The matter is also pertains to one issue only i.e.<br \/>\nregarding recruitment to the post of TPO in the Vlishakapatnam Port Trust (VPT)<br \/>\nvide Employment Notice No. 5\/99 dated 8.12.1999. Therefore the Commission<br \/>\nhas decided to club all the 5 appeals and pass a single order.\n<\/p>\n<p>      The Appellant through the aforementioned RTI applications had sought a<br \/>\ncopy of the mark sheet of candidates who appeared in the examination, including<br \/>\nquestion paper and answer papers and copy of mark sheets of candidates,<br \/>\ncopy of the mark sheets of the selected candidates for interview, copies of<br \/>\nnotings pertaining to issue of appointment letters, a copy of the            selection<br \/>\ncommittee proceedings and recommendations of the selection committee,<br \/>\ncorrespondence between IIFT which conducted the examination and VPT and<br \/>\ndocuments regarding the vigilance enquiry conducted into the matter.\n<\/p>\n<p>        During the hearing the Respondent submit that the appellant has filed a<br \/>\nlarge number of RTI application on this very issue and from time to time the<br \/>\nRespondent have provided him information through various letters. In brief, the<br \/>\nposition is as follows:-\n<\/p>\n<p>       Copy of mark-sheets of 14 candidates selected for interview in the<br \/>\nunreserved category as well as for the 5 OBC candidates selected for interview<br \/>\nand marks obtained by these candidates in the written test, viva-voce and<br \/>\npsychology test are available and have been provided to the Appellant.\n<\/p>\n<p>       Copies of correspondence between IIFT who conducted the examination<br \/>\nand Vishakapatnam Port Trust have been provided.\n<\/p>\n<p>       Copies of file notings for processing the selection of committee members<br \/>\nhave been provided.\n<\/p>\n<p>       Copies of note sheets from 1.12.1999 to 1.3.2001 regarding selection and<br \/>\nissue of appointment orders of candidates have been provided.\n<\/p>\n<p>       Copies of offer letters\/appointment letters to the 3 unreserved candidates<br \/>\nand 1 OBC candidate have been provided.\n<\/p>\n<p>       Copies of selection committee proceedings for unreserved and OBC<br \/>\ncandidates have been provided.\n<\/p>\n<p>       A total number of 948 candidates appeared for the written test and except<br \/>\nfor the 14 unreserved candidates and 5 OBC candidates who were called for<br \/>\ninterview, the answer sheets and question papers of the remaining candidates<br \/>\nare not available with the Respondent and therefore have not been provided.\n<\/p>\n<p>       As per Respondent a vigilance inquiry has been conducted in respect of<br \/>\nthese missing documents.\n<\/p>\n<p>       The PIO has not been able to provide the recommendations of selection<br \/>\ncommittee members for each candidate who appeared for interview as there is<br \/>\nno such practice since marks are given by the committee and not by individual<br \/>\ncommittee member.\n<\/p>\n<p>      The Respondent have also not provided the Appellant with the copy of<br \/>\nvigilance enquiry which was conducted by the Vigilance Department into the<br \/>\nquestion of missing papers and marks of all candidates other than 14 unreserved<br \/>\ncandidates and 5 OBC candidates selected for interview.\n<\/p>\n<p>      After hearing the contention and on perusal of relevant documents on file,<br \/>\nthe Commission finds that the marks and answer papers of candidates (other<br \/>\nthan 14 unreserved candidates and 5 OBC candidates selected for interview)<br \/>\nhave not been provided to the Appellant on the grounds that they are not<br \/>\navailable either with the IIFT or with the Visakhapatnam Port Trust.                              The<br \/>\nAppellant has also not been provided with vigilance enquiry report . Remaining<br \/>\ninformation requested by the Appellant has been provided to the Appellant<br \/>\nthrough different letters in response to his various RTI applications. Mr. Veenu<br \/>\nGopal who represented the respondent during hearing informed the Commission<br \/>\nthat while the vigilance enquiry is now complete, he does not have requisite<br \/>\ninformation whether final decision has been taken on the vigilance enquiry report<br \/>\nor not.
