DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/12\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nCR No.I-29 of 2009 with DCB Police Station, Vadodara City, for the<br \/>\noffences punishable under Sections 406, 420, 465, 467, 468, 471, 474<br \/>\nand 120-B of the Indian Penal Code.\n<\/p>\n<p>2.\tLearned<br \/>\ncounsel appearing for the applicant submits that  he applicant is<br \/>\nattributed of supplying a specimen signature to certain persons who<br \/>\nare alleged to have executed a forged wil of father of the<br \/>\ncomplainant.  The case before the Civil court about probate is<br \/>\npending.  It is further submitted that besides this, there is no role<br \/>\nattributed to the applicant who happened to be a driver of the father<br \/>\nof the complainant and there he may be granted bail.\n<\/p>\n<p>3.\tHeard<br \/>\nlearned APP for the respondent &#8211; State and learned advocate for<br \/>\nthe complainant who opposes grant of bail and submits that but for<br \/>\nthe overt act of supplying specimen signature of the father of the<br \/>\ncomplainant no wil could have been forged and, therefore, the<br \/>\napplicant cannot be enlarged on bail.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, and<br \/>\nbesides, the Civil Court has ceased with the subject matter whether<br \/>\nto grant probate or not, I am inclined to enlarge the applicant on<br \/>\nbail.\n<\/p>\n<p>5.\tLearned<br \/>\ncounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith first information report registered at CR No.I-29 of 2009 with<br \/>\nDCB Police Station, Vadodara City, on executing a bond of Rs.5,000\/-<br \/>\n(Rupees Five Thousand only) with one surety of the like amount to the<br \/>\nsatisfaction of the trial Court and subject to the conditions that he<br \/>\nshall;\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of liberty or misuse liberty;\n<\/p>\n<p>(b)\tnot<br \/>\nact in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>(c)\tsurrender<br \/>\npassport, if any, to the lower court within a week;\n<\/p>\n<p>(d)\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>(e)\tmark<br \/>\npresence at the concerned police station on the first Sunday of every<br \/>\nmonth between 10.00 a.m. and 3.00 p.m. till the trial commences;\n<\/p>\n<p>(f)\tfurnish<br \/>\nthe present address of his residence to the I.O. and also to the<br \/>\nCourt at the time of execution of the bond and shall not change the<br \/>\nresidence without prior permission of this Court;\n<\/p>\n<p>7.\tThe<br \/>\nAuthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>8.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>10.\tAt<br \/>\nthe trial, the trial court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicant on bail.\n<\/p>\n<p>11.\tRule<br \/>\nis made absolute to the aforesaid extent.  D.S. Permitted.\n<\/p>\n<p>12.\tIt<br \/>\nis made clear that observations of prima facie nature shall have no<br \/>\nbearing on any proceedings pending before any Court or forum.\n<\/p>\n<p>(ANANT<br \/>\nS.
