    The petitioner is working as Full Time Menial<\/p>\n
in A.K.S.G.H.S. Malappattam in Kannur District.<\/p>\n
His grievance is that he is denied the benefit of<\/p>\n
by transfer appointment as Laboratory Assistant in<\/p>\n
Government Higher Secondary School.<\/p>\n
    2. It is stated that as per the Special Rules,<\/p>\n
the method of appointment to the post of Laboratory<\/p>\n
Assistant in Government Higher Secondary Schools is<\/p>\n
prescribed. According to the Special Rules, the<\/p>\n
post of Lab Assistant comes under category No.4<\/p>\n
of  Rule  3.    Rule  3   provides  the  method  of<\/p>\n
appointment (1) by direct recruitment and (2) by<\/p>\n
transfer from among qualified last grade employees<\/p>\n
in the schools, at the ratio 75:25. According to<\/p>\n
the petitioner, Full Time Menial is a last grade<\/p>\n
employee and accordingly, the 25% quota reserved<\/p>\n
for by transfer appointment as Laboratory Assistant<\/p>\n

should be available to Full Time Menial as well.   It is<\/p>\n
pointed    out   by   the  petitioner  that  on  earlier<\/p>\n
occasions, several Full Time Menials, placed in the<\/p>\n
same position as that of the petitioner, were appointed<\/p>\n
as Laboratory Assistants in Higher Secondary Schools.<\/p>\n
Ext.P1 proceedings of the Director of Higher Secondary<\/p>\n
Education    dated   17.12.2004 is  relied  on  in  that<\/p>\n
context.   It is stated that thereafter, the Director of<\/p>\n
Higher   Secondary    Education issued  Exts.P2  and   P3<\/p>\n
orders, by which the Full Time Menials were excluded<\/p>\n
from   the    purview   of   appointment  as   Laboratory<\/p>\n
Assistants.      Pointing  out  the    grievance of  the<\/p>\n
petitioner, he submitted Ext.P4 representation dated<\/p>\n
27.9.2010 to the Director, Higher Secondary Education.<\/p>\n
Ext.P4 is pending disposal.\n<\/p>\n<\/p>\n
    3. It is submitted by the learned counsel for the<\/p>\n
petitioner that the view taken by the Director of<\/p>\n
Higher Secondary Education, on a perusal of Exts.P2 and<\/p>\n
P3 orders, appears to be that Full Time Menials working<\/p>\n
in Government Schools do not satisfy the definition of<\/p>\n

“Qualified last grade employees in schools” in Rule 3<\/p>\n
of the Kerala Higher Secondary Education Subordinate<\/p>\n
Service Rules. The counsel submits that this view is<\/p>\n
clearly wrong and Full Time Menial certainly is a last<\/p>\n
grade employee.       The Director of Higher Secondary<\/p>\n
Education has to take a decision in the matter in view<\/p>\n
of the alleged conflicting stand in Exts.P1 to P3, so<\/p>\n
that, matters would be clear and there shall be no<\/p>\n
ambiguity creating confusion among the aspirants for<\/p>\n
being appointed as Laboratory Assistants.<\/p>\n
    4.     The     learned   Government   Pleader,   on<\/p>\n
instructions, submitted that the seniority list for<\/p>\n
appointment as Laboratory Assistants is to be prepared<\/p>\n
by the General Education Department and the Director of<\/p>\n
Public Instruction is the authority to do so.     It is<\/p>\n
therefore, submitted that the petitioner has to submit<\/p>\n
a   representation       to  the   Director  of  Public<\/p>\n
Instruction.\n<\/p>\n

    5.    In   reply,   the  learned  counsel  for   the<\/p>\n
petitioner submitted that the appointing authority is<\/p>\n
the   Director    of   Higher  Secondary  Education  and<\/p>\n
therefore,    Ext.P4    was  submitted  to  the   proper<\/p>\n
authority.    The seniority list prepared by the General<\/p>\n
Education Department becomes relevant only at the time<\/p>\n
of appointment.     In short, the submission is that the<\/p>\n
question whether the Full Time Menial comes under the<\/p>\n
category of persons who could be appointed in the 25%<\/p>\n
quota for appointment as Laboratory Assistants is a<\/p>\n
matter for the decision of the Director of Higher<\/p>\n
Secondary Education and not of the General Education<\/p>\n
Department.\n<\/p>\n<\/p>\n
    6. Taking into account the submissions made by the<\/p>\n
learned counsel for the petitioner as well as the<\/p>\n
learned Government Pleader, I am of the view that the<\/p>\n
Writ Petition can be disposed of directing the second<\/p>\n
respondent    to    consider  and   dispose  of   Ext.P4<\/p>\n
representation.\n<\/p>\n

    Accordingly, the Writ Petition is disposed of as<\/p>\n
follows:\n<\/p>\n<\/p>\n
    The Director of Higher Secondary Education shall<\/p>\n
consider and dispose of Ext.P4 representation dated<\/p>\n
27.9.2010 submitted by the petitioner, as expeditiously<\/p>\n
as possible and, at any rate within a period of three<\/p>\n
months from the date of receipt of a copy of the<\/p>\n
judgment, after affording an opportunity of being heard<\/p>\n
to the petitioner.      The Director of Higher Secondary<\/p>\n
Education would be entitled to make reference to the<\/p>\n
Director of Public Instruction or the Secretary to the<\/p>\n
Government, or both, before taking a final decision on<\/p>\n
Ext.P4. The petitioner shall produce a copy of the Writ<\/p>\n
Petition and certified copy of the judgment before the<\/p>\n
Director of Higher Secondary Education.<\/p>\n
