He has<br \/>\nsubmitted that looking to the allegations made against the present<br \/>\napplicant no role is played by the present applicant. He has<br \/>\nsubmitted that no prima facie case is made out against the present<br \/>\napplicant.  The present applicant is a notary and practicing lawyer.<br \/>\nHe has submitted that so called power of attorney is not notarized by<br \/>\nthe present applicant. He has therefore, prayed that present<br \/>\napplicant may be granted anticipatory bail.\n<\/p>\n<p>3.\tHeard<br \/>\nMs.Chetna Shah, learned APP for the respondent State. Ms.Shah has<br \/>\nvehemently opposed the present application.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, I am<br \/>\ninclined to grant anticipatory bail to the applicant. This Court has<br \/>\nalso taken into consideration the law laid down by the Apex Court in<br \/>\nthe case of <a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of<br \/>\nMaharashtra &amp; Ors.,<\/a> reported in (2011) 1 SCC 694,<br \/>\nwherein the Apex Court reiterated the law laid down by the<br \/>\nConstitutional Bench in the case of Shri Gurubaksh Singh<br \/>\nSibbia &amp; Ors., reported in (1980) 2 SCC 565.\n<\/p>\n<p>5.\tThe application is<br \/>\nallowed. The applicant is granted anticipatory bail in the event of<br \/>\nhis arrest in connection with CR No. I-52 of 2011 registered<br \/>\nwith  Thorala Police Station, Rajkot for the offences as alleged in<br \/>\nFIR on his executing a bond of Rs.10,000\/- [Rupees Ten thousand only]<br \/>\nwith one surety of the like amount on the following conditions that<br \/>\nhe shall:\n<\/p>\n<p>[a]\tco-operate with the<br \/>\ninvestigation and make himself available for interrogation whenever<br \/>\nand wherever required.\n<\/p>\n<p>[b]\tshall remain present<br \/>\nat the concerned Police Station on 14.11.2011 at 11.00 AM ;\n<\/p>\n<p>[c]\tshall not hamper the<br \/>\ninvestigation in any manner nor shall directly or indirectly make any<br \/>\ninducement, threat or promise to any person acquainted with the facts<br \/>\nof the case so as to dissuade him from disclosing such facts to the<br \/>\nCourt or to any police officer;\n<\/p>\n<p>[d]\tat the time of<br \/>\nexecution of bond, furnish him residential address to the<br \/>\ninvestigating officer and the Court concerned and shall not change<br \/>\nthe residence till the final disposal of the case or till further<br \/>\norders;\n<\/p>\n<p>[e]\tnot leave State of<br \/>\nGujarat without the permission of the Court and, if holding a<br \/>\npassport, he shall surrender the same before the Trial Court within a<br \/>\nweek;\n<\/p>\n<p>[f]\tnot obstruct or hamper<br \/>\nthe police investigation and not play mischief with the evidence<br \/>\ncollected or yet to be collected by the police;\n<\/p>\n<p>6.\tIt would be open to the<br \/>\nInvestigating Officer to file an application for remand if he<br \/>\nconsiders it proper and just;
