Rule With  consent  of parties the writ  petition  is<br \/>\n             taken up for final disposal.\n<\/p>\n<p> 2.                    The petitioner was appointed as a Conductor with<br \/>\n             the  respondent  Corporation  in   August  1982.    The<br \/>\n             petitioner   sustained   injury  on   9.10.1998   while<br \/>\n             returning  from  duty.  As a consequence of the  injury<br \/>\n             the  petitioner&#8217;s right leg had to be amputated and the<br \/>\n             petitioner  was  assessed  at   60%  disability.    The<br \/>\n             petitioner  was retired prematurely on 22.11.1999.   It<br \/>\n             may  be also relevant to state that the petitioner  has<br \/>\n             placed  a circular dated 4.2.2000 of the respondent  on<br \/>\n             record  to  the  effect that  employees  who  sustained<br \/>\n             injury  on  account  of accident while on duty  may  be<br \/>\n             suitably  adjusted on alternative job\/ duty during  the<br \/>\n             period  of injury pending consideration of the decision<br \/>\n             period  of injury pending consideration of the decision<br \/>\n             to  be  taken  in  respect of  rehabilitation  of  such<br \/>\n             employees in view of certain judgments of this Court.\n<\/p>\n<p>                    The  subsequent development after the filing  of<br \/>\n             the  petition  is  that the  original  petitioner  Shri<br \/>\n             Mahipal  Singh expired on 10.6.2001 and his legal heirs<br \/>\n             being  his  widow, two sons and mother were brought  on<br \/>\n             record  who  are  now the petitioners  in  the  present<br \/>\n             petition.\n<\/p>\n<p> 3.                 In  view of the aforesaid facts, learned counsel<br \/>\n             for  the  petitioner  contends that the  petitioner  is<br \/>\n             entitled  to  the  protection under  the  Persons  with<br \/>\n             Disabilities (Equal Opportunities, Protection of Rights<br \/>\n             and Full Participation) Act, 1995 (hereinafter referred<br \/>\n             to as the Act) which came into effect on 1.1.1996.\n<\/p>\n<p> 4.                    Mr.    Vinay  Sabharwal,   learned  counsel  for<br \/>\n             respondent  however contends that since the  petitioner<br \/>\n             met  with  an  accident  not   during  the  course   of<br \/>\n             performance  of  his  duty  with  the  respondent,  the<br \/>\n             protection of the Act would not be available.\n<\/p>\n<p> 5.        The  petitioner  was met with accident while  he<br \/>\n             was  returning  from  duty.  The issue  raised  by  Mr.<br \/>\n             Sabharwal  has  been  squarely dealt  with  in  another<br \/>\n             judgment of this Court in CW 5700\/2000 Rajbir Singh Vs.<br \/>\n             Delhi  Transport Corporation and others decided on 24th<br \/>\n             January, 2002.  The said judgment took into account the<br \/>\n             judgment  of another learned Single Judge of this Court<br \/>\n             in  Baljeet Singh Vs.  DTC, ,  holding<br \/>\n             that  the Act being beneficially legislation and has to<br \/>\n             be  construed liberally and such cases would be covered<br \/>\n             under the Act.  Baljeet Singh case (supra) was affirmed<br \/>\n             right till the Supreme Court.\n<\/p>\n<p> 6.                    The  observation of the learned Single Judge  in<br \/>\n             CW  382\/2000 Ashok Kumar Vs.  DTC decided on  10.5.2000<br \/>\n             to  the effect that Section 47 of the Act does not  lay<br \/>\n             down any distinction as to the places where the persons<br \/>\n             has suffered a disability was also taken note of.\n<\/p>\n<p> 7.                    In  view of the aforesaid judgments the case  of<br \/>\n             Shri  Mahipal Singh would be squarely covered under the<br \/>\n             provisions of the Act.\n<\/p>\n<p> 8.                    Writ  petition is thus allowed and the order  of<br \/>\n             termination  dated 22.11.1999 is hereby quashed.   Shri<br \/>\n             Mahipal  Singh would be notionaly treated to have taken<br \/>\n             back  into  service from the date when  the  respondent<br \/>\n             stopped  paying  full salary after termination  of  his<br \/>\n             services   and  would  be   treated  as  in  continuous<br \/>\n             employment without any break in service till he expired<br \/>\n             on  10.6.2001.  The petitioner&#8217;s case would  thereafter<br \/>\n             be  treated  as of an employee who had  expired  during<br \/>\n             service.   The emoluments due to the petitioner for the<br \/>\n             period  for  which  he  would have  served  along  with<br \/>\n             benefits  which would arise on account of his death  in<br \/>\n             service  shall  be calculated and paid to  the  present<br \/>\n             petitioners  who are his legal heirs within a period of<br \/>\n             two months from today.\n<\/p>\n<p> 9.
