DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 07\/05\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\napplicant has filed this application through his father and power of<br \/>\nattorney holder with the following prayer:\n<\/p>\n<p>&#8220;(A)\tThat<br \/>\nthis Hon&#8217;ble Court be pleased to quash and set aside IR bearing I<br \/>\nC.R. No.558 of 2006 registered at Naranpura Police Station, Ahmedabad<br \/>\nand the proceedings prior and pursuant thereto against the applicant<br \/>\nfor the interest of justice;\n<\/p>\n<p>\tAt<br \/>\nthe outset, learned advocates appearing for the applicant and<br \/>\nrespondent No.2 have jointly submitted that both the parties have<br \/>\narrived at an amicable settlement to end their matrimonial dispute.<br \/>\nSo far as the complainant No.2 is concerned she has filed an<br \/>\naffidavit dated 06.05.2010 and stated that with intervention of<br \/>\nfamily members of the applicant as well as respondent No.2, dispute<br \/>\nbetween them no longer survives and they have decided to live<br \/>\nseparately, and therefore, complaint is to be quashed.  Even a<br \/>\ncompromise was arrived on 09.04.2010 between the parties is also<br \/>\nproduced, which is ordered to be taken on record.\n<\/p>\n<p>\tIn<br \/>\nview of the above and considering the agreement for compromise,<br \/>\naffidavit filed by the complainant whereby it is declared that the<br \/>\ndispute between the parties with regard to the subject complaint no<br \/>\nmore exists and they have arrived at an amicable settlement, I am of<br \/>\nthe opinion that continuation of criminal proceedings against the<br \/>\napplicant will entail undue hardship and mental agony.  A case is<br \/>\nmade out to exercise powers under Section 482 of the Code of Criminal<br \/>\nProcedure, 1973.\n<\/p>\n<p>\tThis<br \/>\napplication is allowed accordingly.  Impugned complaint is hereby<br \/>\nquashed quashed.\n<\/p>\n<p>\tDirect<br \/>\nservice is permitted.\n<\/p>\n<p>[Anant<br \/>\nS.
