Justice M.SASIDHARAN NAMBIAR\n\n Dated :09\/10\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n              ------------------------------------------\n                W.P.C.NO. 27055 OF 2009\n              ------------------------------------------\n               Dated        9th October 2009\n\n                          JUDGMENT\n<\/pre>\n<p>           Petition is filed under Article 226 of<\/p>\n<p>Constitution of India for a writ of mandamus directing<\/p>\n<p>the  respondents    to     release         the      vehicle    to the<\/p>\n<p>petitioner  on    conditions           and      to      direct  fourth<\/p>\n<p>respondent,  Sub    Inspector              to     investigate    crime<\/p>\n<p>No.481\/2009    of          Nadakkavu              police       station<\/p>\n<p>expeditiously.    Case of the petitioner is that on<\/p>\n<p>17\/8\/2009 at about      5.30 p.m the motor                bike of the<\/p>\n<p>petitioner KL-11\/AB-5032, which was parked near Thej<\/p>\n<p>Motors, a workshop where the petitioner used to repair<\/p>\n<p>the vehicle,  was taken away by third respondent Sub<\/p>\n<p>Inspector  of  police       and     at     the      time   of  seizure<\/p>\n<p>petitioner was not given any receipt                     acknowledging<\/p>\n<p>the seizure and even though petitioner contacted                   the<\/p>\n<p>third respondent thereafter, he was informed that<\/p>\n<p>there was suspected tampering of engine number and<\/p>\n<p>chassis number and therefore, it is to be examined by<\/p>\n<p>the Forensic Scientific Lab at Kannur and even after<\/p>\n<p>lapse of months vehicle was not produced before the<\/p>\n<p>court  and  was     also      not      released         and   in  such<\/p>\n<p>WPC 27055\/09<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>circumstances, a direction is to be issued to release<\/p>\n<p>the vehicle.\n<\/p>\n<p>           2.  Learned    Government    Pleader    on<\/p>\n<p>instructions   submitted that the  vehicle was found<\/p>\n<p>in abandoned stage and therefore, it was seized and<\/p>\n<p>the factum of seizure was reported to the first<\/p>\n<p>respondent   Sub   Divisional  Magistrate,   and   on<\/p>\n<p>examination of the vehicle it was found that there<\/p>\n<p>was suspected tampering of the engine number and<\/p>\n<p>chassis number and therefore, the matter is to be<\/p>\n<p>investigated. Learned   Government Pleader submitted<\/p>\n<p>that there is no objection for releasing the vehicle<\/p>\n<p>to the petitioner, provided he produces the vehicular<\/p>\n<p>documents and also undertaking that the       vehicle<\/p>\n<p>shall be produced as and when required for the<\/p>\n<p>purpose of investigation. Learned   counsel appearing<\/p>\n<p>for the petitioner submitted  that pursuant to Ext.P3<\/p>\n<p>notice    copies of vehicular documents were already<\/p>\n<p>produced.\n<\/p>\n<p>           3.  Writ petition is disposed directing<\/p>\n<p>fourth respondent to release the vehicle to the<\/p>\n<p>WPC 27055\/09<br \/>\n<span class=\"hidden_text\">                             3<\/span><\/p>\n<p>petitioner,   on   furnishing   necessary   vehicular<\/p>\n<p>documents and   submitting the   undertaking.
