SHRI SURENDRA NAIK, SON OF LATE LAXMI NARAYAN NAIK,\n      5 AND 6 ARESIDENT OF MAUJA CHAK LOKMAN, POLICE STATION\n      DALSING SARAI, DISTRICT SAMASTIPUR\n                                ********\n<\/pre>\n<p>4    03\/11\/2011             There   is   a   dispute    over   plot    no.   548<\/p>\n<p>                   measuring 2 decimals on which there is a well and a<\/p>\n<p>                   temple. The petitioner claims that this belongs to the<\/p>\n<p>                   State of Bihar and that the respondents 5 and 6 are<\/p>\n<p>                   encroachers.\n<\/p>\n<p>                            Accordingly,     an   encroachment        case   was<\/p>\n<p>                   initiated and by order dated 10.07.2007, the Anchal<\/p>\n<p>                   Adhikari, Dalsingsarai has stayed the encroachment<\/p>\n<p>                   proceedings and asked the parties to approach the<\/p>\n<p>                   competent Court for settlement of the dispute.<\/p>\n<p>                            Notices were issued to respondents 5 and 6<\/p>\n<p>                   but they refused to accept notice.\n<\/p>\n<p>                            The order dated 10.07.2007 discloses that the<\/p>\n<p>                   private respondents are claiming title over the lands in<\/p>\n<p>                   question through a sale deed. Obviously, encroachment<br \/>\n<span class=\"hidden_text\">                         2<\/span><\/p>\n<p>        proceedings are not maintainable with respect to the<\/p>\n<p>        raiyati lands and as such the Anchal Adhikari has<\/p>\n<p>        rightly stayed the encroachment proceedings and asked<\/p>\n<p>        the parties to get the dispute settled through a<\/p>\n<p>        competent Court.\n<\/p>\n<p>                 This Court finds no illegality in the order<\/p>\n<p>        impugned.
