DAVE\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE J.B.PARDIWALA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n:20\/09\/2011 \n\n \n\n \n \nCAV\nJUDGMENT \n<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE J.B.PARDIWALA)<\/p>\n<p>\tIn<br \/>\nthis appeal the appellant &#8211; original petitioner seeks to challenge<br \/>\njudgment and order passed by the learned Single Judge dated 22.4.2011<br \/>\nin SCA No. 11391 of 2010, whereby the learned Single Judge rejected<br \/>\nthe petition confirming order passed by Second Additional Senior<br \/>\nCivil Judge and Judicial Magistrate First Class, Bhavnagar, dated<br \/>\n3.8.2010 below Exh.60 in HMP No. 80 of 2005.\n<\/p>\n<p>2.\tIt<br \/>\nis evident that the challenge before the learned Single Judge was to<br \/>\nthe order passed by a Civil Court in a Hindu Marriage Petition.<br \/>\nLearned Single Judge, in exercise of his jurisdiction under Article<br \/>\n227 of the Constitution, refused to grant any relief and rejected the<br \/>\npetition.  This being the position, present appeal would not be<br \/>\nmaintainable under Clause 15 of the Letters Patent.\n<\/p>\n<p>3.\tWe<br \/>\nmay state that this issue as regards maintainability of appeal in the<br \/>\norders of the present nature is no longer res-integra.  In the case<br \/>\nof Gustadji<br \/>\nD. Buhariwala Vs. Nevil B. Buhariwala, reported in 2011 (2) GLH 147,<br \/>\nthe Division Bench of this High Court in paragraphs 56 and 57 have<br \/>\nsummarised its findings as under:-\n<\/p>\n<p>&#8220;56.\tThe<br \/>\n\tsum and substance of our discussion and findings \trecorded in<br \/>\n\tthe Judgment can be now summarized as \tunder:\n<\/p>\n<p>(1)\tWhen<br \/>\nthe Parliament has thought fit to restrict powers under Sec.115 of<br \/>\nthe Code with a definite object, then, under such circumstances an<br \/>\norder which is not revisable under Sec. 115 of the Code cannot be<br \/>\nchallenged by way of filing writ petition under Article-226 of the<br \/>\nConstitution invoking the extra-ordinary jurisdiction of the High<br \/>\ncourts and that too an interlocutory order passed by Civil Courts in<br \/>\na regular suit proceeding.\n<\/p>\n<p>(2)\tWhen<br \/>\nremedy for filing the Revision under Sec. 115 of the Civil Procedure<br \/>\nCode has been expressly barred then in such case the petition under<br \/>\nArticle 227 of the Constitution would lie and not a writ petition<br \/>\nunder Article 226 of the Constitution of India.  If a petition under<br \/>\nArticle-227 of the Constitution would lie and if the same has been<br \/>\ndismissed, then, no appeal under Clause-15 of the Letters Patent<br \/>\nwould be maintainable.  A petition under Article-227 is not a writ<br \/>\npetition.  No Writ can be issued under Article-227.\n<\/p>\n<p>(3)\tWhere<br \/>\nthe statute bans exercise of revisional powers it would require very<br \/>\nexceptional circumstances to warrant interference under Article-227<br \/>\nof the Constitution of India since power of superintendence was not<br \/>\nmade to circumvent statutory law.  Jurisdiction under Article-227<br \/>\ncannot be exercised as a cloak of appeal in disguise.\n<\/p>\n<p>(4)\tThere<br \/>\ncannot be any distinction with regard to a proceeding under<br \/>\nArticle-226\/227 and Sec. 115 of the C.P.C. when it relates to a<br \/>\nproceeding arising out of an order of the Civil courts passed in suit<br \/>\nproceeding.\n<\/p>\n<p>(5)\tWhere<br \/>\nlaw provides the provision of Appeal and the same is decided by the<br \/>\njudicial authority or where there is a scope for judicial scrutiny by<br \/>\nthe subordinate at the top, the petition challenging such order would<br \/>\nbe covered under Article-227 of the Constitution.