Basheer, J.\n             ------------------------------------------\n                 W.P.(C) No.24194 of 2009\n             ------------------------------------------\n         Dated this the 19th   day of November, 2009\n\n                          JUDGMENT\n<\/pre>\n<p>S.R.Bannurmath, C.J.\n<\/p>\n<p>          This public interest litigation is filed by the State<\/p>\n<p>Human Rights Protection Centre alleging non compliance of<\/p>\n<p>safety measures by the mine owners and quarry owners and<\/p>\n<p>the Government in abandoning the mines and quarries by<\/p>\n<p>making them dangerous to the general public and as such a<\/p>\n<p>direction is sought from this Court to be issued to the<\/p>\n<p>respondents to identify the abandoned mines and quarries in<\/p>\n<p>the State and to maintain safety protocols in the area.<\/p>\n<p>          2. After issuance of notice, the Joint Secretary to<\/p>\n<p>Government, Industries Department who is conversant with<\/p>\n<p>the facts has filed a counter affidavit, inter alia, contending<\/p>\n<p>that prima facie there are no acts of negligence on the part of<\/p>\n<p>the respondents in relation to maintaining        safety measures<\/p>\n<p>in the mines and quarries and proper care and caution is being<\/p>\n<p>taken. However, so far as the abandoned mines and quarries<\/p>\n<p>are concerned, noting the fact that there is irregularity in not<\/p>\n<p>taking safety measures by proper filling, the mineral<\/p>\n<p>W.P.(C) No.24194 of 2009\n<\/p>\n<p>                                &#8211; 2 &#8211;\n<\/p>\n<p>concessions are        being granted   only  after  ensuring the<\/p>\n<p>reclamation\/fencing of the pits and       necessary measures as<\/p>\n<p>required under Rule 23(5) of the Kerala Minor Mineral Concession<\/p>\n<p>Rules, 1967 and imposition of a condition on the lessee not to<\/p>\n<p>abandon a mine or part thereof unless final mine closure plan is<\/p>\n<p>approved by the authorities concerned are being implemented<\/p>\n<p>strictly.    It is also ensured that apart from such undertaking,<\/p>\n<p>financial assurance in the form of bank guarantee at the rate<\/p>\n<p>fixed by the Public Works Department is also being collected and<\/p>\n<p>every step to safeguard the public from the abandoned mines<\/p>\n<p>and quarries is being undertaken.\n<\/p>\n<p>            3.    Noting the steps taken by the respondents in<\/p>\n<p>safeguarding the public from the abandoned mines and quarries,<\/p>\n<p>in our view, satisfactory action is being taken and as such we no<\/p>\n<p>longer keep the matter pending on the file of this Court.<\/p>\n<p>However, we direct the concerned officials to strictly implement<\/p>\n<p>the policy decision as well as follow the Rules and even make it<\/p>\n<p>compulsory for mine owners and quarry owners to ensure safety<\/p>\n<p>measures while abandoning mines and quarries or portion<\/p>\n<p>thereof and unless such compliance is there, the mine owner or<\/p>\n<p>W.P.(C) No.24194 of 2009\n<\/p>\n<p>                             &#8211; 3 &#8211;\n<\/p>\n<p>quarry owner should not be let off loosely. It is also directed<\/p>\n<p>that the Government shall take all necessary steps to make the<\/p>\n<p>already abandoned mines and quarries safe and take all<\/p>\n<p>precautionary measures to avert further danger to the public.<\/p>\n<p>            With these observations the writ petition stands<\/p>\n<p>disposed of.\n<\/p>\n<\/p>\n<p>                                    S.R.Bannurmath,<br \/>\n                                      Chief Justice<\/p>\n<p>                                     A.K.
