18.   22.6.2010          The petitioner, common in all these<\/p>\n
                three    cases,        has     sought      a     direction     for<\/p>\n
                payment of salary in two of them, namely,<\/p>\n
                C.W.J.C.No.            7170\/1994           and        C.W.J.C.No.<\/p>\n
                3659\/1995,       whereas       in    C.W.J.C.No.        762\/1995<\/p>\n
                he     seeks      to        challenge          the     order    of<\/p>\n
                absorption of respondent no.5 on the ground<\/p>\n
                that    such    absorption           would     mean    automatic<\/p>\n
                termination            of      the      service         of     the<\/p>\n
                petitioner, inasmuch as the post of Lecturer<\/p>\n
                in Rameshwar Singh College, Muzaffarpur is<\/p>\n
                being    claimed        both    by    the      petitioner      and<\/p>\n
                respondent no.5.\n<\/p>\n
                           It is also not in doubt that the<\/p>\n
                said College in question was an affiliated<\/p>\n
                College and was taken over by the University<\/p>\n
                in the year 1981 pursuant to a decision of<\/p>\n
                the     State     Government          to       take    over    103<\/p>\n
                Colleges        (3rd        phase     of       takeover).      The<\/p>\n
                condition of takeover was already formulated<\/p>\n
                by the State Government and the University
\n                     3<\/span><\/p>\n
could have taken over service of teaching<\/p>\n
and non-teaching employees only as per the<\/p>\n
conditions imposed by the State Government<\/p>\n
in its decision with regard to takeover of<\/p>\n
103 Colleges.\n<\/p>\n
              In        this        case     there        is     an<\/p>\n
appointment letter issued in favour of the<\/p>\n
petitioner by the Principal of the College<\/p>\n
which is not backed by any advertisement.<\/p>\n
Counsel       for    the       petitioner,        however,      has<\/p>\n
stated that there was an advertisement prior<\/p>\n
to the order of appointment issued by the<\/p>\n
Principal of the affiliated College.<\/p>\n
              On the other hand, respondent no.5<\/p>\n
in     his    counter          affidavit     in        C.W.J.C.No.<\/p>\n
762\/1995 has categorically asserted that an<\/p>\n
advertisement           in     newspaper         was     published<\/p>\n
only     in    the       month       of    March,       2000    and<\/p>\n
therefore, the claim of the petitioner of<\/p>\n
being         appointed             on     the         basis     of<\/p>\n
advertisement has been seriously questioned.<\/p>\n
In      any        event        when       the     petitioner’s<\/p>\n
appointment is said to be made in the month<\/p>\n
of   January,        1980      by    the   Principal       of   the<\/p>\n
College and there is a recommendation of the<\/p>\n
College Service Commission on 13.9.1980 as
\n                    4<\/span><\/p>\n
with regard to only a leave reserved post,<\/p>\n
the   records       will          have    to    show     that   the<\/p>\n
college\/the commission had infact advertised<\/p>\n
the said leave reserve post on the basis of<\/p>\n
which the Commission would have given its<\/p>\n
approval as is sought to be conveyed by the<\/p>\n
document in question filed by the petitioner<\/p>\n
showing      temporary             recommendation         of    the<\/p>\n
College Service Commission for a period of<\/p>\n
one   year    or       till       the    availability      of   the<\/p>\n
sanctioned        post       on    which       the   petitioner’s<\/p>\n
approval\/ concurrence was sought to be given<\/p>\n
by the Commission.\n<\/p>\n
             Counsel for the petitioner, however<\/p>\n
has   submitted           that          this    Court     is    not<\/p>\n
required      to    go       into       all    these     questions<\/p>\n
because      there       is       an    order    of     suspension<\/p>\n
issued       by        the        University           which    was<\/p>\n
ultimately withdrawn by the University and<\/p>\n
that by itself will at least go to show that<\/p>\n
after the College had become a constituent<\/p>\n
unit of the University the service of the<\/p>\n
petitioner had been taken over and he could<\/p>\n
continue      at        least           till     the     date    of<\/p>\n
consideration of his case for absorption by<\/p>\n
the University which infact had rejected his
\n                   5<\/span><\/p>\n
case for being absorbed on the post and on<\/p>\n
which    respondent       no.5      has     been     ultimately<\/p>\n
absorbed by the University<\/p>\n
              In the opinion of this Court even<\/p>\n
in an affiliated College the appointment of<\/p>\n
Lecturer        was      well         regulated        by       the<\/p>\n
provisions       of     the     Act     and    the       Statutes<\/p>\n
whether under 1960 Act or under 1976 Act.<\/p>\n
Such      regulation            never         provided          for<\/p>\n
appointment by the Principal of the College.<\/p>\n
              The next issue, therefore, would be<\/p>\n
when      the     Commission            also       has      given<\/p>\n
concurrence on a post of leave vacancy to<\/p>\n
the petitioner and that too for a limited<\/p>\n
period of one year, it would be difficult to<\/p>\n
understand        that        the       service        of       the<\/p>\n
petitioner could be ever taken over in terms<\/p>\n
of section 4(14) of the Act read with the<\/p>\n
condition imposed by the State Government in<\/p>\n
the order taking over 103 Colleges in the<\/p>\n
year 1980.\n<\/p>\n
              Unfortunately         there     is   a     complete<\/p>\n
silence    on     the   part     of     the    University        to<\/p>\n
give    any     details   on     these      aspects       and   in<\/p>\n
fact there is counter affidavit on behalf of<\/p>\n
the University explaining these aspects.
