L.B.DABHI, APP for Respondent(s) :\n1, \nNone for Respondent(s) :\n2, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t\t \n\n \n\n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 26\/11\/2010 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>RULE.\n<\/p>\n<p>Mr.\n<\/p>\n<p>\tL.B.Dabhi, learned APP appears and waives service of notice of Rule<br \/>\n\ton behalf of the Respondent &#8211; State of Gujarat.\n<\/p>\n<p>Having<br \/>\n\tregard to the facts of the case, the application is taken up for<br \/>\n\thearing today.\n<\/p>\n<p>By<br \/>\n\tfiling instant application, the applicant &#8211; convict prisoner,<br \/>\n\twho, vide judgment and order dated 9.3.2005 rendered in Sessions<br \/>\n\tCase No.172 of 2004 by the learned Additional Sessions Judge,<br \/>\n\tMehsana, has been convicted for the offence punishable under Section<br \/>\n\t302 etc. of the Indian Penal Code and sentenced to imprisonment for<br \/>\n\tlife, has filed this application through jail authority, praying to<br \/>\n\tenlarge him on temporary bail for a period of 20 days to enable him<br \/>\n\tto find out suitable match for his elder son who is of marriageable<br \/>\n\tage.\n<\/p>\n<p>We<br \/>\n\thave considered the submissions advanced by  Mr.L.B.Dabhi, learned<br \/>\n\tAPP for the Respondent &#8211; State of Gujarat and perused the<br \/>\n\taverments made in the application and the supporting documents that<br \/>\n\tform part of the application.  We have also gone through the jail<br \/>\n\tremark sheet submitted by the learned APP.\n<\/p>\n<p>Upon<br \/>\n\tperusal of the jail remark sheet, we have noticed that the applicant<br \/>\n\thas undergone total period of more than 6 years of imprisonment and<br \/>\n\tduring the said period he has enjoyed temporary bail on three<br \/>\n\toccasions and has also enjoyed Furlough Leave on three occasions and<br \/>\n\ton all the occasions the Applicant &#8211; convict has surrendered<br \/>\n\tin time.  There is no jail punishment and the conduct of the<br \/>\n\tApplicant &#8211; convict in the jail is also good.  Besides this,<br \/>\n\tthe ground stated by the Applicant &#8211; convict prisoner seeking<br \/>\n\this release on temporary bail appears to be genuine.\n<\/p>\n<p>In<br \/>\n\tview of this, we deem it expedient to consider the plea of the<br \/>\n\tApplicant to release him on temporary bail for a period of 15 days<br \/>\n\tfrom the date of his actual release.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the Application succeed in part and and is<br \/>\n\taccordingly partly allowed.  The Applicant &#8211; Convict &#8211;<br \/>\n\tABDULBHAI<br \/>\n\tSAMRATBHAI SIPAI is ordered to be released on<br \/>\n\ttemporary bail for a period of 15 days from the date of his actual<br \/>\n\trelease on executing a personal bond of Rs.5,000\/- before the jail<br \/>\n\tauthority on usual terms and conditions. The applicant shall<br \/>\n\tsurrender to the jail authority on completion of 15 days from the<br \/>\n\tdate of his release without fail.  During the period of temporary<br \/>\n\tbail, the applicant shall not abuse the liberty granted to him and<br \/>\n\tshall maintain law and order.
