Gill, Advocate\n           for respondents.\n                 -----\n\nJUDGMENT:\n<\/pre>\n<p>1.         This petition seeks quashing of letter (Annexure P-<\/p>\n<p>2) to S.S.P. dated 7.1.2008, seeking police help and letter dated<\/p>\n<p>9.6.2008 (Annexure P-5), taking over the mortgaged properties<\/p>\n<p>which were valued at Rs.38.30 lac.\n<\/p>\n<p> C.W.P. No.13042 of 2008<\/p>\n<p><span class=\"hidden_text\">                                                                    2<\/span><\/p>\n<p>2.        Case of the petitioners is that petitioner No.1 took a<\/p>\n<p>loan of Rs.1.95 lac on 11.8.1988 for purchasing a mini bus. On<\/p>\n<p>default of payment, the Financial Corporation has taken deemed<\/p>\n<p>possession of the mortgaged property. The petitioner has<\/p>\n<p>already paid a sum of Rs.2.83 lacs which was adjusted against<\/p>\n<p>interest from time to time. The Financial Corporation offered<\/p>\n<p>One Time Settlement, vide letter dated 9.8.2001 (Annexure P-<\/p>\n<p>1) on payment of Rs.2.12 lac in instalments. The petitioner<\/p>\n<p>could not pay the said amount and thereafter, as on 15.1.2008,<\/p>\n<p>demand of Rs.22,70,837\/- was raised.\n<\/p>\n<p>3.        On 1.8.2008, while issuing notice, following order<\/p>\n<p>was passed:-\n<\/p>\n<p>          &#8220;The    petitioners   had    borrowed      a   sum   of<br \/>\n          Rs.01,95,000\/- in the year 1988 for the purchase of<br \/>\n          Mini Bus under &#8220;General Transport Scheme&#8221;. Till<br \/>\n          date, the petitioner has paid a sum of Rs.02,83,000\/-<br \/>\n          which has been adjusted towards the interest. The<br \/>\n          present account position is as follows:-\n<\/p>\n<p>                                              (Amt. in Rs.)<br \/>\n          Outstanding\/Default                 22,70,837\/-\n<\/p>\n<p>          Principal &amp; expenses                1,85,895\/-\n<\/p>\n<p>          Interest (with further intt. from   20,84,942\/-<br \/>\n          15-01-2008)<br \/>\n C.W.P. No.13042 of 2008<\/p>\n<p><span class=\"hidden_text\">                                                                   3<\/span><\/p>\n<p>          The respondents have attached the residential house<br \/>\n          of the petitioners and agricultural land of the<br \/>\n          guarantors.\n<\/p>\n<p>          Learned counsel for the petitioners submits that<br \/>\n          similarly situated persons who also availed of loan<br \/>\n          from the respondents, have been granted concession<br \/>\n          and one time settlement has been arrived at between<br \/>\n          them. Therefore, the petitioners should have also<br \/>\n          been treated similarly.\n<\/p>\n<p>          Learned counsel for the petitioners states that the<br \/>\n          petitioners are ready and willing to make some<br \/>\n          payment as full and final payment to the<br \/>\n          respondents.\n<\/p>\n<p>          Notice of motion for 15.10.2008.\n<\/p>\n<p>          In the meantime, sale of the attached property of the<br \/>\n          petitioners as well as the property belonging to the<br \/>\n          guarantors shall not be effected. In order to test the<br \/>\n          bonafides of the petitioners, they are directed to<br \/>\n          deposit a sum of Rs.1 lac on or before the next date<br \/>\n          of hearing.&#8221;\n<\/p>\n<\/p>\n<p>4.        