SANKARAN, J.\n                      ---------------------------\n                      B.A. No. 748 of 2010\n                  ------------------------------------\n              Dated this the 22nd day of March, 2010\n\n\n                             O R D E R\n<\/pre>\n<p>      This is an application for anticipatory bail under Section 438<\/p>\n<p>of the Code of Criminal Procedure. The petitioner is accused No.2<\/p>\n<p>in Crime No.685\/2009 of Alappuzha North Police Station.<\/p>\n<p>      2.    The offences alleged against the petitioner are under<\/p>\n<p>Sections 323, 324, 326 and 308 read with Section 34 of the<\/p>\n<p>Indian Penal Code.\n<\/p>\n<p>      3.    The prosecution case is that on 25.11.2009 at about<\/p>\n<p>7.50 P.M., the accused persons assaulted the de facto<\/p>\n<p>complainant. Accused No.1 attacked the de facto complainant<\/p>\n<p>with a sword stick, which resulted in serious injuries on the de<\/p>\n<p>facto complainant. The allegation against accused No.2 is that he<\/p>\n<p>kicked the de facto complainant. The grievous hurt caused to the<\/p>\n<p>de facto complainant is not attributable to the overt act done by<\/p>\n<p>the petitioner.\n<\/p>\n<p>      4. In the facts and circumstances of the case, I am of the<\/p>\n<p>view that anticipatory bail can be granted to the petitioner as<\/p>\n<p><span class=\"hidden_text\">B.A. No. 748 of 2010              2<\/span><\/p>\n<p>none of the serious injuries caused to the de facto complainant is<\/p>\n<p>attributable to the overt acts done by the petitioner.<\/p>\n<p>         There will be a direction that in the event of the arrest of<\/p>\n<p>the petitioner, the officer in charge of the police station shall<\/p>\n<p>release him on bail on his executing bond for Rs.15,000\/- with<\/p>\n<p>two solvent sureties for the like amount to the satisfaction of the<\/p>\n<p>officer concerned, subject to the following conditions:<\/p>\n<blockquote><p>         A) The petitioner shall         report    before      the<br \/>\n             investigating officer between 9 A.M and 11 A.M.<br \/>\n             on alternate Mondays, till the final report is filed<br \/>\n             or until further orders;\n<\/p><\/blockquote>\n<blockquote><p>         B) The     petitioner    shall   appear     before    the<br \/>\n             investigating officer for interrogation as and when<br \/>\n             required;\n<\/p><\/blockquote>\n<blockquote><p>         C) The petitioner shall not try to influence the<br \/>\n             prosecution    witnesses    or   tamper   with    the<br \/>\n             evidence.\n<\/p><\/blockquote>\n<blockquote><p>         D) The petitioner shall not commit any offence or<br \/>\n             indulge in any prejudicial activity while on bail.\n<\/p><\/blockquote>\n<blockquote><p>         E) In case of breach of any of the conditions<br \/>\n             mentioned above, the bail shall be liable to be<br \/>\n             cancelled.<\/p><\/blockquote>\n<p>        The Bail Application is allowed to the extent indicated<\/p>\n<p> above.\n<\/p>\n<\/p>\n<p>                                    K.T.
