DABHI, APP, for Respondent(s) : 1, \nNone\nfor Respondent(s) :\n2, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE A.M.KAPADIA\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nand\n\t\t\n\t\n\t \n\t\t \n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE BANKIM.N.MEHTA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/02\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>(Per<br \/>\n: HONOURABLE MR.JUSTICE A.M.KAPADIA)<\/p>\n<p>1.\t\tRule.\n<\/p>\n<p>Mr. Dabhi, learned APP, appears and waives service of rule on behalf<br \/>\nof the respondent State of Gujarat.\n<\/p>\n<p>2.\t\tHaving<br \/>\nregard to the facts of the case, the application is taken up for<br \/>\nhearing today.\n<\/p>\n<p>3.\t\tThe<br \/>\napplicant-convict who, by judgement and order dated 14.6.2007<br \/>\nrendered in Sessions Case No.  138 of 2004 by learned Additional City<br \/>\nSessions Judge, Fast Track Court No. 8, Vadodara, has been convicted<br \/>\nfor the offences punishable under Section 395 etc. of the Indian<br \/>\nPenal Code and sentenced to suffer rigorous imprisonment for 10<br \/>\nyears, has filed this application through jail authority praying for<br \/>\nsuspension of sentence and to release him on regular bail during the<br \/>\npendency and final hearing of the above numebred Criminal Appeal.<br \/>\nAlternative, he has also prayed that hearing of the above numbered<br \/>\nCriminal Appeal may be expedited  as the appeals filed by four<br \/>\nco-accused have been decided on 24.8.2009.\n<\/p>\n<p>4.\t\tHaving<br \/>\nconsidered the submissions advanced by Mr. Dabhi, learned APP for the<br \/>\nrespondent State of Gujarat and upon perusal of the averments made in<br \/>\nthe application so also jail remark sheet and copy of the farad of<br \/>\nthe judgement and order of this Court dated 24.8.2009 rendered in<br \/>\nCriminal Appeal No. 956 of 2007 with Criminal Appeal No. 965 of 2007<br \/>\nwith Criminal Appeal No. 1190 of 2007 with Criminal Appeal No. 1214<br \/>\nof 2007, according to us, no ground is made out for suspension of<br \/>\nsentence and to release him on regular bail. However, it is seen that<br \/>\napplicant is original accused No. 2 in Sessions Case No. 138 of 2004.<br \/>\nIt can be said from the copy of the farad that four separate Criminal<br \/>\nAppeals filed by the co-accused have been decided by the co-ordinate<br \/>\nBench of this  Court vide judgement and order dated 24.8.2009.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of the above, since separate four Criminal Appeals filed by the<br \/>\nco-accused have been decided by a co-ordinate Bench of this Court,<br \/>\nthis appeal is also required to be decided as early as possible.\n<\/p>\n<p>6.\t\tFor<br \/>\nthe foregoing reasons, the prayer for suspension of sentence and to<br \/>\nrelease the applicant on bail is rejected. However, the prayer for<br \/>\nearly hearing of the appeal is granted.  Accordingly, the Registry is<br \/>\ndirected to notify the above numbered Criminal Appeal on final<br \/>\nhearing board in the third week of March, 2011 by showing it on a<br \/>\nseparate board.\n<\/p>\n<p>7.\t\tRule<br \/>\nis made absolute to the aforesaid extent.\n<\/p>\n<p>\t\t\t\t\t\t\t(A.M.\n<\/p>\n<p>KAPADIA, J)<\/p>\n<p>   (BANKIM N.
