        The State     and    its    officers,     who were<\/p>\n
arrayed as respondents in O.P.No.9069\/02, are the<\/p>\n
appellants herein.    The respondents in the appeal,<\/p>\n
the writ petitioners, challenged Exts.P2, P3, P5<\/p>\n
and P7 orders, Ext.P2 order being passed by the<\/p>\n
Tahsildar  imposing      a    penalty       on    the writ<\/p>\n
petitioners,  under      Section      10    of    the Land<\/p>\n
Conservancy Act {for short “the Act”}, allegedly<\/p>\n
for cutting and removing two teak tress from a<\/p>\n
puramboke property. Though statutory appeal and<\/p>\n
revision were preferred by the writ petitioners<\/p>\n
against the said order, the same were dismissed.<\/p>\n
It is, therefore, the writ petition was filed<\/p>\n
challenging the orders passed by the authorities.<\/p>\n
The learned single Judge held that the imposition<\/p>\n
of penalty was not preceded by any enquiry nor was<\/p>\n
there any materials forthcoming to establish that<\/p>\n
the  petitioners     are    liable     to    be   proceeded<\/p>\n

\nagainst, under Section 10 of the Act. The writ<\/p>\n
petition was, therefore, allowed and the impugned<\/p>\n
orders were quashed. Hence this appeal.<\/p>\n
       2.   We have heard the learned Government<\/p>\n
Pleader.\n<\/p>\n
       3.    It is seen that though show cause<\/p>\n
notices were issued by the Tahsildar alleging that<\/p>\n
the writ petitioners have cut and removed two teak<\/p>\n
trees from the puramboke land, the petitioners<\/p>\n
appeared before the officer and took up a specific<\/p>\n
contention that they had not cut and removed the<\/p>\n
trees as alleged in the notice.   It was contended<\/p>\n
that the petitioners have no property in the<\/p>\n
disputed  area.  It  seems    that, in  spite   of<\/p>\n
objection having been taken, no enquiry, as such,<\/p>\n
was conducted, no witnesses were examined, no<\/p>\n
other independent material was produced and proved<\/p>\n
to show that the petitioners were responsible for<\/p>\n
cutting and removing the trees from the Government<\/p>\n
land.   Nevertheless, the Tahsildar proceeded to<\/p>\n
pass the order imposing the penalty. Neither the<\/p>\n
appellants nor the revisional authority considered<\/p>\n
any  of  the  contentions    raised by  the   writ<\/p>\n
petitioners.\n<\/p>\n

                          :: 3 ::\n<\/p>\n<\/p>\n
       4. In these circumstances, the learned<\/p>\n
single   Judge     was     perfectly      justified  in<\/p>\n
interfering   with    the       orders   impugned.  The<\/p>\n
procedure under Section 10 of the Act has been<\/p>\n
held to be quasi criminal in character by this<\/p>\n
court  on   more    than     one   occasion.     In such<\/p>\n
circumstances, we do not find any reason to take a<\/p>\n
different view from the one taken by the learned<\/p>\n
single Judge.\n<\/p>\n
       The appeal is bereft of merit and hence<\/p>\n
dismissed.\n<\/p>\n<\/p>\n
