It was submitted that even if it is considered<br \/>\n\tthat the workman would not be entitled for the backwages, it least<br \/>\n\the would be entitled to continuity in service which was so ordered<br \/>\n\tby the Labour Court in the award and ought not to have been set<br \/>\n\taside.  The learned counsel therefore, submitted that the matter<br \/>\n\tdeserves consideration.\n<\/p>\n<p>It<br \/>\n\tappears from the Award passed by the Labour Court that the alleged<br \/>\n\ttermination was of 31.01.2008.  Whereas the dispute is raised after<br \/>\n\ta period of six years.  Further, the status of the workman-appellant<br \/>\n\twas as a daily wager. Under these circumstances, it appears to us<br \/>\n\tthat the learned Single Judge has interfered with the Award passed<br \/>\n\tby the Labour Court so far as it relates to backwages and continuity<br \/>\n\tin service are concerned.\n<\/p>\n<p>In<br \/>\n\ta case of daily wager, once reinstatement is maintained and the<br \/>\n\taward so far as it relates to backwages and continuity in service is<br \/>\n\tset aside, the power exercised cannot be said to be arbitrary, more<br \/>\n\tparticularly, in view of the direction issued by the learned Single<br \/>\n\tJudge that the earlier period of the respondent, i.e, before<br \/>\n\tretrenchment be taken into consideration for the purpose of reaching<br \/>\n\tthe age of superannuation as well as pension and the retiral dues<br \/>\n\tand not for any increment or for any other purpose.
