes of the
\nUnion.\n<\/p>\n
\t(3)\tNotwithstanding
\nanything in this article, Parliament may by law provide for the use,
\nafter the said period of fifteen years, of –\n<\/p>\n
\t(a)\tthe
\nEnglish language, or<\/p>\n
\t(b)\tthe
\nDevanagari form of numerals,<\/p>\n
\tfor
\nsuch purposes as may be specified in the law.\n<\/p>\n
\tNormally,
\nin India,  majority of the people have accepted Hindi as a national
\nlanguage and many people speak Hindi and write in Devanagari script
\nbut there is nothing on the record to suggest that any provision has
\nbeen made or order issued declaring Hindi as a national language of
\nthe country.\n<\/p>\n
\tIn
\nthe present case, as we find that under Rules 9(4) and 33(3A) a
\nspecific provision has been made to  give the particulars of
\ndeclaration under   the Standards of Weights and Measures (Packaged
\nCommodities) Rules, 1977, either in Hindi in Devanagari script or in
\nEnglish, it is for the manufacturers and others who are guided by the
\nRules of 1977 to decide whether particulars of declaration should be
\nin Hindi in Devanagari script or in English. No mandamus can be
\nissued on any of such manufacturers or others for giving details or
\nparticulars of package in Hindi in Devanagari script.\n<\/p>\n
\tThere
\nbeing no merit, the petition is dismissed but there shall be no order
\nas to costs.\n<\/p>\n
