No.43344 of 2010\n                                       RAJESH PRASAD\n                                               Versus\n                                    THE STATE OF BIHAR\n                                             -----------\n<\/pre>\n<p>02\/    14.01.2011          Both the above stated criminal miscellaneous cases arise out<\/p>\n<p>                    of Aurangabad (Mufassil) P.S. Case no. 198\/1998 registered under<\/p>\n<p>                    section 395 of the IPC and accordingly, both the above stated petitions<\/p>\n<p>                    are being disposed of by this common order.\n<\/p>\n<p>                               Heard learned counsel for the petitioners as well as learned<\/p>\n<p>                    P.P. for the State.\n<\/p>\n<p>                               It appears from the impugned order that petitioners were<\/p>\n<p>                    made accused in the above stated case and they were charge sheeted.<\/p>\n<p>                    The charges against them were framed on 11.9.2001 but on 4.2.2002<\/p>\n<p>                    petitioner in Cr. Misc.no.43333\/2010 and on 19.8.2004 petitioner in<\/p>\n<p>                    Cr. Misc. no. 43344\/2010 respectively were made absent themselves<\/p>\n<p>                    from the proceeding resulting cancellation of their bail bond.<\/p>\n<p>                    Subsequently, they surrendered before the trial court.<\/p>\n<p>                               Considering the aforesaid circumstances as well as<\/p>\n<p>                    submissions of the parties, petitioners (Damodar Yadav and Rajesh<\/p>\n<p>                    Prasad) are directed to be released on bail in connection with<\/p>\n<p>                    Aurangabad (Mufassil) P.S. Case no. 198\/1998 on furnishing bail<\/p>\n<p>                    bond of Rs 10,000\/- each with two sureties of the like amount each to<\/p>\n<p>                    the satisfaction of the Addl.
