THE RESIDENT COMMISSIONER GOVERNMENT OF BIHAR, BIHAR BHAWAN, 5\n     KAUTILYA MARG, NEW DELHI\n                                       -----------\n<\/pre>\n<p>2.   10.08.2010            Heard learned Counsel for the petitioner and the learned<\/p>\n<p>                  Counsel for the State.\n<\/p>\n<p>                           The    petitioner   is   aggrieved     by    the    order   dated<\/p>\n<p>                  29.6.2010 transferring him to Gardanibagh.<\/p>\n<p>                           It is submitted that the petitioner was posted at Bihar<\/p>\n<p>                  Bhawan, New Delhi when he came to be suspended by an<\/p>\n<p>                  order dated 15.2.2010 and his headquarters during suspension<\/p>\n<p>                  period    was    designated       as   the   office   of    Superintending<\/p>\n<p>                  Engineer, Building Circle, Patna. The petitioner questioned the<\/p>\n<p>                  same in CWJC No. 5739 of 2010. On 19.4.2010 this Court<\/p>\n<p>                  stayed the operation of the order of suspension. The writ<\/p>\n<p>                  petition is stated to be still pending.\n<\/p>\n<p>                           Learned Counsel for the petitioner is correct in his<\/p>\n<p>                  submission that if the order of suspension has been stayed the<\/p>\n<p>                  order fixing the headquarter at Patna during period of<\/p>\n<p>                  suspension automatically also vanishes. The petitioner is first<\/p>\n<p>                  required to be permitted to join at Bihar Bhawan, New Delhi<br \/>\n             and thereafter the matter may proceed afresh in accordance<\/p>\n<p>            with law.\n<\/p>\n<p>                  This   Court    finds   that   the       impugned    order     dated<\/p>\n<p>            29.6.2010 proceeds on a completely wrong premise when in<\/p>\n<p>            column   4   it   describes   him    as    a    person    relieved   from<\/p>\n<p>            suspension. This Court has already held that the petitioner<\/p>\n<p>            stands reinstated in his service at Bihar Bhawan, New Delhi<\/p>\n<p>            and column 4 should have made a correct recitals of his<\/p>\n<p>            present status and in absence of which the present impugned<\/p>\n<p>            order is not sustainable.\n<\/p>\n<p>                  The order dated 29.6.2010 is quashed in so far as the<\/p>\n<p>            petitioner alone is concerned, without prejudice to the rights of<\/p>\n<p>            the respondents.\n<\/p>\n<p>                  The writ application stands allowed.\n<\/p>\n<\/p>\n<pre>Snkumar\/-                                         (Navin Sinha,J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Phuleshwar Prasad Mandal vs The State Of Bihar &amp;Amp; Ors on 10 August, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA CWJC No.11094 of 2010 1.
