Bhat, Advocate.   \n\nHonble Mr. Justice J.P.Singh, Judge.\nDate: 30.12.2010 \n:J U D G M E N T :\n<\/pre>\n<p>The petitioners-Mansha Begum and Phultaj were recommended<br \/>\nfor engagement as Rehbar-e-Taleem in the Upgraded Primary School,<br \/>\nMorian by the Village Level Education Committee.<br \/>\nThe Panel prepared by the Committee was later substituted by<br \/>\nanother Panel of seven persons, which included M\/s Sajda Kosar and<br \/>\nTahira Kosar, respondent Nos. 5 &amp; 6. The petitioners did not, however,<br \/>\nfigure therein.\n<\/p>\n<p>The dispute between the petitioners and respondent Nos.5 &amp; 6 as<br \/>\nto their entitlement to selection and engagement as Rehbar-e-Taleem<br \/>\ncame to be considered by the Deputy Commissioner, Rajouri, who<br \/>\nopined that the candidates of hamlet Morian of Village Galuthi would<br \/>\nalso be eligible for engagement along with the residents of that part of<br \/>\nhamlet Morian which was situated in Village Bhathian.<br \/>\nAggrieved by the decision of the Deputy Commissioner and<br \/>\nclaiming exclusive right of consideration to engagement as Rehbar-e-<br \/>\nTaleem, to the residents of hamlet Morian falling in Village Bhathian,<br \/>\nM\/s Mansha Begum and Phultaj have approached this Court seeking<br \/>\n<span class=\"hidden_text\">2<\/span><br \/>\nquashing of Deputy Commissioner, Rajouri&#8217;s Communication<br \/>\nNo.HQA\/DCR\/816-18 dated 29.08.2006, besides a direction to the<br \/>\nofficial respondents to consider them for engagement against available<br \/>\nvacancies of Rehbar-e-Taleem in Middle School, Morian Village<br \/>\nBhathian.\n<\/p>\n<p>It is not in dispute between the parties that the petitioners are<br \/>\nresidents of Hamlet Morian falling in Village Bhathian of Tehsil<br \/>\nThanamandi, and respondent Nos. 5 &amp; 6 were residing in hamlet Morian<br \/>\nfalling in Village Galuthi of Tehsil Rajouri. The Affidavit of Deputy<br \/>\nCommissioner, Rajouri, filed pursuant to the directions of the Court,<br \/>\nindicates that Government Middle School, Morian falls in Education<br \/>\nZone Manjakote, Tehsil and District Rajouri and the building of Middle<br \/>\nSchool, Morian, was located in Khasra No.30 (State Land) of village<br \/>\nBhathian in Tehsil Thanamandi of District Rajouri.<br \/>\nThe issue that, therefore, arises for determination in the Writ<br \/>\nPetition is as to whether the petitioners, who are residents of hamlet<br \/>\nMorian of Village Bhathian, alone were entitled to consideration for<br \/>\nengagement as Rehbar-e-Taleem in Middle School, Morian or the<br \/>\nresidents of hamlet Morian falling in Village Galuthi, too were eligible to<br \/>\ncompete.\n<\/p>\n<p>During the pendency of the Writ Petition, respondent Nos. 5 &amp; 6<br \/>\ngot engaged as Rehbar-e-Taleem in Government Primary School,<br \/>\nDharan and Government Middle School, Dharan. They, therefore, have<br \/>\nno interest left in the engagement of Rehbar-e-Taleem in Middle School,<br \/>\nMorian.\n<\/p>\n<p><span class=\"hidden_text\">3<\/span><\/p>\n<p>M\/s Mehmood Ahmed and Naim Kosar have, however, sought<br \/>\ntheir impleadment as party respondents urging that being in the panel,<br \/>\nthey were interested in the issue raised by the petitioners in the Writ<br \/>\nPetition, which, when decided, would affect their right to selection and<br \/>\nengagement as Rehbar-e-Taleem in Middle School, Morian.<br \/>\nHeard learned counsel for the petitioners, the State counsel as<br \/>\nalso the learned counsel appearing for Mehmood Ahmed and Naim<br \/>\nKosar.