Learned counsel for the petitioner submits that the<\/p>\n<p>amount of Rs.1 lac was deposited and further demands are<\/p>\n<p>arbitrary, particularly when penal interest has also been<\/p>\n<p>capitalized in violation of law laid down by the Hon&#8217;ble<br \/>\n C.W.P. No.13042 of 2008<\/p>\n<p><span class=\"hidden_text\">                                                                   4<\/span><\/p>\n<p>Supreme Court in <a href=\"\/doc\/1423031\/\">Central Bank of India v. Ravindra AIR<\/a><\/p>\n<p>2001 SC 3095. He has also submitted that the Financial<\/p>\n<p>Corporation had a remedy of moving the Court under Section<\/p>\n<p>31 of the State Financial Corporation Act, 1951 (for short, &#8220;the<\/p>\n<p>Act&#8221;), but the Financial Corporation chose to proceed under<\/p>\n<p>Section 29 of the Act. The Financial Corporation has, thus,<\/p>\n<p>made discrimination against the petitioners in not granting<\/p>\n<p>waiver, which has been granted in some other cases. The<\/p>\n<p>Financial Corporation has proceeded against the house of the<\/p>\n<p>petitioners which is exempted from attachment under Section<\/p>\n<p>60 of the Civil Procedure Code.\n<\/p>\n<p>5.         In the reply filed, stand of the respondents is that<\/p>\n<p>they are proceeding as per the contract in a commercial<\/p>\n<p>transaction and the petition raises disputed questions as to the<\/p>\n<p>amount due. The Financial Corporation had option of invoking<\/p>\n<p>Section 29 of the Act and was not bound to proceed under<\/p>\n<p>Section 31 of the Act. The allegation of discrimination has also<\/p>\n<p>been denied. It has also been stated that Section 60 of Civil<\/p>\n<p>Procedure Code was not applicable.\n<\/p>\n<p>6.         We have heard learned counsel for the parties.<br \/>\n C.W.P. No.13042 of 2008<\/p>\n<p><span class=\"hidden_text\">                                                                     5<\/span><\/p>\n<p>7.         No doubt the petitioners have paid a sum of<\/p>\n<p>Rs.2,83,000\/- against the total principal amount of Rs.1,95,00\/-,<\/p>\n<p>which has mostly been adjusted towards interest, the payments<\/p>\n<p>have been given over a scattered period and as per the contract,<\/p>\n<p>certainly, more amount is due. Even if demand raised is higher,<\/p>\n<p>quantification is a disputed question. The petitioners did not<\/p>\n<p>pay as per One Time Settlement offer.\n<\/p>\n<p>8.         Disputed questions do arise as to the amount to be<\/p>\n<p>paid by the petitioners and on disputed facts, it cannot be held<\/p>\n<p>that nothing is due against the petitioner or that no claim can be<\/p>\n<p>made by the respondents or that the respondents cannot proceed<\/p>\n<p>under Section 29 of the Act against mortgaged properties.<\/p>\n<p>Section 60 CPC does not apply. The said provision applies only<\/p>\n<p>to execution of decree of civil court. There is no merit in the<\/p>\n<p>plea of discrimination.\n<\/p>\n<p>9.         There is no dispute with the proposition that the<\/p>\n<p>Corporation being a public authority has to act fairly, but<\/p>\n<p>without settling the disputed questions, we cannot issue any<\/p>\n<p>direction to the Financial Corporation, at this stage, except<\/p>\n<p>saying that if the Corporation wishes to dispose of the property,<\/p>\n<p>it will allow the petitioners to bring a buyer and the sale by the<br \/>\n C.W.P. No.13042 of 2008<\/p>\n<p><span class=\"hidden_text\">                                                                     6<\/span><\/p>\n<p>Corporation will be by following due process, in such a way<\/p>\n<p>that best price of the property is fetched and after adjusting its<\/p>\n<p>dues, the remaining amount be remitted to the petitioners. The<\/p>\n<p>Corporation cannot capitalize penal interest as held in Central<\/p>\n<p>Bank of India (supra) and if that has been done, the<\/p>\n<p>Corporation will make necessary adjustment accordingly. If<\/p>\n<p>any amount is recovered in excess, the petitioners will be<\/p>\n<p>entitled to get the same refunded. For remaining disputes, if<\/p>\n<p>any, the petitioners will be at liberty to have their liability<\/p>\n<p>quantified in appropriate proceedings, if so advised.\n<\/p>\n<p>10.
