By this petition, the petitioner seeks for a writ in<\/p>\n<p>          the nature of mandamus\/direction to the respondents to scale<\/p>\n<p>          the answer sheets of the petitioner and declare the result<\/p>\n<p>          thereafter. It is further sought that the respondents be<\/p>\n<p>          directed to comply with the provisions of Clause 38 of the<\/p>\n<p>          circular issued by the Chhattisgarh Public Service<\/p>\n<p>          Commission (Annexure P\/5) wherein, it is provided that in<\/p>\n<p>          the State Service Preliminary Examination, 2005 and Main<\/p>\n<p>          Examination 2005, valuation of optional subjects scaling<\/p>\n<p>          system would be made applicable and the marks would be<\/p>\n<p>          awarded on scale.\n<\/p>\n<p>2.   The facts in nutshell are that the petitioner,<br \/>\nalongwith others, applied for appointment in State Services.<br \/>\nThe petitioner appeared in the preliminary examination<br \/>\nconducted by Chhattisgarh Public Service Commission, (for<br \/>\nshort, C.G.P.S.C.) held on 6.11.2005 and on the basis of<br \/>\nresult of the preliminary examination, the petitioner<br \/>\nappeared in the main examination held from 15.06.2006 to<br \/>\n27.7.2006 and 30.06.2006. The result was declared on<br \/>\n31.01.2007.  The petitioner was unsuccessful in the main<br \/>\nexamination. The petitioner has filed this petition<br \/>\nchallenging the result of the main examination declared on<br \/>\n25.01.2007 on the ground that scaling system has not been<br \/>\ndone, as according to the newspaper report, the scaling was<br \/>\nnot possible within a period of two days. The Chairman,<br \/>\nC.G.P.S.C., in his interview, has declared that the result<br \/>\nwas declared after applying scaling system. Learned counsel<br \/>\nappearing for the petitioner submits that on 25.01.2007, it<br \/>\nwas reported in the news paper that the result could not be<br \/>\ndeclared on account of non-completion of scaling work and<br \/>\nthereafter, the result was declared on 31.01.2007 after<br \/>\nscaling. According to him, this is practically impossible to<br \/>\ncomplete scaling within such a short period as there were<br \/>\n9736 answer sheets. The interview is to be held in the month<br \/>\nof March 2007.\n<\/p>\n<p>3.   It appears that the entire petition is based on certain<br \/>\nnews paper reports which have no basis to support the<br \/>\ncontention of the petitioner that the scaling of the answer<br \/>\nsheets was not possible within such a short period. Learned<br \/>\ncounsel appearing for the petitioner has not pointed out<br \/>\nasto how many experts in scaling works were involved, how<br \/>\nmany answer sheets were scaled in one hour and how much work<br \/>\nthey have performed. In absence of the above materials, it<br \/>\nis not possible to issue a writ in the nature of mandamus as<br \/>\nsought for by this petition in this sketchy petition without<br \/>\nhaving relevant and sufficient materials.\n<\/p>\n<p>4.   The petitioner has obtained the marksheet of the main<br \/>\nexamination under the provisions of Right to Information<br \/>\nAct. The marksheet itself indicates that the scaling was<br \/>\ndone and the marks were allotted on scale. It is well<br \/>\nsettled that a candidate on finding himself as unsuccessful<br \/>\nin the examination, cannot raise the dispute with regard to<br \/>\nthe procedure adopted in the examination.\n<\/p>\n<p>5.   In the case of Chandra Prakash Tiwari &amp; Others Vs.<br \/>\nShakuntala Shukla &amp; Others, (2002) 6 S.C.C. 127, the Supreme<br \/>\nCourt held as under:-\n<\/p>\n<blockquote><p>          &#8220;32&#8230;It is a remedy which stands barred and it is<br \/>\n          in  this  perspective  in  <a href=\"\/doc\/1129833\/\">Om  Prakash  Shukla  v.<br \/>\n          Akhilesh Kumar Shukla<\/a> a three-Judge Bench of  this<br \/>\n          Court laid down in no uncertain terms that when  a<br \/>\n          candidate  appears  at  the  examination   without<br \/>\n          protest   and  subsequently  found   to   be   not<br \/>\n          successful   in  the  examination,   question   of<br \/>\n          entertaining  a  petition  challenging  the   said<br \/>\n          examination would not arise.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>          &#8220;33.    Subsequently, the decision in  Om  Prakash<br \/>\n          stands followed by a later decision of this  Court<br \/>\n          in  Madan  Lal v. State of J&amp;K wherein this  Court<br \/>\n          stated as below: (SCC p. 493, paras 9-10)<\/p>\n<p>          &#8220;9.  Before dealing with this contention, we  must<br \/>\n          keep in view the salient fact that the petitioners<br \/>\n          as  well  as  the contesting successful candidates<br \/>\n          being respondents concerned herein, were all found<br \/>\n          eligible  in  the light of marks obtained  in  the<br \/>\n          written test, to be eligible to be called for oral<br \/>\n          interview.  Up to this stage there is  no  dispute<br \/>\n          between  the parties. The petitioner also appeared<br \/>\n          at  the  oral  interview conducted by the  members<br \/>\n          concerned  of  the Commission who interviewed  the<br \/>\n          petitioners  as well as the contesting respondents<br \/>\n          concerned. Thus the petitioners took a  chance  to<br \/>\n          get   themselves  selected  at   the   said   oral<br \/>\n          interview.   Only  because  they  did   not   find<br \/>\n          themselves to have emerged successful as a  result<br \/>\n          of their combined performance both at written test<br \/>\n          and oral interview, they have filed this petition.<br \/>\n          It is now well settled that if a candidate takes a<br \/>\n          calculated  chance and appears at  the  interview,<br \/>\n          then, only because the result of the interview  is<br \/>\n          not  palatable  to him, he cannot turn  round  and<br \/>\n          subsequently contend that the process of interview<br \/>\n          was  unfair  or  the Selection Committee  was  not<br \/>\n          properly  constituted. In the case of  <a href=\"\/doc\/1129833\/\">Om  Prakash<br \/>\n          Shukla  v.  Akhilesh  Kumar  Shukla<\/a>  it  has  been<br \/>\n          clearly  laid  down by a Bench  of  three  learned<br \/>\n          Judges  of  this  Court that when  the  petitioner<br \/>\n          appeared  at  the examination without protest  and<br \/>\n          when  he  found  that  he  would  not  succeed  in<br \/>\n          examination  he  filed a petition challenging  the<br \/>\n          said  examination, the High Court should not  have<br \/>\n          granted any relief to such a petitioner.&#8221;\n<\/p><\/blockquote>\n<blockquote><p>     6.   In view of the dicta laid down by the Supreme Court,<\/p>\n<p>          this petition is not entertainable as the petitioner has<\/p>\n<p>          appeared in the examination and he having failed in the main<\/p>\n<p>          examination, questions the non-application of scaling system<\/p>\n<p>          which is evident from the fact that declaration of result<\/p>\n<p>          was delayed as admitted by the Chairman, C.G.P.S.C. on<\/p>\n<p>          account of time consumed in the process of scaling of the<\/p>\n<p>          answer-sheets. The marksheet obtained by the petitioner<\/p>\n<p>          under the Right to Information Act clearly indicates<\/p>\n<p>          application of scaling system.\n<\/p><\/blockquote>\n<p>7.   In view of foregoing and for the reasons stated<br \/>\nhereinabove this petition is dismissed, summarily.
