Justice P.BHAVADASAN\n\n Dated :24\/03\/2010\n\n O R D E R\n                       P.BHAVADASAN, J.\n                       -------------------------\n                     C.R.P No.844 of 2008\n                       --------------------------\n               Dated this the 24th March, 2010\n\n                             O R D E R\n<\/pre>\n<p>      Petitioner challenges the order dated 30.8.2008<\/p>\n<p>passed by the Taluk Land Board, Taliparamba.         Revision<\/p>\n<p>petitioner claims possession over 2 acres and 21 3\/4 cents<\/p>\n<p>of land comprised in Re.Sy.No.30\/2 of Panniyoor amsom.<\/p>\n<p>It is stated that her father had obtained the property on<\/p>\n<p>tenancy right. It is also stated that her father had obtained<\/p>\n<p>purchase certificate    in respect of the property as per<\/p>\n<p>order   in   O.A   No.9647\/76       of   the    Land Tribunal,<\/p>\n<p>Taliparamba. Revision petitioner obtained the property as<\/p>\n<p>per Sale deed No.3504\/93 of S.R.O. Taliparamba from her<\/p>\n<p>father.\n<\/p>\n<p>      2.    The petitioner preferred a claim petition under<\/p>\n<p>Section 85 (8) of the Kerala Land Reforms Act on the basis<\/p>\n<p>of the gift deed executed in her favour by her father. She<\/p>\n<p>produced certain documents before the Taluk Land Board<\/p>\n<p>to establish her       claim. She also pointed out that<\/p>\n<p>proceedings under 85 (A) of the Act is misconceived<\/p>\n<p>because of her possession over the property. In spite of the<\/p>\n<p>C.R.P No.844 of 2008<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>above objections and documents produced by her, without<\/p>\n<p>considering any of them, the impugned order has been<\/p>\n<p>passed.\n<\/p>\n<p>      3.     Learned counsel appearing for the petitioner<\/p>\n<p>pointed out that Sri.C.V Koran taken by the Taluk Land<\/p>\n<p>Board     as the declarent had nothing to do with the<\/p>\n<p>property. Several documents were produced to establish<\/p>\n<p>her claim over the property.       Without considering the<\/p>\n<p>documents produced by the petitioner, the impugned order<\/p>\n<p>has been passed.\n<\/p>\n<p>      4.     There seems to be considerable force in the<\/p>\n<p>submission made by the learned counsel for the petitioner.<\/p>\n<p>From the materials available, it is seen that the petitioner<\/p>\n<p>had definite claim that property did not belong to Sri.<\/p>\n<p>C.V.Koran and in fact belong to Sri.Mammad Kunji Haji.<\/p>\n<p>She had also produced purchase certificate obtained from<\/p>\n<p>her father and assignment deed executed in her favour. It<\/p>\n<p>is also significant to note that the claim gets support from<\/p>\n<p>the report of the Revenue Inspector. Under these<\/p>\n<p>circumstances, the Taluk Land Board was not justified in<\/p>\n<p>C.R.P No.844 of 2008<br \/>\n<span class=\"hidden_text\">                               3<\/span><\/p>\n<p>declining the relief prayed for by the petitioner.