\n                   6<\/span><\/p>\n
            This Court in fact would also find<\/p>\n
it difficult to decide the question as to<\/p>\n
whether     the       mark-sheet        submitted      by     the<\/p>\n
petitioner        of     his   qualifying         Master       of<\/p>\n
Science Examination was forged or otherwise,<\/p>\n
inasmuch    as     the    University         while     allowing<\/p>\n
absorption      of      respondent       no.5    through      its<\/p>\n
Absorption       Committee        had    found    the       mark-<\/p>\n
sheet    submitted        by   the      petitioner       to   be<\/p>\n
forged. Counsel for the petitioner, however,<\/p>\n
would submit that on an earlier occasion the<\/p>\n
Absorption Committee of the University had<\/p>\n
found some other ground and had advised the<\/p>\n
petitioner         to      seek         absorption          under<\/p>\n
different    Statutes.         The      whole    question     in<\/p>\n
fact    would     be    whether        the   petitioner       was<\/p>\n
qualified under any of the Statutes framed<\/p>\n
by the Chancellor for being absorbed as a<\/p>\n
teacher of the College. This aspect again<\/p>\n
involving question of facts can be gone into<\/p>\n
in a graphic manner by the author of the<\/p>\n
Statutes himself, namely, Chancellor of the<\/p>\n
University.\n<\/p>\n
            The        scope      of     enquiry        to     be\n\nundertaken        by     the   Chancellor         of     course\n\n<\/pre>\n
unlimited u\/s 9(4) of the Act being quite
\n                     7<\/span><\/p>\n
vast,       it     will         be     also        open      for      the<\/p>\n
Chancellor          to     go        into     the        legality      of<\/p>\n
appointment of the petitioner and respondent<\/p>\n
no.5    so    as    to     confer          him     the     benefit    of<\/p>\n
being absorbed in the College.<\/p>\n
              In that view of the matter, this<\/p>\n
Court       would       deem     it        expedient        that      the<\/p>\n
matter is decided by the Hon’ble Chancellor<\/p>\n
who in exercise of his power u\/s 9(4)of the<\/p>\n
Act     will        examine           as      to      whether         the<\/p>\n
appointment of the petitioner and absorption<\/p>\n
in    the    College       was        permissible           so   as    to<\/p>\n
allow        him     to        question           the       order     of<\/p>\n
absorption         passed       in     favour         of   respondent<\/p>\n
no.5. Since everything will depend on the<\/p>\n
outcome       of     the       legality          of      appointment\/<\/p>\n
absorption of the petitioner, the validity<\/p>\n
of absorption order of respondent no.5 will<\/p>\n
only be gone into after it is held that the<\/p>\n
appointment of the petitioner was valid.<\/p>\n
              Since       these        writ        petitions        have<\/p>\n
remained pending for a very long period from<\/p>\n
1994    onwards,         this        Court       would      only    hope<\/p>\n
that    the        Chancellor          would        find     time      to<\/p>\n
dispose of the matter as early as possible<\/p>\n
preferably         within       a     period       of      six   months
\n                            8<\/span><\/p>\n
            from the date of receipt\/production of copy<\/p>\n
            of this order.\n<\/p>\n
                     With the aforementioned observation<\/p>\n
            and direction, these writ applications are<\/p>\n
            disposed of.\n<\/p>\n