\n<\/p>\n<p>(6)\tWhere<br \/>\na petition is filed, both under Articles-226 and 227 of the<br \/>\nConstitution, it will have to be considered whether the point raised<br \/>\nin the petition arose for adjudication for the first time before the<br \/>\nHigh court.  If the challenge in the petition is with respect to the<br \/>\npoint already adjudicated upon by the subordinate court, then, it<br \/>\nwill have to be held that the supervisory jurisdiction of the High<br \/>\ncourt was invoked and not the original.\n<\/p>\n<p>(7)\tThe<br \/>\ncause title, averments and the prayers in the petition can be taken<br \/>\ninto account while deciding whether the petition is one under<br \/>\nArticle-226 and 227 of the Constitution.  This has to be determined<br \/>\non the facts of each case having regard to &#8211;\n<\/p>\n<p>\ti)\tnature<br \/>\nand the jurisdiction invoked;\n<\/p>\n<p>\tii)\tthe<br \/>\naverments contained in the petition;\n<\/p>\n<p>\tiii)\tthe<br \/>\nreliefs sought;  and<\/p>\n<p>iv)\tmost<br \/>\nimportantly, the true nature of the principal order passed by the<br \/>\nlearned Single Judge.  The true nature of the order passed by the<br \/>\nlearned Single Judge has to be determined on the basis of true<br \/>\ncharacter of the relief granted.  By merely labeling the petition<br \/>\nunder Article-226 and by praying for Writ of Certiorari it cannot be<br \/>\nsaid that the facts justify the party to invoke the extraordinary<br \/>\njurisdiction of the High court under Article-226 of the Constitution<br \/>\nof India.\n<\/p>\n<p>(8)\tAs<br \/>\nheld by the Supreme Court in the case of Radhe Shyam V\/s. Chhabi Nath<br \/>\nreported in (2009) 5 SCC -616, orders and proceeding of the Judicial<br \/>\nCourts subordinate to the High Court are not amenable to the writ<br \/>\njurisdiction of the High Court under Article-226 of the Constitution,<br \/>\nmore particularly, when the orders are passed in Suit proceeding in a<br \/>\ncontest between two private parties.\n<\/p>\n<p>(9)\tWrit<br \/>\nPetition is a remedy in public law which may be filed by any person<br \/>\nbut the main respondent should be either Government, Governmental<br \/>\nagency or a State or instrumentalities of the State within the<br \/>\nmeaning of Article-12.  Private individuals cannot be equated with<br \/>\nState or instrumentality of the State.  All the respondents in a writ<br \/>\npetition cannot be private parties.  High Court can issue Writ to any<br \/>\nperson, but the person against whom writ will be issued must have<br \/>\nsome statutory or public duty to perform.\n<\/p>\n<p>(10)\tIn<br \/>\na petition for relief under Article-226 of the Constitution, the<br \/>\nCourt\/Tribunal whose order is impugned in the petition must be made a<br \/>\nparty to the petition so that the writ sought from the Court can go<br \/>\nagainst the Court\/Tribunals, but if the petition is for relief under<br \/>\nArticle-227 of the Constitution, it is well settled that the<br \/>\nCourts\/Tribunals whose order impugned in a petition, need not be a<br \/>\nparty in the writ petition.  By entertaining the petition under<br \/>\nArticle-227 of the Constitution, the High Court exercise  its power<br \/>\nof superintendence, which is analogous to the revisional<br \/>\njurisdiction.\n<\/p>\n<p>57.\tHaving<br \/>\nconsidered the entire issue threadbare and also having considered the<br \/>\nposition of law, we hold that the appeal is not maintainable under<br \/>\nClause 15 of the Letters Patent and on the ground of maintainability<br \/>\nthe appeal fails and deserves to be dismissed.  The appeal is<br \/>\naccordingly dismissed with no order as to costs.&#8221;\n<\/p>\n<p>4.\tIn<br \/>\nthis view of the matter, we hold that the present appeal is not<br \/>\nmaintainable and the same is hereby dismissed with no order as to<br \/>\ncosts.\n<\/p>\n<p>\t\t\t\t\t\t(A.L.\n<\/p>\n<p>Dave, Actg.
