They are<\/p>\n<p>challenging Ext.P6 notification issued by the 1st respondent<\/p>\n<p>inviting tenders for award of contract for house keeping work in<\/p>\n<p>their establishments. According to the petitioner, the security<\/p>\n<p>guards already working are entitled to be engaged for the work.<\/p>\n<p>The petitioner, therefore, seeks the following reliefs:<\/p>\n<blockquote><p>      &#8220;(a) To declare that the works done by the DGR sponsored agencies<br \/>\n           by    employing      Ex-servicemen     security guards    in  the<br \/>\n           establishments of the 1st respondent can be entrusted only to<br \/>\n           such agencies in accordance with the Govt. of India, DGR<br \/>\n           guidelines and to declare that the action of the 1st respondent in<br \/>\n           denying work to Ex-servicemen security guards by entrusting<br \/>\n           such works to private tenderers in terms of work (2) mentioned<br \/>\n           in Ext.P6 is illegal, improper and ultravires.\n<\/p><\/blockquote>\n<blockquote><p>      (b)  To call for the entire records leading to Ext.P6 and to issue a<br \/>\n           Writ of Certiorari or any other appropriate Writ, order or<br \/>\n           direction quashing the same, to the extend [sic] of allotment of<br \/>\n           work (2) mentioned in Ext.P6.\n<\/p><\/blockquote>\n<blockquote><p>      (c)  To issue a Writ of Mandamus or any other appropriate Writ,<br \/>\n           order or direction, directing the 1st respondent not to allot the<br \/>\n           items of work shown as work (2) in Ext.P6, on the basis of<br \/>\n           Ext.P6 proceedings.\n<\/p><\/blockquote>\n<blockquote><p>      (d)  To issue a Writ of Mandamus or any other appropriate Writ,<br \/>\n           order or direction, directing the 1st respondent to continue to<br \/>\n           allot the items of work shown as work (2) of Ext.P6, only to DGR<br \/>\n           sponsored agencies employing not less than 90% work force<br \/>\n           from among Ex-servicemen security guards and to further direct<br \/>\n           the 1st respondent to permit the continuance of existing DGR<br \/>\n           sponsored agencies employing Ex-servicemen security guards,<br \/>\n           in the establishments of the 1st respondent in accordance with<\/p>\n<p><span class=\"hidden_text\">w.p.c.10508\/08                          2<\/span><\/p>\n<p>             the Govt. of India guidelines.\n<\/p><\/blockquote>\n<blockquote><p>      (e)    To issue any other appropriate Writ, order or direction, directing<br \/>\n             the 1st respondent to permit the continuance of Ex-servicemen<br \/>\n             security guards employed by DGR sponsored agencies in the<br \/>\n             establishment of the 1st respondent, even after 4 years, as<br \/>\n             directed in Ext.P4 series.\n<\/p><\/blockquote>\n<blockquote><p>      (f)    To call for the records leading to Ext.P5 &amp; P5(a) and to issue a<br \/>\n             writ of certiorari or any other appropriate writ, order or direction<br \/>\n             quashing the same.&#8221;<\/p><\/blockquote>\n<p>      2.     The learned Standing Counsel appearing for the 1st<\/p>\n<p>respondent submits that the employees, whose cause is espoused<\/p>\n<p>by the petitioner, were security guards deputed by the former<\/p>\n<p>security agency to whom a contract was awarded for security<\/p>\n<p>work in the establishments of the 1st respondent. The contract<\/p>\n<p>period of that agency expired and in accordance with the scheme<\/p>\n<p>framed by the Directorate General of Resettlement, a new<\/p>\n<p>security agency has taken charge and the employees concerned<\/p>\n<p>have already ceased to be working in the 1st respondent&#8217;s<\/p>\n<p>establishments. They also submit that security agencies are<\/p>\n<p>engaged strictly in accordance with the guidelines issued by the<\/p>\n<p>Directorate General of Resettlement.