\n<\/p>\n<p>On facts, it was not disputed by the learned counsel appearing for<br \/>\nMehmood Ahmed and Naim Kosar that they were residents of that part<br \/>\nof hamlet Morian, which falls in Village Galuthi of Tehsil Rajouri and the<br \/>\npetitioners belonged to that part of hamlet Morian, which fell in the<br \/>\njurisdiction of Revenue Village Bhathian of Tehsil Thanamandi.<br \/>\nAs the facts pleaded by the petitioners were not disputed by the<br \/>\nlearned counsel appearing for M\/s Mehmood Ahmed and Naim Kosar,<br \/>\nthey were heard on merits of the petitioners Writ Petition because there<br \/>\nwas no necessity of getting their formal Response thereto.<br \/>\nIn view of the admitted facts, all that is required to be seen is<br \/>\nwhether being residents of a different Revenue Village, i.e, Village<br \/>\nGaluthi, the residents of hamlet Morian falling in Village Galuthi were<br \/>\nalso eligible to compete for available vacancies of Rehbar-e-Taleem in<br \/>\nMiddle School, Morian, falling in Village Bhathian.<br \/>\nTo find the answer to the issue, reference needs to be made to the<br \/>\nRehbar-e-Taleem Scheme launched vide Government Order No.396-<br \/>\nEdu of 2000 dated 28.04.2000 and Government Order Nos. 563-Edu of<br \/>\n<span class=\"hidden_text\">4<\/span><br \/>\n2005 dated 24.08.2005, 394-Edu of 2006 dated 28.07.2006 and 288-<br \/>\nEdu of 2009 dated 08.04.2009.\n<\/p>\n<p>In terms of the Rehbar-e-Taleem Scheme and the Government<br \/>\nOrders, referred to hereinabove, only those belonging to the Village<br \/>\nwhere the School was located are eligible to compete for engagement<br \/>\nas Rehbar-e-Taleem in the School.\n<\/p>\n<p>The Village contemplated by the Scheme has been declared by<br \/>\nthe State Government vide its Order of 24.08.2005 to mean and always<br \/>\ndeemed to have meant a Revenue Village.\n<\/p>\n<p>The School in question where the vacancies of Rehbar-e-Taleem<br \/>\nhave arisen, admittedly falls in hamlet Morian of Village Bhathian of<br \/>\nTehsil Thanamandi. Thus, according to the Scheme and the<br \/>\nGovernment orders on the subject, only the residents of Village<br \/>\nBhathian would be entitled to compete for engagement as Rehbar-e-<br \/>\nTaleem at Middle School, Morian.\n<\/p>\n<p>The residents of that part of hamlet Morian which falls in another<br \/>\nVillage Galuthi of a different Tehsil, i.e, Rajouri, would have, thus, no<br \/>\nright to consideration for engagement.\n<\/p>\n<p>Deputy Commissioner, Rajouri&#8217;s Communication impugned in the<br \/>\nWrit Petition, whereby residents of hamlet Morian falling in Village<br \/>\nGaluthi, too have been ordered to be considered for participation in the<br \/>\nselection process is, thus, illegal being against the Scheme formulated<br \/>\nvide Government Order No.396- Edu of 2000 dated 28.04.2000 and the<br \/>\nGovernment orders issued in this behalf.\n<\/p>\n<p><span class=\"hidden_text\">5<\/span><\/p>\n<p>The claim of M\/s Mehmood Ahmed and Naim Kosar to<br \/>\nengagement as Rehbar-e-Taleem in Middle School, Morian, is,<br \/>\ntherefore, untenable.\n<\/p>\n<p>For all what has been said above, this Petition succeeds and is,<br \/>\naccordingly, allowed quashing Deputy Commissioner, Rajouri&#8217;s<br \/>\nCommunication No.HQA\/DCR\/816-18 dated 29.08.2006 whereby<br \/>\nresidents of hamlet Morian falling in Village Galuthi too were allowed<br \/>\nparticipation for selection as Rehbar-e-Taleem.<br \/>\nA direction shall, therefore, issue to respondent Nos. 1 to 4 to<br \/>\noperate the earlier Panel in which the petitioners figured at Serial Nos.1<br \/>\n&amp; 2, to consider them for selection and engagement as Rehbar-e-<br \/>\nTaleem. Requisite orders shall be passed by the respondents in this<br \/>\nbehalf within a period of eight weeks.\n<\/p>\n<p>( J. P.
