No. 599 of 2009\n               ======================\n         Dated, this the 16th day of February, 2009\n\n                             O R D E R\n<\/pre>\n<p>      In this Revision    Petition filed under Section 397 read with<\/p>\n<p>Sec. 401    Cr.P.C. the petitioner who was the accused in S.T.<\/p>\n<p>No. 674 of 2006 on the file of the Judicial First Class Magistrate-<\/p>\n<p>II, Thamarassery challenges       the conviction    entered and the<\/p>\n<p>sentence passed against      him for an offence punishable under<\/p>\n<p>Sec. 138 of the Negotiable Instruments Act, 1881 (hereinafter<\/p>\n<p>referred to as &#8216;the Act&#8217;).  The cheque amount was Rs.42,000\/-.<\/p>\n<p>The compensation ordered by the lower appellate court is<\/p>\n<p>Rs.42,000\/-.\n<\/p>\n<p>      2.   I heard the learned counsel for the Revision Petitioner<\/p>\n<p>and the learned Public Prosecutor.\n<\/p>\n<p>      3.   The learned counsel appearing for the Revision<\/p>\n<p>Petitioner re-iterated the contentions in support of the Revision.<\/p>\n<p>      4.     The courts below have concurrently held that the<\/p>\n<p>cheque in question was drawn by the petitioner in favour of the<\/p>\n<p>complainant, that the complainant had validly complied with<\/p>\n<p><span class=\"hidden_text\">Crl.R..P. No. 599\/2009           -:2:-<\/span><\/p>\n<p>clauses (a) and (b) of the proviso to Section 138 of the Act.<\/p>\n<p>and that the Revision Petitioner\/accused failed to make the<\/p>\n<p>payment within 15 days of receipt of the statutory notice.       Both<\/p>\n<p>the courts have considered and rejected the defence set up by<\/p>\n<p>the revision petitioner while entering the conviction.      The said<\/p>\n<p>conviction has been recorded after a careful evaluation of the<\/p>\n<p>oral and documentary evidence.         I do     not find any error,<\/p>\n<p>illegality or impropriety in the conviction so recorded concurrently<\/p>\n<p>by the courts below and the same is hereby confirmed.<\/p>\n<p>       5.       What now survives for consideration is the legality of<\/p>\n<p>the sentence imposed on the revision petitioner.       In the light of<\/p>\n<p>the recent decision of the Supreme Court in             Ettappadan<\/p>\n<p>Ahammedkutty v. E.P. Abdullakoya &#8211; 2008 (1) KLT 851<\/p>\n<p>default sentence cannot be imposed for the enforcement of an<\/p>\n<p>order for compensation under Sec. 357 (3) Cr.P.C.              I am,<\/p>\n<p>therefore, inclined to modify the sentence to one of fine only.<\/p>\n<p>Accordingly, for the conviction under Section 138 of the Act the<\/p>\n<p>revision petitioner is sentenced to pay a fine of Rs.42,000\/-<\/p>\n<p>(Rupees forty two thousand only).            The said fine shall be<\/p>\n<p><span class=\"hidden_text\">Crl.R..P. No. 599\/2009             -:3:-<\/span><\/p>\n<p>paid as compensation under Section 357 (1) Cr.P.C.           The<\/p>\n<p>revision petitioner is permitted either to deposit the said fine<\/p>\n<p>amount before the Court below or directly pay the compensation<\/p>\n<p>to the complainant within four months from today and produce<\/p>\n<p>a memo to that effect before the trial Court in case of direct<\/p>\n<p>payment. If he fails to deposit or pay the said amount within<\/p>\n<p>the aforementioned period he shall suffer simple imprisonment<\/p>\n<p>for three months by way of default sentence.<\/p>\n<p>       In the result, this Revision is disposed of confirming the<\/p>\n<p>conviction entered but modifying the sentence imposed on the<\/p>\n<p>revision petitioner.\n<\/p>\n<p>       Dated this the 16th day of February, 2009.\n<\/p>\n<\/p>\n<p>                                          V.
