And Others\nPetitioner Counsel :- Dr. Neel Kamal\nRespondent Counsel :- C.S.C.,Anurag Khanna,Ritvik Upadhyay\n\nHon'ble Arun Tandon,J.\n<\/pre>\n<p>The petitioners, who had submitted applications for registration for<br \/>\nthe Ph.D Course in the Chaudhary Charan Singh University,<br \/>\nMeerut (hereinafter referred to as the &#8216;University&#8217;) and had been<br \/>\nregistered in August, 2009, on the basis of the meeting of the<br \/>\nResearch Degree Committee held after 11th July, 2009 have filed<br \/>\nthis petition for setting aside the advertisement issued by the<br \/>\nUniversity which requires that such candidates who were<br \/>\nregistered for Ph. D. Course as per the Research Degree<br \/>\nCommittee meeting held on 11th July, 2009, shall have to qualify<br \/>\nthe Research Eligibility Test for their registration to Ph.D. Degree<br \/>\nto be held on 11th April, 2010.\n<\/p>\n<p>It is stated in the writ petition that in accordance with the<br \/>\nOrdinances framed by the University, the petitioners had submitted<br \/>\nthe application forms for registration and the Research Degree<br \/>\nCommittee which met after 11th July, 2009 registered the<br \/>\npetitioners but now the University has issued the advertisement in<br \/>\nview of the UGC (Minimum Standards and Procedure For Awards<br \/>\nof M.Phil\/PH.D Degree), Regulation, 2009 (hereinafter referred to<br \/>\nas the &#8216;Regulations&#8217;) issued by the University Grants Commission<br \/>\nunder Section 26 of the University Grants Commission, Act 1956.<br \/>\nThese Regulations came into effect from the date of publication in<br \/>\nthe Gazette of India i.e. 11th July, 2009.\n<\/p>\n<p>It appears that since the registration of the petitioners was not done<br \/>\nin accordance with the aforesaid Regulations, the University issued<br \/>\nthe advertisement stating that all those candidates whose Research<br \/>\nDegree Committee was held after 11th July, 2009 shall have to<br \/>\nqualify the Research Eligibility Test for their registration. to Ph.D<br \/>\nDegree.\n<\/p>\n<p>Learned counsel for the petitioners submitted that as the petitioners<br \/>\nhad been registered in accordance with the Ordinances of the<br \/>\nUniversity which have not been amended till date, and as the<br \/>\npetitioners have worked for more than 6 months and have<br \/>\nsubmitted their six months progress report in accordance with the<br \/>\n provisions of the Ordinances, the University is not justified in<br \/>\ninsisting that they should also appear at the Research Eligibility<br \/>\nTest.\n<\/p>\n<p>Sri Anurag Khanna, learned counsel appearing for the respondent-<br \/>\nUniversity submits that the Regulations clearly provide certain<br \/>\nbenefits to the students who are registered in accordance with the<br \/>\nprovisions of the Regulations and if the petitioners continue with<br \/>\nthe Research without appearing at the test which is being held in<br \/>\naccordance with the provisions of the Regulations, the said<br \/>\nbenefits will not accrue to them. He, therefore, submits that it is for<br \/>\nthe petitioners to take a decision whether they wish to continue<br \/>\nwith their Research without appearing at the Entrance Test. He,<br \/>\nhowever, is not in a position to state whether the University has<br \/>\namended the Ordinances or not.\n<\/p>\n<p>Sri Ritvik Upadhyaya, learned counsel appearing for the<br \/>\nUniversity Grants Commission states that some more time may be<br \/>\ngranted to the University Grants Commission to file the counter<br \/>\naffidavit. He has, however, submitted that the aforesaid<br \/>\nRegulations of the University Grants Commission are binding on<br \/>\nthe University and in this connection has placed reliance upon the<br \/>\ndecision of the Supreme Court in Annamalai University,<br \/>\nrepresented by the Registrar Vs. Secretary to Government,<br \/>\nInformation and Tourism Department &amp; Ors., reported in 2009 (4)<br \/>\nSCC 590.\n<\/p>\n<p>It is necessary to get the version of the University Grants<br \/>\nCommission before the matter is finally heard, but the University<br \/>\nGrants Commission has not filed its counter affidavit.\n<\/p>\n<p>The interim protection, which the petitioners have prayed for at<br \/>\nthis stage is that they may not be restrained by the University from<br \/>\ncontinuing with their research work. As stated by Sri Anurag<br \/>\nKhanna, learned Standing Counsel for the University, it is for the<br \/>\npetitioners to decide whether they desire to appear to at the test to<br \/>\nbe held by the University pursuant to the Regulations framed by<br \/>\nthe University Grants Commission. In such circumstances, the<br \/>\nUniversity shall not restrain the petitioners from continuing with<br \/>\ntheir Research work merely because they have not appeared at the<br \/>\nEntrance Test or after appearing at the test have not been able to<br \/>\nclear it. This order shall be subject to the decision of the writ<br \/>\npetition and shall not confer any right upon the petitioners.\n<\/p>\n<p>Counter affidavit by the University Grants Commission may be<br \/>\nfiled within two weeks.
